我國高等學校學位撤銷權法律規(guī)制研究

【摘要】:學位代表學生一定學識水平,是學生就業(yè)或繼續(xù)深造的重要依據(jù)。學位與高等教育受教育者的切身利益密切相關。近些年來,隨著高等教育的逐步發(fā)展和公民權利意識的進一步提高,因學位撤銷引發(fā)的糾紛不斷增多,學位撤銷權行使過程中諸多問題日益凸顯。如何將學位撤銷權的行使納入納入法治軌道,完善學位撤銷的相關法律規(guī)定切實保障受教育者的合法權益成為了學界關注的焦點。本研究以近些年發(fā)生的高校學位撤銷案為基礎,通過案情分析,歸納出我國高等學校學位撤銷權行使過程中存在的問題,并深入分析這些問題存在的原因,進而從多方面對我國高等學校學位撤銷權的行使提出法律規(guī)制的對策與意見。本文采用的研究方法主要是文獻法、案例法和交叉分析法。論文共分為五個部分:第一部分:引言。主要闡明了本文的研究目的、研究內容、研究意義以及文獻綜述,本研究立足于可查到的各類因學位撤銷權引發(fā)的學位糾紛案件,分析各高等學校學位撤銷權行使過程所存在的問題,針對學位撤銷權行使過程中存在的行使條件、程序不規(guī)范、救濟途徑缺失等問題提出法律規(guī)制的對策,希望在一定程度上能引起高等學校及相關部門的關注,并盡可能的呼吁更多的社會關注點轉投到高等學校學位撤銷權的研究中去。第二部分:我國高等學校學位撤銷權概述。主要闡明了我國高校學位撤銷權的內涵、性質、特征和現(xiàn)實必要性,我國高校的學位撤銷權屬于行政許可權范疇,即高等學校在做出學位授予行為之后,發(fā)現(xiàn)學位申請人存在舞弊作偽等嚴重違反《學位條例》規(guī)定的行為,高等學校依法擁有主動單方面撤銷學位申請人學位的權力,根據(jù)這一內涵可以歸納出學位撤銷權具有主動性、主體性、事后性以及條件性。第三部分:我國高等學校學位撤銷權現(xiàn)狀分析。主要闡明了目前我國高等學校學位撤銷權的行使過程中主要暴露出四大問題:行使條件不明確、程序不規(guī)范、證據(jù)不明以及救濟機制缺失。第四部分:美國高等學校學位撤銷權法律規(guī)制的現(xiàn)狀及對我國的啟示。主要闡明了對美國高等學校學位撤銷權的行使情況進行調查分析,并從對美國高等學校學位撤銷權行使規(guī)定的深入分析中獲得啟示和經驗。第五部分:我國高等學校學位撤銷權法律規(guī)制的對策分析。主要闡明了針對目前我國高等學校學位撤銷權行使過程的問題及發(fā)生原因,從法律的視角提出規(guī)制高等學校學位撤銷權行使的相關對策。
[Abstract]:Degree represents a certain level of knowledge and is an important basis for employment or further study. Degree is closely related to the vital interests of higher education. In recent years, with the gradual development of higher education and the further improvement of the awareness of civil rights, the number of disputes caused by the revocation of degrees is increasing, and many problems in the exercise of the right to revoke degrees have become increasingly prominent. How to bring the exercise of the right of degree revocation into the rule of law and how to improve the relevant legal provisions of the revocation of degrees to protect the legitimate rights and interests of the educated has become the focus of academic attention. On the basis of the revocation of university degree in recent years, this study sums up the problems in the exercise of the right of revocation of university degree in our country through the case analysis, and deeply analyzes the reasons for these problems. Then, the author puts forward the countermeasures and suggestions of legal regulation on the exercise of the right to revoke degrees in colleges and universities in China from many aspects. The research methods used in this paper are literature method, case law and cross-analysis method. The thesis is divided into five parts: the first part: introduction. This paper mainly expounds the purpose, content, significance and literature review of this paper. This study is based on the various kinds of degree disputes caused by the right to revoke degrees. This paper analyzes the problems existing in the exercise process of the degree revocation right in various colleges and universities, and puts forward some countermeasures for the legal regulation in the exercise of the degree revocation right, such as the conditions for the exercise of the degree revocation right, the non-standard procedure, the lack of relief channels, and so on. The author hopes to attract the attention of universities and related departments to a certain extent, and appeals for more social concerns to be put into the research of the right of revocation of university degrees as much as possible. The second part: an overview of the right of revocation of academic degrees in colleges and universities in China. This paper mainly expounds the connotation, nature, characteristics and practical necessity of the right to revoke degrees in colleges and universities in our country. The right of revocation of degrees in colleges and universities in our country belongs to the category of administrative permission, that is, after making the act of granting degrees, It is found that the applicant for a degree has serious violations of the provisions of the degree regulations, such as fraud and forgery, and institutions of higher learning have the power to unilaterally revoke the degree of the applicant for a degree on their own initiative according to law, According to this connotation, it can be concluded that the right of degree revocation has the characteristics of initiative, subjectivity, hindsight and conditionality. The third part: the analysis of the current situation of degree revocation right in higher education institutions in China. This paper mainly expounds four main problems in the exercise of the right to revoke degrees in colleges and universities in our country: the conditions of exercise are not clear, the procedure is not standardized, the evidence is unclear and the relief mechanism is missing. The fourth part: the current situation and enlightenment to our country of the legal regulation of the right to revoke degrees in American colleges and universities. This paper mainly expounds the investigation and analysis of the exercise of the right to revoke degrees in American colleges and universities, and obtains enlightenment and experience from the in-depth analysis of the provisions on the exercise of the right to revoke degrees in American institutions of higher learning. The fifth part: the countermeasure analysis of the legal regulation of the right of revocation of university degree in our country. This paper mainly expounds the problems and causes of the exercise of the right to revoke degrees in colleges and universities in China, and puts forward the relevant countermeasures to regulate the exercise of the right of revocation of degrees in colleges and universities from the perspective of law.
