【摘要】：中國對(duì)非營利組織一直采取以政府為主導(dǎo)的行政化監(jiān)管體制,但其局限性也很明顯,比如監(jiān)管制度約束力不足,重資格預(yù)審、輕行為監(jiān)管,公私權(quán)力邊界模糊,社會(huì)主體的監(jiān)督地位邊緣化等。突破傳統(tǒng)的行政化監(jiān)管體制,需要結(jié)合中國提出的"全面依法治國"戰(zhàn)略,將非營利組織納入法治框架,堅(jiān)持社會(huì)本位、公私法分治和分類監(jiān)管原則,構(gòu)建起"以法制為基礎(chǔ),依托大數(shù)據(jù)等信息技術(shù),形成多元主體聯(lián)動(dòng)監(jiān)督機(jī)制,強(qiáng)化對(duì)非營利組織法律責(zé)任的追究,建立司法救濟(jì)機(jī)制"的法治化監(jiān)管體系,促進(jìn)非營利組織的依法自治。
[Abstract]:China has been adopting a government-led administrative regulatory system for non-profit organizations, but its limitations are also obvious, such as inadequate regulatory system binding, prequalification, less supervision over behavior, and blurred boundaries between public and private powers. The supervision status of the social subject is marginalized and so on. To break through the traditional administrative supervision system, we should combine the strategy of "ruling the country according to law" put forward by China, bring non-profit organizations into the framework of rule of law, adhere to the principles of social standard, public and private law division and classified supervision, and construct a "legal system as the basis." Relying on the information technology such as big data, this paper forms a multi-subject linkage supervision mechanism, strengthens the investigation of the legal responsibility of the non-profit organizations, establishes the legal supervision system of the judicial relief mechanism, and promotes the legal autonomy of the non-profit organizations.
