【摘要】：建設和弘揚法治行政文化是當下依法治國戰(zhàn)略有效推進的重要支點。當前我國法治行政文化尚處于萌芽階段,尤其以當代公職人員法治思維的缺乏為突出表現(xiàn)。其原因大致有三,一是以差序格局為綱的中國傳統(tǒng)互動模式使得中國公職人員的社會人屬性受到了情理文化的顯著影響;二是科層制自身的弊端導致公職人員喪失了自主人格,他們寧可戴著腳鐐跳舞,而不愿充分發(fā)揮其主觀能動性;三是公職人員歸根到底難以擺脫其自然人的逐利屬性,全身心投入到法治行政的洪流之中。因此打破傳統(tǒng)人情關系文化,消除科層制的弊端,克服逐利基因對培育公職人員法治思維意義深遠。
[Abstract]:The construction and promotion of the administrative culture of rule by law is an important fulcrum for the effective promotion of the strategy of governing the country according to law. At present, the administrative culture of rule of law in our country is still in its infancy, especially the lack of legal thinking of public officials. There are three reasons for this: one is that the traditional Chinese interaction mode, which is based on the pattern of different order, makes the social and human attributes of Chinese public officials significantly influenced by the social, rational, and cultural factors; the other is that the malpractice of the hierarchy system results in the loss of the independent personality of the public officials. They would rather dance in fetters than give full play to their subjective initiative; third, public officials are difficult to get rid of their natural person's property of pursuing interests in the final analysis, and devote themselves to the torrent of the administration of the rule of law. Therefore, it is of great significance to break the traditional culture of human relationship, to eliminate the malpractice of the hierarchy system and to overcome the profit-seeking gene to cultivate the public officials' thinking of ruling by law.
