【摘要】：差別性少數(shù)民族權(quán)利的正當(dāng)性問題一直是困擾各國理論工作者與實(shí)踐者的重大議題。基于學(xué)界既有的理論探索和世界民族政治實(shí)踐,本文概括出五種有關(guān)少數(shù)民族差別性權(quán)利正當(dāng)性的理論基礎(chǔ)與范式,即弱勢地位理論范式、道德理論范式、公共性理論范式、歷史性權(quán)利理論范式以及補(bǔ)償-激勵(lì)理論范式。其中前三個(gè)理論范式更為流行更為重要,后兩個(gè)理論范式則是補(bǔ)充性的。這些權(quán)利來源理論范式各有其條件、解釋強(qiáng)項(xiàng)與解釋力不足之處,它們(特別是前三個(gè)理論范式)不是單一的自我證成的理論假定,而是嵌入到自由主義、社群主義、社會(huì)主義和民族主義等意識形態(tài)和理論主張之中,從而呈現(xiàn)出規(guī)范性論證與經(jīng)驗(yàn)性論證相結(jié)合,以及意識形態(tài)的價(jià)值判斷與現(xiàn)實(shí)主義的權(quán)力政治邏輯相結(jié)合的特質(zhì)。
[Abstract]:The legitimacy of the rights of different ethnic minorities has always been a major issue that plagued the theoretical workers and practitioners of all countries. Based on the theoretical exploration and the practice of the world's national politics, this paper summarizes five theoretical foundations and paradigms about the justifiable rights of minority nationalities, namely, the theoretical paradigm of the disadvantaged position, and the moral theory. Paradigm, public theory paradigm, historical right theory paradigm and compensation incentive theory paradigm. The first three theoretical paradigms are more popular and more important, and the latter two theories are complementary. These theories have their own conditions to explain the strengths and weaknesses of the explanatory power, especially the first three theory models. Rather than a single theoretical hypothesis of self evidence, it is embedded in ideologies and theories, such as liberalism, communitarianism, socialism and nationalism, which presents a combination of normative arguments and empirical arguments, and the combination of ideological value judgment and the power and political logic of realism.
