【摘要】：作為一項重要的營養(yǎng)食品,民眾與奶制品的淵源頗深,奶制品的安全與否直接影響到民眾的健康水平和幸福指數(shù),因此,它是一項關(guān)系到民生的重要事件,民眾對奶制品安全的需求也是十分迫切的。近年來,我國奶制品安全事件不斷發(fā)生,有一些奶制品安全事件甚至成為較大的安全事故,造成了極壞的社會影響,嚴重打擊到了公眾對國內(nèi)奶制品安全的信心,在很長一段時間,奶制品的海外代購、香港代購一度暢銷,一罐難求。奶制品安全市場調(diào)控的失靈,讓人民群眾對于政府監(jiān)管有了殷切的期望。前期我們在不斷發(fā)生的奶制品安全事故當中獲得了很多教訓,同樣也吸取了很多經(jīng)驗,在政府、民眾、企業(yè)等多方的共同努力之下,我國的奶制品安全政府監(jiān)管取得了一定的成績,近年來大型的奶制品安全事件已經(jīng)減少,并且處于一個可控的水平中。本文從政府監(jiān)管理論入手,分析奶制品安全市場政府介入的可能性和必要性,并且結(jié)合當下奶制品安全政府監(jiān)管的現(xiàn)狀,提出問題,分析原因,仍然可以看到我國奶制品安全的政府監(jiān)管存在著一定的問題或者是不足,因此本文在分析問題的基礎(chǔ)上,結(jié)合當下奶制品安全政府監(jiān)管的實際情況,分析和總結(jié)美國、歐盟、澳大利亞等國的奶制品安全政府監(jiān)管情況,提出了一些對策,具體的對策有:第一,按照服務(wù)型政府、責任型政府進行政府職能轉(zhuǎn)變,讓政府的監(jiān)管思想從被動的監(jiān)管轉(zhuǎn)向主動監(jiān)管,強化政府的監(jiān)管責任;第二,在現(xiàn)有奶制品安全監(jiān)管的基礎(chǔ)上,繼續(xù)加快轉(zhuǎn)變奶制品安全政府監(jiān)管方式的革新,建立完善的奶制品安全監(jiān)管體系;第三,進一步梳理政府奶制品安全監(jiān)管機構(gòu)的組織架構(gòu),對各個部門的職權(quán)進行重新的梳理和劃分,實現(xiàn)各部門權(quán)責明晰;第四,繼續(xù)推進奶制品安全監(jiān)管法律法規(guī)體系的建設(shè),同時出臺更多的奶制品監(jiān)管安全標準,讓監(jiān)管有法可依;第五,完善奶制品安全檢驗檢測體系,加大檢驗檢測設(shè)備和技術(shù)的投入;第六,規(guī)范奶制品安全監(jiān)管機構(gòu)的行為,提高政府奶制品安全監(jiān)管隊伍的素質(zhì),打造一支高效、專業(yè)的監(jiān)管隊伍;第七,推進監(jiān)管制度的創(chuàng)新,引入社會監(jiān)管力量,形成監(jiān)管合力,實現(xiàn)科學監(jiān)管。
[Abstract]:As an important nutritional food, people and dairy products have a deep origin. The safety of dairy products directly affects the health level and happiness index of the people. Therefore, it is an important event related to people's livelihood. People's demand for dairy products safety is also very urgent. In recent years, dairy safety incidents have occurred continuously in our country, and some dairy safety incidents have even become bigger safety accidents, which have caused extremely bad social impact and seriously hit the public confidence in domestic dairy safety. For a long time, dairy products were purchased overseas. The failure of market regulation of dairy products makes the people have great expectations for government supervision. In the early days, we learned a lot of lessons from the continuous dairy safety accidents, and we also learned a lot of experience. Thanks to the joint efforts of the government, the public, enterprises, and so on, The government supervision of dairy products safety in China has made some achievements. In recent years, large-scale dairy safety incidents have been reduced, and are in a controllable level. Starting with the theory of government supervision, this paper analyzes the possibility and necessity of government intervention in dairy product safety market, and combines with the present situation of government supervision of dairy product safety, puts forward problems and analyzes the reasons. It can still be seen that there are some problems or deficiencies in the government supervision of dairy products safety in China. Therefore, based on the analysis of the problems and the actual situation of the current government supervision of dairy products safety, this paper analyzes and summarizes the United States and the European Union. Australia and other countries put forward some countermeasures on the supervision of dairy products safety. The specific countermeasures are as follows: first, according to the service-oriented government, the responsible government changes the functions of the government. Let the government's supervision thought change from passive supervision to active supervision, strengthen the government's supervisory responsibility; second, on the basis of the existing dairy product safety supervision, continue to accelerate the reform of the transformation of dairy product safety government supervision mode. Third, further combing the organizational structure of the government dairy product safety regulatory body, rearranging and dividing the functions and powers of each department, realizing the clarity of the authority and responsibility of each department; fourth, Continue to promote the construction of a legal and regulatory system for the safety supervision of dairy products, and at the same time issue more safety standards for the supervision of dairy products, so that supervision can be governed by law; fifthly, improve the system of safety inspection and detection of dairy products. Increase the investment in inspection and testing equipment and technology; sixth, standardize the behavior of dairy product safety regulatory bodies, improve the quality of the government dairy product safety supervision team, and create an efficient and professional supervision team; seventh, Promote the innovation of supervision system, introduce social supervision force, form supervision force and realize scientific supervision.
