【摘要】：我國專業(yè)學(xué)位自1991年開始實(shí)行,2009年后正式招收全日制專業(yè)學(xué)位研究生,二十多年來得到了快速發(fā)展。專業(yè)學(xué)位作為一種新型學(xué)位制度,調(diào)整了以往我國研究生教育只有學(xué)術(shù)型學(xué)位的學(xué)位結(jié)構(gòu)和教育模式,有利于我國高等教育的長(zhǎng)期發(fā)展和國際接軌。當(dāng)然,專業(yè)學(xué)位教育在經(jīng)歷了過去二十多年快速發(fā)展的同時(shí),其入學(xué)、培養(yǎng)等多個(gè)環(huán)節(jié)均不同程度地出現(xiàn)了若干問題。這些問題固然與我國高等教育尤其是專業(yè)學(xué)位教育領(lǐng)域的相關(guān)法律法規(guī)不完善、教育行政管理體制不適應(yīng)時(shí)代要求等宏觀因素密不可分,但是,為了我國專業(yè)學(xué)位教育制度在未來的健康有序發(fā)展,我們認(rèn)為,對(duì)我國專業(yè)學(xué)位研究生教育中存在的問題進(jìn)行深入分析,進(jìn)而從法律制度上思考提出相關(guān)保障機(jī)制就顯得非常必要和重要。 本文分為三個(gè)大部分： 首先從專業(yè)學(xué)位等相關(guān)概念入手,詮釋我國專業(yè)學(xué)位的發(fā)展背景和歷程。然后針對(duì)我國專業(yè)研究生培養(yǎng)的基本環(huán)節(jié)——入學(xué)、培養(yǎng)、考核及就業(yè),從上述四個(gè)方面對(duì)其中存在的問題進(jìn)行了分析,指出了我國專業(yè)學(xué)位教育發(fā)展中存在的相關(guān)法律法規(guī)不完善、社會(huì)參與力量薄弱等主要問題及這些問題產(chǎn)生的原因。最后在介紹美、英、日各國專業(yè)學(xué)位研究生教育制度發(fā)展過程及制度經(jīng)驗(yàn)的基礎(chǔ)上,從完善法律制度的角度,提出了我國專業(yè)學(xué)位發(fā)展的相應(yīng)法律對(duì)策,主要包括：完善專業(yè)學(xué)位相關(guān)法律法規(guī),明確專業(yè)學(xué)位法律地位；調(diào)整專業(yè)學(xué)位現(xiàn)有管理體制,完善專業(yè)學(xué)位自身體系；改革相關(guān)制度,保證專業(yè)學(xué)位教育質(zhì)量；建立多元化考核制度,完善與職業(yè)資格認(rèn)證制度的銜接。以期對(duì)我國專業(yè)學(xué)位研究生培養(yǎng)制度的改革和完善提供參考和幫助。
[Abstract]:Professional degree in China has been implemented since 1991. After 2009, it formally enrolled full-time professional degree graduate students, and has developed rapidly in the past twenty years. As a new type of degree system, professional degree adjusts the academic degree structure and educational model, which is beneficial to the long-term development of Chinese higher education and international integration. Of course, professional degree education has experienced rapid development in the past twenty years, at the same time, its entrance, training and many other links have appeared a number of problems in varying degrees. These problems are closely related to the imperfect laws and regulations in the field of higher education, especially in the field of professional degree education, and the inadaptability of the educational administration system to the requirements of the times, but, For the sake of the healthy and orderly development of our professional degree education system in the future, we think that the problems existing in the professional degree graduate education in our country are deeply analyzed. Furthermore, it is very necessary and important to put forward the relevant safeguard mechanism from the legal system. This paper is divided into three parts: First of all, from the professional degree and other related concepts, the interpretation of our professional degree development background and process. Then, in view of the basic links of professional graduate training in China-admission, training, examination and employment, the problems in these four aspects are analyzed. This paper points out the main problems existing in the development of professional degree education in China, such as imperfect laws and regulations, weak social participation, and the causes of these problems. Finally, on the basis of introducing the development process and system experience of the graduate education system of professional degree in the United States, Britain and Japan, and from the angle of perfecting the legal system, this paper puts forward the corresponding legal countermeasures for the development of professional degree in our country. It mainly includes: perfecting the relevant laws and regulations of professional degree, clarifying the legal status of professional degree, adjusting the existing management system of professional degree, perfecting the system of professional degree itself, reforming the relevant system, ensuring the quality of professional degree education; To establish a diversified assessment system and perfect the link with the professional qualification certification system. In order to provide reference and help for the reform and perfection of the training system of professional degree graduate students in our country.
