【摘要】：國家環(huán)境保護(hù)部于2013年的9月份發(fā)布了《企業(yè)環(huán)境信用評價辦法（試行）（征求意見稿）》，該文件一經(jīng)公布立刻引起了學(xué)界和實務(wù)界的廣泛關(guān)注。從企業(yè)環(huán)境信用評價試點(diǎn)省市的現(xiàn)狀發(fā)現(xiàn)該評價制度存在三大主要的法律問題，第一，企業(yè)環(huán)境信用評價的主體參與模式不健全，突出表現(xiàn)在我國的第三方評價機(jī)構(gòu)發(fā)展緩慢和公眾參與評價的方式單一等等。第二，企業(yè)環(huán)境信用評價標(biāo)準(zhǔn)不合理，如評價指標(biāo)上沒有突出環(huán)境信用、評價指標(biāo)相互交叉和評價方法缺乏科學(xué)性。第三，企業(yè)環(huán)境信用評價結(jié)果應(yīng)用模式不完善，亟需與其他部門、環(huán)境經(jīng)濟(jì)政策和社會信用體系的聯(lián)動。 企業(yè)環(huán)境信用評價的主體參與模式方面，主要針對其出現(xiàn)的問題，分成兩個部分來解決。一方面，應(yīng)當(dāng)確定企業(yè)環(huán)境信用第三方機(jī)構(gòu)獨(dú)立評價制度，這種制度有利于企業(yè)環(huán)境信用評價的科學(xué)性、客觀性和專業(yè)性。第三方機(jī)構(gòu)獨(dú)立評價不單要求該機(jī)構(gòu)自身的不斷完善和政府從中的助推力量，，還要求企業(yè)環(huán)境行為信息數(shù)據(jù)的健全。另一方面，加強(qiáng)公眾參與企業(yè)環(huán)境信用評價，需從評價標(biāo)準(zhǔn)、評價過程和評價結(jié)果應(yīng)用等等方面著手。 分析企業(yè)環(huán)境信用評價標(biāo)準(zhǔn)的問題上，其標(biāo)準(zhǔn)選擇的理論基礎(chǔ)應(yīng)是“生態(tài)人”模式理論，它注重生態(tài)的整體利益和生態(tài)德性。在具體完善措施方面，評價指標(biāo)應(yīng)注重環(huán)境信用、評價方法應(yīng)增強(qiáng)科學(xué)合理性和評價內(nèi)容上應(yīng)強(qiáng)調(diào)企業(yè)環(huán)保法律責(zé)任。 企業(yè)環(huán)境信用評價結(jié)果應(yīng)用模式的健全，有利于政府實施差別化的管理，有利于多部門的協(xié)同合作，也有利于政府企業(yè)公眾之間的良性互動。在結(jié)果應(yīng)用模式中涉及的方面比較多，但最為重要的是加強(qiáng)和三大環(huán)境經(jīng)濟(jì)政策的聯(lián)動，分別是和綠色信貸、綠色保險和綠色證券的聯(lián)動，加強(qiáng)企業(yè)環(huán)境信用評價的獎勵懲罰機(jī)制，最后形成與社會大眾的普遍聯(lián)動，把企業(yè)環(huán)境信用評價制度真正落實到實處，保護(hù)環(huán)境成為企業(yè)自律行為。
[Abstract]:In September 2013, the State Ministry of Environmental Protection issued the "measures for evaluating Environmental Credit of Enterprises (draft for soliciting opinions)", which immediately attracted the attention of academic and practical circles as soon as it was published. From the current situation of the pilot provinces and cities of enterprise environmental credit evaluation, it is found that there are three main legal problems in the evaluation system. First, the main participation mode of enterprise environmental credit evaluation is not perfect. The main manifestations are the slow development of the third-party evaluation institutions and the single way of public participation in evaluation and so on. Second, the evaluation standard of enterprise environmental credit is unreasonable, such as the lack of outstanding environmental credit on the evaluation index, the intersection of evaluation indexes and the lack of scientific evaluation methods. Third, the application model of enterprise environmental credit evaluation results is not perfect, and it needs to be linked with other departments, environmental economic policies and social credit system. The main body participation mode of enterprise environmental credit evaluation is divided into two parts to solve the problems. On the one hand, it is necessary to establish the independent evaluation system of the third party organization of enterprise environmental credit, which is beneficial to the scientific, objective and professional nature of enterprise environmental credit evaluation. The independent evaluation of third-party organizations requires not only the improvement of the organization itself and the power of the government, but also the perfection of the information and data of the environmental behavior of the enterprise. On the other hand, to strengthen public participation in enterprise environmental credit evaluation, we should start from evaluation criteria, evaluation process and application of evaluation results. On the basis of analyzing the evaluation standard of enterprise environmental credit, the theoretical basis of its standard selection should be the theory of "ecological man" mode, which pays attention to the whole benefit and ecological virtue of ecology. In the aspect of concrete consummation measures, the evaluation index should pay attention to the environmental credit, the evaluation method should strengthen the scientific rationality and the evaluation content should emphasize the enterprise environmental protection legal responsibility. The perfect application mode of enterprise environmental credit evaluation results is beneficial to the government to implement differential management, to the cooperation of various departments, and to the benign interaction between the public of government enterprises. There are many aspects involved in the result application model, but the most important thing is to strengthen the linkage with the three major environmental and economic policies, namely, the linkage with green credit, green insurance and green securities. Strengthen the reward and punishment mechanism of enterprise environmental credit evaluation, finally form the general linkage with the public, put the enterprise environmental credit evaluation system into practice, and protect the environment become the self-discipline behavior of the enterprise.
