【摘要】：程序失當(dāng)行政行為是不當(dāng)行政行為的主要形式之一,規(guī)制程序失當(dāng)行政行為是法治政府建設(shè)的必然要求。程序失當(dāng)行政行為的認(rèn)定可以從程序錯(cuò)誤和程序瑕疵兩方面進(jìn)行考量。程序失當(dāng)行政行為主要表現(xiàn)為自定程序、民主程序缺失、行政不作為與慢作為等。規(guī)制程序失當(dāng)行政行為應(yīng)當(dāng)充分發(fā)揮合理性原則與正當(dāng)程序原則的作用,并對(duì)相關(guān)行為人進(jìn)行歸責(zé)。
[Abstract]:Procedural misconduct is one of the main forms of improper administrative behavior, and the regulation of procedural misconduct is an inevitable requirement for the construction of a government ruled by law. The identification of procedural misconduct can be considered from two aspects: procedural error and procedural flaw. The administrative behavior of procedural misconduct is mainly manifested as self-determination procedure, democratic procedure deficiency, administrative omission and slow action, etc. In order to regulate the administrative act of procedural misconduct, the rational principle and the due process principle should be brought into full play, and the relevant actors should be imputed.
