新農(nóng)村基礎(chǔ)設(shè)施建設(shè)的法律保障研究

【摘要】:“十八大”報(bào)告中指出,“要堅(jiān)持把國(guó)家基礎(chǔ)設(shè)施建設(shè)和社會(huì)事業(yè)發(fā)展重點(diǎn)放在農(nóng)村,深入推進(jìn)新農(nóng)村建設(shè)和扶貧開(kāi)發(fā),全面改善農(nóng)村生產(chǎn)生活條件”。農(nóng)村基礎(chǔ)設(shè)施建設(shè)多年來(lái)一直都是中央政府報(bào)告中關(guān)于新農(nóng)村建設(shè)的重點(diǎn)所在,國(guó)家力圖加大資本投入來(lái)保障農(nóng)村基礎(chǔ)設(shè)施的供給,從而加快新型城鎮(zhèn)化的建設(shè)的速度。農(nóng)村基礎(chǔ)設(shè)施是我國(guó)新農(nóng)村建設(shè)的載體,農(nóng)村基礎(chǔ)設(shè)施建設(shè)是新農(nóng)村建設(shè)的必經(jīng)途徑。本文是在依法治農(nóng)原則的指導(dǎo)下,,力求得出一系列法律指導(dǎo)措施,完善農(nóng)村基礎(chǔ)設(shè)施的法律保障體系。 農(nóng)村基礎(chǔ)設(shè)施就是在適應(yīng)農(nóng)村需求的基礎(chǔ)上,為發(fā)展農(nóng)村生產(chǎn)和保證農(nóng)民生活所需要的公共服務(wù)設(shè)施的總和。由于農(nóng)村基礎(chǔ)設(shè)施具有非競(jìng)爭(zhēng)性和非排他性,因而,從屬性來(lái)看,農(nóng)村基礎(chǔ)設(shè)施屬于公共產(chǎn)品領(lǐng)域。目前,我國(guó)農(nóng)村基礎(chǔ)設(shè)施建設(shè)存在著很多的不足之處,例如建設(shè)規(guī)劃不合理、建設(shè)結(jié)構(gòu)不合理、建設(shè)投融資渠道單一、建設(shè)監(jiān)管不到位等。在農(nóng)村基礎(chǔ)設(shè)施建設(shè)的法律保障中存在著統(tǒng)籌城鄉(xiāng)一體化發(fā)展法治理念的缺失、農(nóng)村基礎(chǔ)設(shè)施建設(shè)法律主體的缺位、農(nóng)業(yè)投資立法上的不足、農(nóng)民參與權(quán)保障的缺乏等一系列的問(wèn)題。 本文通過(guò)對(duì)美國(guó)、日本、法國(guó)等發(fā)達(dá)國(guó)家農(nóng)村基礎(chǔ)設(shè)施建設(shè)的介紹,了解不同國(guó)家在農(nóng)村基礎(chǔ)設(shè)施建設(shè)中的經(jīng)驗(yàn),對(duì)我國(guó)農(nóng)村基礎(chǔ)設(shè)施建設(shè)提出了多角度的發(fā)展思路。 在農(nóng)村基礎(chǔ)設(shè)施建設(shè)的法律保障研究中,提出了建立完善的農(nóng)村基礎(chǔ)設(shè)施規(guī)劃制度、建立完善的農(nóng)村基礎(chǔ)設(shè)施建設(shè)主體法律制度、建立完善的農(nóng)村基礎(chǔ)設(shè)施資金投入法律制度的建議以及保障農(nóng)村基礎(chǔ)設(shè)施的基本原則。通過(guò)農(nóng)村基礎(chǔ)設(shè)施法律保障體系的完善,實(shí)現(xiàn)農(nóng)村經(jīng)濟(jì)的穩(wěn)步提升,加速我國(guó)新農(nóng)村建設(shè)的步伐,為我國(guó)實(shí)現(xiàn)中華民族偉大復(fù)興的中國(guó)夢(mèng)奠定基礎(chǔ)。
[Abstract]:In the report of the 18th National Congress of the CPC, it was pointed out that "it is necessary to focus on the construction of state infrastructure and the development of social undertakings in rural areas, deepen the construction of new rural areas and help the poor, and comprehensively improve the conditions of production and living in rural areas." The construction of rural infrastructure has been the focus of the central government report on the construction of new rural areas for many years, the state is trying to increase capital investment to protect the supply of rural infrastructure, so as to speed up the pace of the construction of new urbanization. Rural infrastructure is the carrier of new rural construction in China, and rural infrastructure construction is the necessary way of new rural construction. Under the guidance of the principle of administering agriculture according to law, this paper tries to obtain a series of legal guiding measures to perfect the legal guarantee system of rural infrastructure, which is based on adapting to the needs of rural areas. The sum of the public services needed to develop rural production and ensure farmers' livelihood. Because rural infrastructure is non-competitive and non-exclusive, rural infrastructure belongs to the field of public goods. At present, there are many deficiencies in the construction of rural infrastructure in China, such as unreasonable construction planning, unreasonable construction structure, single investment and financing channels of construction, inadequate supervision of construction and so on. In the legal guarantee of rural infrastructure construction, there is a lack of the concept of the rule of law in the overall development of urban and rural areas, the absence of legal subjects in rural infrastructure construction, and the lack of legislation on agricultural investment. Through the introduction of rural infrastructure construction in developed countries such as the United States, Japan, France and other developed countries, this paper explores the experiences of different countries in rural infrastructure construction. In the study of the legal guarantee of rural infrastructure construction, the author puts forward the establishment of a perfect rural infrastructure planning system. The main body legal system of rural infrastructure construction should be established, the suggestion of perfect rural infrastructure investment legal system should be established, and the basic principles of rural infrastructure should be guaranteed. Through the perfection of the legal guarantee system of rural infrastructure, the steady improvement of rural economy is realized, the pace of new rural construction is accelerated, and the foundation of Chinese Dream for the great rejuvenation of the Chinese nation is laid.
