【摘要】：21世紀(jì)以來,我國社會的信息化程度日益加深,互聯(lián)網(wǎng)技術(shù)的不斷進(jìn)步,社會各界對公民個(gè)人信息價(jià)值的認(rèn)識不斷提高,公民個(gè)人信息在收集、加工、使用、儲存以及傳遞等方面越來越便捷,同時(shí)公民個(gè)人信息安全問題在互聯(lián)網(wǎng)廣泛使用的今天已經(jīng)成為一大社會熱點(diǎn)難題。論文從網(wǎng)絡(luò)時(shí)代下公民的個(gè)人信息安全保護(hù)面臨的問題展開討論,以期為我國公民的個(gè)人信息安全保護(hù)提供一些新的思路。論文首先對公民個(gè)人信息的定義進(jìn)行了辨析,根據(jù)不同的分類標(biāo)準(zhǔn)對公民個(gè)人信息作了區(qū)分,公民個(gè)人信息保護(hù)的依據(jù),之后分析了當(dāng)前我國公民個(gè)人信息保護(hù)的現(xiàn)狀,在當(dāng)前保護(hù)下出現(xiàn)的問題。其次,選取了美國與德國兩個(gè)對公民個(gè)人信息保護(hù)采取不同立法模式的國家,了解其先進(jìn)的做法,為我國的公民個(gè)人信息保護(hù)找到有益的借鑒。直到今天為止,中國仍未制定出旨在增強(qiáng)公民個(gè)人信息安全保護(hù)的法律;另一方面,公民大多對其本人的相關(guān)信息缺乏足夠的安全保護(hù)的意識。最后,結(jié)合我國的實(shí)際情況,提出了以統(tǒng)一立法模式的公民個(gè)人信息保護(hù)立法,并且做好與現(xiàn)行法律的協(xié)調(diào)過渡,增強(qiáng)網(wǎng)絡(luò)服務(wù)行業(yè)的自律監(jiān)管也是一種可行有效的途徑,最后想方設(shè)法地提高公民對其本人信息安全的保護(hù)意識,真正地減少對公民個(gè)人信息的侵害,確保公民個(gè)人信息的安全。
[Abstract]:Since the 21st century, the degree of information in our society has deepened day by day, with the continuous progress of Internet technology, the value of citizens' personal information has been continuously improved, and the personal information of citizens is being collected, processed and used. Storage and transmission are becoming more and more convenient. At the same time, the security of personal information has become a hot social problem in the Internet. This paper discusses the problems faced by citizens' personal information security protection in the network age, in order to provide some new ideas for the personal information security protection of Chinese citizens. Firstly, the paper analyzes the definition of citizen's personal information, distinguishes the citizen's personal information according to different classification standards, and then analyzes the current situation of citizen's personal information protection in China. Problems that arise under current protection. Secondly, two countries, the United States and Germany, which adopt different legislative models for the protection of citizens' personal information, are selected to understand their advanced practices, and to find a useful reference for the protection of citizens' personal information in our country. To this day, China has not enacted any laws aimed at enhancing the security of its citizens' personal information. On the other hand, most of its citizens lack sufficient awareness of the security of their own relevant information. Finally, according to the actual situation of our country, it is a feasible and effective way to improve the self-regulation of network service industry by unifying the legislation model of citizen's personal information protection legislation, and making a good coordination and transition with the current law. Finally, we try our best to improve citizens' awareness of protecting their own information security, to reduce the infringement of citizens' personal information, and to ensure the security of citizens' personal information.
