【摘要】：當(dāng)前,中國政府在環(huán)境信息公開這一問題上取得了一定的進(jìn)展,但總體上仍處于較低的水平。主要體現(xiàn)在政府部門經(jīng)常以“國家秘密”為由不公開環(huán)境信息,以及對(duì)公眾申請(qǐng)環(huán)境信息公開嚴(yán)格進(jìn)行“生產(chǎn)、生活、科研需要”的審查。在完善我國公眾環(huán)境知情權(quán)時(shí),應(yīng)當(dāng)考慮到社會(huì)穩(wěn)定的需求以及政府環(huán)境信息公開的能力。從切實(shí)可行的角度來看,為了平衡政府對(duì)環(huán)境信息的管理權(quán)、政府公開環(huán)境信息的能力和公眾環(huán)境知情權(quán)之間的關(guān)系,應(yīng)當(dāng)在政府信息公開的法律法規(guī)中明確規(guī)定“依法應(yīng)當(dāng)主動(dòng)公開的政府環(huán)境信息不得被確定為國家機(jī)密”;考慮參考目前環(huán)境公益訴訟的做法,規(guī)定符合法定條件的社會(huì)組織可以無需理由申請(qǐng)政府公開環(huán)境信息;鼓勵(lì)“民間環(huán)境信息公開”,并大力提升公眾的環(huán)境科學(xué)素養(yǎng)。
[Abstract]:At present, the Chinese government has made some progress on the issue of environmental information disclosure, but on the whole, it is still at a low level. It is mainly reflected in the fact that government departments often use "state secrets" to not disclose environmental information, and strictly examine the "production, living and scientific research needs" of public applications for environmental information disclosure. In perfecting the public's right to know, we should take into account the needs of social stability and the ability of the government to open environmental information. From a practical point of view, in order to balance the government's right to manage environmental information, the relationship between the ability of the government to disclose environmental information and the public's right to know about the environment, It should be clearly stated in the laws and regulations on the disclosure of government information that "government environmental information which should be disclosed voluntarily according to law shall not be determined as a state secret"; and consider referring to the current practice of environmental public interest litigation, Social organizations that meet the statutory requirements can apply for the disclosure of environmental information without reason; encourage "public environmental information disclosure", and vigorously improve the environmental scientific literacy of the public.
