論完善我國(guó)行業(yè)協(xié)會(huì)懲戒權(quán)的法律規(guī)制

【摘要】:當(dāng)前我國(guó)經(jīng)濟(jì)改革的深入開(kāi)展,市場(chǎng)是經(jīng)濟(jì)運(yùn)行中的重要環(huán)節(jié),并且我國(guó)將市場(chǎng)經(jīng)濟(jì)的改革和發(fā)展列為我國(guó)經(jīng)濟(jì)發(fā)展的重要目標(biāo)。那么就意味著政府進(jìn)一步削弱其權(quán)力對(duì)市場(chǎng)限制,使的市場(chǎng)更加靈活的調(diào)配資源,自由的運(yùn)行。政府職能的轉(zhuǎn)型,在市場(chǎng)中位置逐漸轉(zhuǎn)換的過(guò)程中,社會(huì)組織的地位與日俱增。那么行業(yè)協(xié)會(huì)作為眾多企業(yè)自治的產(chǎn)物,在維護(hù)行業(yè)內(nèi)企業(yè)共同利益,管理行業(yè)秩序,協(xié)調(diào)內(nèi)部關(guān)系上都發(fā)揮著越來(lái)越重要的作用。就目前我國(guó)國(guó)內(nèi)市場(chǎng)現(xiàn)狀的分析,我國(guó)行業(yè)協(xié)會(huì)與國(guó)外領(lǐng)先的市場(chǎng)水平還有一些差距。因此,為了促進(jìn)企業(yè)在行業(yè)協(xié)會(huì)管理下的發(fā)展,就必須對(duì)行業(yè)協(xié)會(huì)的管理制度進(jìn)行相應(yīng)的調(diào)整和完善。而行業(yè)協(xié)會(huì)的懲戒權(quán)作為管理和維護(hù)行業(yè)內(nèi)部穩(wěn)定的保障,也是行業(yè)協(xié)會(huì)管理制度調(diào)整的重要環(huán)節(jié)。但懲戒權(quán)作為權(quán)力的使用,需要進(jìn)行法律規(guī)制,以求行業(yè)協(xié)會(huì)能夠規(guī)范正確的使用懲戒權(quán),更好的維護(hù)行業(yè)秩序和市場(chǎng)秩序。本文運(yùn)用比較法和理論分析法,借鑒國(guó)外先進(jìn)的關(guān)于行業(yè)協(xié)會(huì)的自治權(quán)的相關(guān)規(guī)定,并與我國(guó)現(xiàn)階段的成果進(jìn)行相應(yīng)的對(duì)比,并且過(guò)程中參考國(guó)內(nèi)外學(xué)者的研究,結(jié)合我國(guó)的現(xiàn)狀和政策發(fā)展方向,對(duì)行業(yè)協(xié)會(huì)懲戒權(quán)制度的構(gòu)建提出一些可行性建議。為了論證可行性建議,本文將分為以下四章來(lái)進(jìn)行論述:第一章主要論述行業(yè)協(xié)會(huì)懲戒權(quán)的適用及其性質(zhì)。了解行業(yè)協(xié)會(huì)懲戒權(quán)的適用主體、規(guī)范客體和內(nèi)容,并且理清他們之間的關(guān)系,有助于加深對(duì)行業(yè)協(xié)會(huì)懲戒權(quán)理論上的了解。并且分析行業(yè)協(xié)會(huì)懲戒權(quán)的性質(zhì),從自律性和契約性來(lái)闡述懲戒權(quán)的本質(zhì)。第二章主要是對(duì)行業(yè)協(xié)會(huì)懲戒權(quán)進(jìn)行法律規(guī)制的理論基礎(chǔ)進(jìn)行論述。透過(guò)對(duì)行業(yè)協(xié)會(huì)懲戒權(quán)的兩個(gè)原則的概述,闡明法律規(guī)制的重要性。而且指出行業(yè)協(xié)會(huì)懲戒權(quán)的法律規(guī)制在實(shí)際運(yùn)用中發(fā)揮的作用作為其依據(jù),體現(xiàn)其價(jià)值。第三章主要對(duì)行業(yè)協(xié)會(huì)懲戒權(quán)的現(xiàn)狀進(jìn)行分析。首先找出行業(yè)協(xié)會(huì)懲戒權(quán)在我國(guó)所面對(duì)的幾個(gè)主要問(wèn)題,其次透過(guò)對(duì)我國(guó)現(xiàn)狀分析以及國(guó)外經(jīng)驗(yàn)分析,了解國(guó)內(nèi)外之間的差距,并為提出可行性建議提供思路。第四章主要是從第三章所提出的問(wèn)題入手,提出相應(yīng)的完善建議。從行業(yè)協(xié)會(huì)的主體定位、程序應(yīng)用到最后的救濟(jì)制度,分別提出一些可行性建議。
[Abstract]:At present, with the development of economic reform in our country, the market is an important link in the economic operation, and the reform and development of the market economy is regarded as the important target of our country's economic development. That means that the government further weakens its power to restrict the market, making the market more flexible to allocate resources and operate freely. With the transformation of government function, social organization is becoming more and more important in the process of changing position in the market. Then, as the product of many enterprises' autonomy, trade associations play a more and more important role in safeguarding the common interests of enterprises, managing the order of the industry, and coordinating the internal relations. Based on the analysis of the present situation of domestic market in China, there is still some gap between China's trade association and the leading market level of foreign countries. Therefore, in order to promote the development of enterprises under the management of trade associations, the management system of trade associations must be adjusted and perfected accordingly. As the guarantee of management and maintenance of the industry internal stability, the disciplinary power of the trade association is also an important link in the adjustment of the management system of the trade association. However, as the use of power, disciplinary power needs to be regulated by law in order for the trade association to regulate the correct use of disciplinary power and to better maintain the order of the industry and the market. This article uses the comparative method and the theory analysis method, draws lessons from the foreign advanced related stipulation about the profession association's autonomy, and carries on the corresponding contrast with our country's present stage achievement, and in the process consults the domestic and foreign scholar's research. Combined with the current situation and policy development direction of our country, some feasible suggestions on the construction of disciplinary power system of trade association are put forward. In order to prove the feasibility, this paper will be divided into the following four chapters: the first chapter mainly discusses the application and nature of disciplinary power of trade association. Understanding the applicable subject, standardizing the object and content of the disciplinary power of the trade association, and clarifying the relationship between them will help to deepen the theoretical understanding of the disciplinary power of the trade association. It also analyzes the nature of disciplinary power of trade association and expounds the nature of disciplinary power from self-discipline and contract. The second chapter mainly discusses the theoretical basis of the legal regulation of the disciplinary power of trade associations. This paper expounds the importance of legal regulation by summarizing the two principles of disciplinary power of trade associations. It also points out that the legal regulation of disciplinary power of trade association acts as its basis and embodies its value. The third chapter mainly analyzes the current situation of disciplinary power of industry association. First of all, we find out the main problems of the disciplinary power of trade association in our country, and then through the analysis of the present situation of our country and the analysis of foreign experience, we understand the gap between domestic and foreign countries, and provide some ideas for putting forward feasible suggestions. The fourth chapter is mainly from the third chapter raised the question, proposed the corresponding consummation proposal. From the position of the main body of the trade association and the application of the procedure to the final relief system, some feasible suggestions are put forward.
