【摘要】：隨著全球經(jīng)濟(jì)的高速發(fā)展，航空運(yùn)輸業(yè)已成為促進(jìn)經(jīng)濟(jì)發(fā)展的重要發(fā)動(dòng)機(jī)和引擎。目前我國(guó)的航空運(yùn)輸業(yè)正處于行業(yè)高速成長(zhǎng)階段，對(duì)經(jīng)濟(jì)的拉動(dòng)作用非常明顯，但也存在諸多不足之處，，適應(yīng)不了改革開(kāi)放和經(jīng)濟(jì)社會(huì)發(fā)展的需要。因此，構(gòu)建起相應(yīng)的法律制度和管理模式，加速我國(guó)航空運(yùn)輸業(yè)的國(guó)際化進(jìn)程，全面進(jìn)入國(guó)際經(jīng)濟(jì)環(huán)境的愿望非常迫切�；诖�，本文主要從行政法的角度分析我國(guó)的航空運(yùn)輸業(yè)的政府規(guī)制情況，以期規(guī)范我國(guó)的航空運(yùn)輸業(yè)。 文章首先在第一章概述航空運(yùn)輸?shù)母拍钆c特征，并說(shuō)明了行政法律規(guī)制的內(nèi)涵和特點(diǎn)，為政府對(duì)航空運(yùn)輸業(yè)的法律規(guī)制做了鋪墊。接著在第二章介紹了我國(guó)航空運(yùn)輸業(yè)的行政法律規(guī)制發(fā)展歷史與現(xiàn)狀，提出目前我國(guó)政府在規(guī)制航空運(yùn)輸業(yè)上出現(xiàn)的不足。文章在第三章探究國(guó)外的發(fā)達(dá)國(guó)家與和我國(guó)有相似發(fā)展途徑的發(fā)展中國(guó)家巴西的經(jīng)驗(yàn)，借鑒國(guó)外的成功經(jīng)驗(yàn)，探究對(duì)我國(guó)政府規(guī)制航空運(yùn)輸業(yè)的啟示文章在第四章將重點(diǎn)放在對(duì)我國(guó)航空運(yùn)輸業(yè)中的行政法律規(guī)制體系構(gòu)建的對(duì)策建議上，本文將從行政立法、行政執(zhí)法與行政監(jiān)督這幾方面提出合理建議，以求進(jìn)一步完善我國(guó)航空運(yùn)輸業(yè)的行政法律規(guī)制。
[Abstract]:With the rapid development of the global economy, air transport has become an important engine and engine to promote economic development. At present, China's aviation transport industry is in the stage of rapid growth of the industry, and it is very obvious to the economy, but there are also many shortcomings to adapt to the needs of reform and opening up and economic and social development. It is very urgent to build up the corresponding legal system and management model to accelerate the international process of China's aviation transport industry and to enter the international economic environment. Based on this, this paper mainly analyzes the government regulation of China's aviation transportation industry from the perspective of administrative law, in order to standardize China's aviation transportation industry.
The first chapter outlines the concept and characteristics of air transport in the first chapter, and explains the connotation and characteristics of administrative legal regulation, and paves the way for the government's legal regulation of air transport industry. Then the second chapter introduces the history and current situation of the development of the administrative legal regulation of China's aviation transportation industry, and puts forward that the government of our country is regulating air transportation at present. In the third chapter, the third chapter explores the experience of the developed countries of foreign countries and the developing countries with similar development ways in China, drawing on the successful experience of foreign countries, and exploring the inspiration for the government regulation of the air transport industry in our country. The fourth chapter will focus on the administrative legal regulation of China's aviation transportation industry. On the proposal of the system construction, this article will put forward reasonable suggestions from administrative legislation, administrative law enforcement and administrative supervision in order to further improve the administrative legal regulation of China's aviation transportation industry.
