【摘要】：有機食品作為一種富有營養(yǎng)、無污染的安全食品,近些年來得到了迅速的發(fā)展。有機食品以生態(tài)、無污染、優(yōu)質(zhì)以及安全,而不同于其它食品。有機食品在生產(chǎn)、加工制作中嚴禁使用化肥、農(nóng)藥、激素等,需要嚴格執(zhí)行生產(chǎn)加工標準,并在產(chǎn)品認證中有專門的機構(gòu)來執(zhí)行。有機食品的發(fā)展中,應(yīng)該如何應(yīng)對假冒偽劣、如何有效監(jiān)管、如何保證消費者的安全,成為需要解決的一個法律問題。本文以有機食品的監(jiān)管為研究內(nèi)容,通過文獻分析法、比較分析法,對其法律制度的完善進行了深入的分析與探討,闡述了食品監(jiān)管的相關(guān)理論,論述了監(jiān)管有機食品的必要性,分析了我國有機食品監(jiān)管存在的法律問題和現(xiàn)狀,并結(jié)合國外經(jīng)驗提出了完善我國有機食品監(jiān)管法律制度的建議。全文主要分為五個部分:第一部分闡述了本文研究的背景、意義,國內(nèi)外的研究現(xiàn)狀以及主要的研究方法與創(chuàng)新之處;第二部分主要闡述了有機食品監(jiān)管的相關(guān)概念,通過有機食品監(jiān)管概念、性質(zhì)、意義的闡述,對有機食品監(jiān)管的基本理論依據(jù)進行了探討;第三部分主要對國外有機食品監(jiān)管制度進行了分析與探討,為我國有機食品監(jiān)管的法律制度建設(shè)提供了借鑒。第四部分主要對我國有機食品監(jiān)管的法律問題及問題產(chǎn)生的原因進行了分析;第五部分主要針對我國有機食品監(jiān)管的法律制度問題提出了具體的完善對策,以促進我國有機食品行業(yè)的健康持續(xù)發(fā)展。
[Abstract]:Organic food, as a kind of nutritious and pollution-free safe food, has been developed rapidly in recent years. Organic foods are different from other foods in terms of ecology, pollution, quality and safety. Organic food is strictly forbidden to use chemical fertilizer, pesticide, hormone and so on in production, processing, etc. It is necessary to strictly implement the standard of production and processing, and there is a special organization to implement it in the product certification. In the development of organic food, how to deal with fake and shoddy, how to supervise effectively and how to ensure the safety of consumers have become a legal problem to be solved. This paper takes the supervision of organic food as the research content, through the literature analysis method, the comparative analysis method, has carried on the thorough analysis and the discussion to its legal system consummation, elaborated the related theory of the food supervision. This paper discusses the necessity of the supervision of organic food, analyzes on the existing legal problems and present situation of the supervision of organic food in China, and puts forward some suggestions on how to perfect the legal system of the supervision of organic food in China based on foreign experience. The full text is divided into five parts: the first part describes the background, significance, research status at home and abroad, as well as the main research methods and innovations; the second part mainly describes the related concepts of organic food regulation. Based on the concept, nature and significance of organic food regulation, the basic theoretical basis of organic food supervision is discussed. The third part mainly analyzes and discusses the foreign organic food supervision system. It provides reference for the legal system construction of organic food supervision in China. The fourth part mainly analyzes the legal problems and the causes of the problems in the regulation of organic food in China, and the fifth part mainly puts forward some concrete countermeasures to improve the legal system of the supervision of organic food in China. In order to promote the healthy and sustainable development of organic food industry in China.
