【摘要】：文件管理工作在檔案事業(yè)管理體系中處于薄弱環(huán)節(jié),由于長期以來重視不足,檔案法規(guī)體系中涉及文件管理的款項寥寥無幾,作為文件管理的新型機構,我國文件中心的發(fā)展曾在一段時間內為檔案界研究的熱點,本文從該機構的法規(guī)角度出發(fā),在法律法規(guī)的立法、制定等方面深入研究,期望通過法律條文認可和維護該機構的運行。隨著政府法治社會治理模式的不斷革新和發(fā)展,以及信息技術的日益發(fā)展,需要推進文件中心機構的不斷建設,立法工作也勢在必行,選擇立法項目、制定計劃,設計法規(guī)內容是文件中心不斷發(fā)展的必需要求。本文圍繞我國文件中心法規(guī)開展研究,一共有五大部分。第一部分為緒論部分,主要介紹本篇論文的選題背景、研究目的和意義、文獻綜述及研究的思路方法等;第二部分主要介紹我國文件中心的建設歷程與現(xiàn)狀;第三部分主要介紹了我國文件中心法規(guī)建設的歷程和主要內容;第四部分,分析我國文件中心法規(guī)的立法情況和內容特點,和聯(lián)合檔案室的法規(guī)情況做出比較,對美國文件管理具有一定參考價值的立法指導思想和法規(guī)內容進行介紹,借鑒他國法治經(jīng)驗;第五部分,我國文件中心法規(guī)建設的構建思考,阻礙文件中心法規(guī)的原因分析,探索文件中心法規(guī)未來的發(fā)展,對文件管理的法規(guī)內容進行仔細思考,并提出關于明確立法體制和法規(guī)層次等措施。文件中心的法規(guī)作為維護機構運行和國家文件信息資源的重要法律保障,其法規(guī)建設的必要性是不言而喻的。對已有法規(guī)內容存在的經(jīng)驗和不足進行深度剖析,從我國檔案法治工作的實際出發(fā),積極探尋解決問題的有效途徑,科學、合理的設計法規(guī),明確規(guī)定文件管理主體的權利職責,逐步建立和完善文件工作法規(guī)體系和組織體系,確保我國文件中心機構工作的順利開展和健康成長。
[Abstract]:The document management work is in the weak link in the archives enterprise management system, because for a long time the insufficient attention, the archives laws and regulations system involves the document management the funds very few, as the document management new type organization, The development of our country's document center has been the hot spot of archival research for a period of time. From the perspective of this institution's laws and regulations, this paper makes a thorough study on the legislation and formulation of laws and regulations, etc. The operation of the agency is expected to be recognized and maintained through legal provisions. With the continuous innovation and development of the governance model of the government ruling by law society and the development of information technology, it is necessary to promote the continuous construction of the document center organization, and the legislative work is also imperative. The design of regulatory content is an essential requirement for the continuous development of document centers. This article carries on the research around our country document center regulation, altogether has five parts. The first part is the introduction part, which mainly introduces the background, the purpose and significance of the research, the literature review and the method of the research, the second part mainly introduces the history and the present situation of the construction of the document center in our country. The third part mainly introduces the history and main contents of the construction of the document center laws and regulations in our country, the fourth part, analyzes the legislative situation and the content characteristic of the documents center laws and regulations of our country, and makes the comparison with the laws and regulations of the joint archives office. This paper introduces the legislative guiding ideology and legislation content of American document management which has certain reference value, and draws lessons from other countries' experience of ruling by law. The fifth part is about the construction of document center laws and regulations in our country, and the analysis of the reasons that hinder the establishment of document center laws and regulations. This paper explores the future development of the document center laws and regulations, thinks carefully about the contents of the laws and regulations of document management, and puts forward some measures such as clarifying the legislative system and the level of laws and regulations and so on. As an important legal guarantee for maintaining the operation of the organization and the information resources of the national documents, the regulations of the document center are self-evident in the necessity of the construction of the laws and regulations. This paper makes a deep analysis of the experience and deficiency of the existing laws and regulations, and from the reality of the archives ruling by law in our country, actively explores the effective ways to solve the problems, scientific and reasonable design laws and regulations, The rights and responsibilities of the main body of document management should be clearly defined, and the legal system and organizational system of document work should be established and perfected step by step to ensure the smooth development and healthy growth of the work of the document center organization in our country.
