【摘要】：定海區(qū)于2007年在城市管理領(lǐng)域開展相對集中行政處罰權(quán)工作,由區(qū)城管執(zhí)法局行使轄區(qū)內(nèi)部分市容環(huán)境衛(wèi)生、城市規(guī)劃、市政公用管理、環(huán)境保護(hù)、工商行政管理、公安交通、河道管理等職能,并通過不斷的改進(jìn)自身管理體制以適應(yīng)城市發(fā)展和管理的需要。至此,定海區(qū)在城市管理領(lǐng)域取得了良好的社會效果,保持了良好的城市管理環(huán)境。 但隨著城市的進(jìn)一步擴(kuò)張,城管承擔(dān)了越來越多的管理職能,加之集中執(zhí)法也集中了大量的矛盾,執(zhí)法部門與公眾的矛盾也隨之增多,執(zhí)法領(lǐng)域相繼出現(xiàn)的執(zhí)法不公、執(zhí)法不力、違法執(zhí)法等現(xiàn)象,將政府機(jī)構(gòu)推向了公眾的對立面。如何通過強(qiáng)化內(nèi)部監(jiān)督,來糾正和規(guī)范城管綜合執(zhí)法行為,實(shí)現(xiàn)和諧執(zhí)法,是一個值得研究的課題。 本文以定海區(qū)城管綜合執(zhí)法內(nèi)部監(jiān)督為研究對象,首先對城市管理、城管綜合執(zhí)法、內(nèi)部監(jiān)督等相關(guān)概念進(jìn)行了闡述,并提出了分權(quán)制衡、人性缺陷假設(shè)等相關(guān)理論。其次通過一系列地調(diào)查、研究,分析了目前定海區(qū)城管綜合執(zhí)法內(nèi)部的現(xiàn)狀,包括監(jiān)督的主體、方式以及取得的成績,并指出了城管綜合執(zhí)法內(nèi)部監(jiān)督存在的主要問題,以及對產(chǎn)生問題的原因進(jìn)行了深入的分析。之后,在大量閱讀發(fā)達(dá)國家和其他城市有關(guān)城管綜合執(zhí)法內(nèi)部監(jiān)督文獻(xiàn)資料的基礎(chǔ)上,得出了加強(qiáng)城管綜合執(zhí)法內(nèi)部監(jiān)督的啟示。最后,筆者通過綜合相關(guān)理論和實(shí)踐經(jīng)驗,并結(jié)合定海區(qū)實(shí)際,從改革層級監(jiān)督、強(qiáng)化專門監(jiān)督、加強(qiáng)同級執(zhí)法監(jiān)督和完善城管內(nèi)部監(jiān)督機(jī)制等五個方面入手,較為全面地提出了強(qiáng)化定海城管綜合執(zhí)法內(nèi)部監(jiān)督的對策。
[Abstract]:In 2007, Dinghai District carried out relatively centralized administrative punishment work in the field of urban management. The District Urban Management and Law Enforcement Bureau exercises part of the city's appearance and environmental hygiene, urban planning, municipal public administration, environmental protection, industrial and commercial administration, public security and transportation within its jurisdiction. River management and other functions, and through continuous improvement of their own management system to meet the needs of urban development and management. So far, Dinghai area has achieved good social effect in the field of urban management and maintained a good urban management environment. However, with the further expansion of the city, urban management has assumed more and more management functions. In addition, centralized law enforcement has also concentrated a large number of contradictions, and the contradictions between law enforcement departments and the public have also increased. Weak law enforcement, illegal law enforcement and other phenomena have pushed government agencies to the opposite of the public. How to strengthen internal supervision to correct and standardize the comprehensive law enforcement behavior of urban management and achieve harmonious law enforcement is a subject worth studying. This paper takes the internal supervision of urban management comprehensive law enforcement in Dinghai area as the research object. Firstly, it expounds the related concepts such as urban management, urban management comprehensive law enforcement, internal supervision and so on, and puts forward relevant theories such as separation of powers and checks and balances, hypothesis of human nature defect and so on. Secondly, through a series of investigations and studies, this paper analyzes the present situation of urban management comprehensive law enforcement in Dinghai area, including the main body, methods and achievements of supervision, and points out the main problems existing in the internal supervision of urban management comprehensive law enforcement. And the causes of the problem are analyzed in depth. After reading a large number of developed countries and other cities on the basis of comprehensive urban management law enforcement internal supervision literature on the basis of the strengthening of urban comprehensive law enforcement internal supervision enlightenment. Finally, by synthesizing relevant theories and practical experience and combining with the actual situation in Dinghai area, the author starts from five aspects: reforming the level of supervision, strengthening the specialized supervision, strengthening the supervision of law enforcement at the same level and perfecting the internal supervision mechanism of urban management. The countermeasures to strengthen the internal supervision of Dinghai City Management's comprehensive law enforcement are put forward.
