【摘要】：對電影內(nèi)容進(jìn)行審查是國家電影管理機(jī)構(gòu)對電影進(jìn)行監(jiān)督管理的主要方式,電影管理的制度是否完善,不僅影響著包括電影從業(yè)者和觀眾的權(quán)益,而且對電影行業(yè)的發(fā)展有著重要作用。電影審查是電影能否公映的準(zhǔn)入程序,是一種行政許可行為。電影審查由政府電影管理部門負(fù)責(zé),對電影內(nèi)容進(jìn)行審查。對內(nèi)容符合規(guī)定的電影頒發(fā)電影公映許可證,對內(nèi)容不符合規(guī)定的內(nèi)容要求送審方進(jìn)行刪改,從而達(dá)到上映標(biāo)準(zhǔn)。在現(xiàn)今我國電影市場蓬勃發(fā)展的趨勢下,我國電影審查制度受到各方的關(guān)注,在審查制度屢屢暴露問題時,其合理性越來越受到懷疑,甚至有人主張實行國外的電影分級管理制度。國外電影管理制度中的先進(jìn)經(jīng)驗我國可以充分借鑒,為我國電影審查制度改革提供良好范例,然而我國電影行業(yè)有其特殊性,不能盲目照搬國外電影管理制度。所以在此基礎(chǔ)上,筆者期望借由這篇文章,分析我國現(xiàn)行的電影審查制度,對英美等國家和地區(qū)的電影管理制度中的優(yōu)點(diǎn)加以分析借鑒,并結(jié)合我國電影管理的現(xiàn)狀,對我國電影審查制度的改進(jìn)從立法角度提出個人建議,希望借由制定《電影法》或《電影促進(jìn)法》的契機(jī),促進(jìn)我國審查制度的完善。本文共分為四個部分,主要內(nèi)容如下： 一、簡析我國電影審查制度。從我國電影審查的歷史概況,審查活動從所依據(jù)的法律法規(guī)、審查主體和審查內(nèi)容四個方面敘述我國電影審查制度的概況。最后分析我國電影審查制度的優(yōu)勢和不足。 二、分析我國電影審查制度改革方向及其依據(jù)。電影審查制度暴露出一些缺陷,對電影產(chǎn)業(yè)的發(fā)展產(chǎn)生不利影響,因此我國應(yīng)當(dāng)改革電影審查制度。在提倡政府職能轉(zhuǎn)變,下放行政權(quán)力、嚴(yán)簡審批事項、簡化行政程序的今天,行政體制的改革也為我國電影審查制度的改革指明了方向。 三、從比較法角度分析國外和地區(qū)電影管理制度對我國電影審查制度的借鑒。對美國、英國、韓國和我國香港地區(qū)電影管理制度中的優(yōu)點(diǎn)加以分析以供我國電影審查制度改革所參考。 四、對我國電影審查制度提出個人建議。通過建議推進(jìn)電影領(lǐng)域的立法進(jìn)程,從而主張建立一套從依據(jù)的法律法規(guī)、審查機(jī)構(gòu)和審查標(biāo)準(zhǔn)均適合我國國情的電影審查制度,以促進(jìn)我國電影事業(yè)的發(fā)展。
[Abstract]:Censorship of film content is the main way for the State Film Administration to supervise and manage films. Whether the film management system is perfect or not affects not only the rights and interests of film practitioners and viewers, but also the rights and interests of film practitioners and viewers. And the development of the film industry has an important role. Film censorship is the admission procedure of whether the film can be released, and it is an administrative licensing act. Film censorship is the responsibility of the government film management department to review the content of the film. Issue film release license to the film that the content conforms to the regulation, delete the content that does not conform to the specified content requirement, so as to meet the exhibition standard. With the booming development of the film market in our country nowadays, the film censorship system in our country has been concerned by all sides. When the censorship system is exposed frequently, its rationality is more and more questioned. Some even advocate the implementation of foreign film grading management system. The advanced experience in the foreign film management system can be fully used for reference in our country, which can provide a good example for the reform of the film censorship system in our country. However, the film industry in our country has its particularity and can not blindly copy the foreign film management system. Therefore, on this basis, the author expects to use this article to analyze the current film censorship system in China, to analyze the advantages of the film management system in Britain and the United States and other countries and regions, and to combine the current situation of film management in our country. This paper puts forward some personal suggestions on the improvement of China's film censorship system from the angle of legislation, hoping to promote the perfection of our country's censorship system by the opportunity of formulating the Film Law or the Film Promotion Law. This paper is divided into four parts, the main contents are as follows: first, a brief analysis of China's film censorship system. This paper describes the general situation of China's film censorship system from four aspects: the historical overview of Chinese film censorship, the review activities from the laws and regulations based on, the subject of the review and the content of the review. Finally, it analyzes the advantages and disadvantages of China's film censorship system. Second, it analyzes the direction and basis of the reform of China's film censorship system. The film censorship system exposes some defects and has a negative impact on the development of the film industry. Therefore, our country should reform the film censorship system. Today, when we advocate the transformation of government functions, decentralization of administrative power, strict simplification of examination and approval matters, and simplification of administrative procedures, the reform of the administrative system has also pointed out the direction for the reform of the film censorship system in our country. From the perspective of comparative law, this paper analyzes the foreign and regional film management system for reference to China's film censorship system. This paper analyzes the advantages of the film management system in the United States, Britain, South Korea and Hong Kong in order to provide a reference for the reform of the film censorship system in China. Fourth, it puts forward some personal suggestions on the film censorship system in China. In order to promote the development of China's film industry, it is proposed to establish a set of laws and regulations based on which the censors and standards are suitable for the national conditions of our country through the proposal to promote the legislative process in the field of film.
