【摘要】：大學(xué)依法治校是依法治國方略在高等教育領(lǐng)域的具體化與現(xiàn)實化,既是理論研究的熱點問題也是實踐應(yīng)用的重大課題。 大學(xué)章程之對于大學(xué)依法治校的意義就是以“基本法”的地位保障大學(xué)能基于其特有的組織屬性,遵循高等教育運行規(guī)律,充分履行好其人才培養(yǎng)、科學(xué)研究、社會服務(wù)和文化創(chuàng)新的職能,實現(xiàn)學(xué)者治學(xué)、教授治校、學(xué)術(shù)自由、學(xué)生成才的教育理想,養(yǎng)成大學(xué)精神,培育大學(xué)文化,并在此過程中提高制度反省和文化自覺能力,形成以章程建設(shè)引領(lǐng)和促進大學(xué)內(nèi)部綜合改革,推動現(xiàn)代大學(xué)制度建設(shè)的良好局面。 論文主要研討四個問題：大學(xué)是什么、何謂大學(xué)章程、應(yīng)然的大學(xué)章程、我國大學(xué)章程現(xiàn)狀及其制定改進。為使研究更具有實踐針對性,論題所指大學(xué)章程是中國大陸公立高等院校之大學(xué)章程。 通過文獻檢索與研究、實地調(diào)查與專家訪談、比較研究等綜合方法,針對我國現(xiàn)有大學(xué)章程制定中的主要不足提出了改進建議：(1)建設(shè)大學(xué)文化,培育教育信仰與熟成法治意識；(2)廣延制定主體,增強利益相關(guān)者實際參與性；(3)完善制定程序,提升大學(xué)章程的法律地位；(4)優(yōu)化章程內(nèi)容,突出重要制度安排；(5)改善外部環(huán)境,為章程制定創(chuàng)設(shè)良好生態(tài)。
[Abstract]:Running a university according to law is the embodiment and reality of the strategy of governing the country by law in the field of higher education. It is not only a hot topic of theoretical research but also a major subject of practical application. The significance of the university charter for the university to run the university according to the law is to ensure that the university can, on the basis of its unique organizational attributes, follow the rules of higher education operation, fully fulfill its personnel training, and carry out scientific research on the basis of the status of the "basic Law". The function of social service and cultural innovation, the realization of the educational ideal of scholars, teaching and learning, academic freedom, the cultivation of university spirit, the cultivation of university culture, and the improvement of institutional introspection and cultural consciousness in the process, Forming a good situation of leading and promoting the comprehensive reform in universities with the construction of articles of association and promoting the construction of modern university system. This paper mainly discusses four problems: what is a university, what is a university charter, what should be a university charter, the status quo of the university charter and its formulation and improvement. In order to make the research more practical, the thesis refers to the university charter of public institutions of higher learning in mainland China. Through the comprehensive methods of literature retrieval and research, field investigation and expert interview, comparative study, this paper puts forward some suggestions on how to improve the university culture in view of the main deficiencies in the constitution formulation of the existing universities in China. To cultivate educational belief and know well become the consciousness of rule of law (2) to extend the main body of making, to strengthen the actual participation of stakeholders, to perfect the procedure of making, to improve the legal status of the university constitution and to optimize the contents of the constitution and to stress the important system arrangement; 5) to improve the external environment and create a good ecology for the establishment of articles of association.
