【摘要】：日新月異的科學技術(shù)使我們的日常生活發(fā)生了近乎翻天覆地的變化，其中最有影響力的莫過于因特網(wǎng)的發(fā)展。在如今快節(jié)奏、講求效率的現(xiàn)代社會，因特網(wǎng)最具突破性的直接影響人們生活方式的是網(wǎng)絡(luò)交易的發(fā)展。網(wǎng)絡(luò)交易的飛速發(fā)展給人們生活帶來傳統(tǒng)交易所不能比擬的快捷、高效等便利時，也不可避免的會滋生網(wǎng)絡(luò)交易欺詐，隨著其發(fā)展的深入，網(wǎng)絡(luò)交易欺詐行為越來越多，危害越來越大、越來越廣，不得不引起人們的高度重視。在享受網(wǎng)絡(luò)交易給我們帶來便利的同時，網(wǎng)絡(luò)交易雙方關(guān)于規(guī)制網(wǎng)絡(luò)交易欺詐行為的呼聲也越來越高。本文中，筆者針對現(xiàn)實中普遍存在的網(wǎng)絡(luò)交易欺詐行為，深入剖析其危害性及主要特征，聯(lián)系我國網(wǎng)絡(luò)交易環(huán)境的實際，借鑒國外相關(guān)立法的先進經(jīng)驗，提出了規(guī)制我國網(wǎng)絡(luò)交易欺詐行為的相關(guān)對策措施。 全文除了引言、結(jié)語外，共分為四個部分。 第一部分概述了網(wǎng)絡(luò)交易欺詐行為的基本問題。首先對網(wǎng)絡(luò)交易欺詐行為的成因進行了一定分析，由于互聯(lián)網(wǎng)絡(luò)的飛速發(fā)展、網(wǎng)絡(luò)交易監(jiān)管的不健全、維權(quán)的困難性以及法律法規(guī)不健全等原因?qū)е戮W(wǎng)絡(luò)交易欺詐行為的頻發(fā)。再者，本部分對網(wǎng)絡(luò)交易欺詐行為下定義并指出網(wǎng)絡(luò)交易欺詐行為具有隱蔽性、廣泛性、簡便性、技術(shù)性等新特征，這些特征在提出相關(guān)規(guī)制對策時均應(yīng)充分加以考慮。此外還闡述了其構(gòu)成要件，，最后，還簡述了目前存在的網(wǎng)絡(luò)交易欺詐行為主要包括信息欺詐、網(wǎng)絡(luò)陷阱欺詐、網(wǎng)絡(luò)釣魚欺詐等基本類型。 第二部分闡述了我國關(guān)于網(wǎng)絡(luò)交易欺詐行為法律規(guī)制的現(xiàn)狀及其困境。我國目前關(guān)于網(wǎng)絡(luò)交易欺詐行為的法律規(guī)制，最有成效的莫過于《電子簽名法》的出臺，本法明確了電子簽名的效力以及相關(guān)規(guī)則，使我國關(guān)于網(wǎng)絡(luò)交易欺詐行為立法步上了一個新臺階。與此同時，我們也要看到我國現(xiàn)今相關(guān)立法的困境，諸如：立法過于原則化；由于缺乏網(wǎng)絡(luò)交易證據(jù)保全制度，網(wǎng)絡(luò)欺詐行為證據(jù)難以保全；網(wǎng)絡(luò)交易欺詐案件的執(zhí)行困難等等。 第三部分主要是關(guān)于國外對網(wǎng)絡(luò)交易欺詐行為的法律規(guī)制的現(xiàn)狀的考察及其評價。本部分重點介紹了美國、歐盟、新加坡、澳大利亞等國規(guī)制網(wǎng)絡(luò)交易欺詐行為的先進立法，包括美國的《統(tǒng)一計算機信息交易法》、《統(tǒng)一電子交易法》、《國際與國內(nèi)電子商務(wù)簽章法》、歐盟的《電子簽名指令》及《電子商務(wù)指令》、新加坡的《電子交易法》以及澳大利亞的《電子交易法》。本文對這些法律進行了簡單介紹，通過分析指出了其先進之處以及值得我國借鑒的地方。 第四部分是本文的重點，提出了關(guān)于規(guī)制我國網(wǎng)絡(luò)交易欺詐行為的法律對策。針對我國現(xiàn)行法律體制在規(guī)范網(wǎng)絡(luò)交易方面的不足，筆者認為對于網(wǎng)絡(luò)交易欺詐行為的立法應(yīng)當先進行綜合立法，再不斷根據(jù)我國網(wǎng)絡(luò)交易環(huán)境實際細化出臺具體的相關(guān)法律。本部分主要包括明確網(wǎng)絡(luò)交易平臺提供商的監(jiān)管義務(wù)；規(guī)范確立網(wǎng)絡(luò)實名制；建立完善的網(wǎng)絡(luò)交易證據(jù)保全制度；建立健全網(wǎng)絡(luò)交易欺詐在線解決糾紛機制；完善保護消費者個人信息的法律規(guī)制等措施，來減少網(wǎng)絡(luò)交易欺詐行為的發(fā)生。
[Abstract]:The rapid development of network transaction brings convenience to people ' s life style . In this paper , the author analyzes its harmfulness and its main characteristics in order to bring convenience to people ' s life . In this paper , the author puts forward some countermeasures to regulate the fraudulent behavior of network transaction in China .

In addition to the introduction , the conclusion is divided into four parts .

The first part summarizes the basic problems of network transaction fraud . Firstly , the causes of network transaction fraud are analyzed . Due to the rapid development of Internet , the imperfection of network transaction supervision , the difficulty of maintaining the rights and the imperfection of laws and regulations , these characteristics should be taken into consideration .

In the second part , the present state and the predicament of the legal regulation of network transaction fraud are described in the second part . In our country , there is no legal regulation about network transaction fraud . The most effective method is the promulgation of the electronic signature method . This Law clearly defines the effectiveness of the electronic signature and the relevant rules so as to make our country have a new step in the legislation step of fraud . At the same time , we should also see the plight of the relevant legislation in our country , such as : the legislation is too principled ;
Due to the lack of evidence preservation system of network transaction , the evidence of network fraud is difficult to preserve ;
difficulties in the implementation of network transaction fraud cases , etc .

The third part is mainly about the investigation and evaluation of the current situation of the legal regulation of network transaction fraud abroad . This part focuses on the advanced legislation regulating the fraudulent behavior of network transactions in the United States , the European Union , Singapore , Australia and other countries .

The fourth part is the focus of this paper , and puts forward the legal countermeasures to regulate the fraudulent behavior of network transactions in China . In view of the deficiency of the current legal system of China in regulating the network transaction , the author believes that the legislation should firstly carry out comprehensive legislation on the fraudulent behavior of the network transaction , and then , according to the actual refinement of the network transaction environment in our country , the specific relevant laws should be introduced . This part mainly includes the supervision obligation of the provider of the network trading platform .
