論我國(guó)公共租賃住房法律制度的完善

【摘要】:“人人都有適當(dāng)住房”是我國(guó)改善民生所面臨的重要課題。但是,當(dāng)前火爆的房地產(chǎn)市場(chǎng)導(dǎo)致商品房?jī)r(jià)格畸高,日益高昂的住房?jī)r(jià)格導(dǎo)致城市中的中低收入群體住房困難問(wèn)題日益顯現(xiàn),如果這個(gè)問(wèn)題得不到有效解決將導(dǎo)致嚴(yán)重的社會(huì)問(wèn)題。我國(guó)政府對(duì)于這個(gè)問(wèn)題日益重視,先后出臺(tái)了“廉租房”、“經(jīng)濟(jì)適用房”和“限價(jià)商品房”等政策來(lái)解決我國(guó)中低收入群體的住房困難的現(xiàn)狀。取得了很好的社會(huì)效果,解決了很多人的住房難問(wèn)題。但是,還存在著一些既不符合以上條件而又很難通過(guò)市場(chǎng)解決住房問(wèn)題的“夾心層”群體。他們被排除在這些住房保障政策之外,“夾心層”群體住房的問(wèn)題依然沒(méi)有得到解決,而公共租賃住房的制度的出現(xiàn)則為這一難題的解決提供了一個(gè)有效的途徑。 公共租賃住房制度在解決“夾心層”群體的住房困難的方面發(fā)揮著無(wú)可替代的作用。雖然公共租賃住房制度剛剛開(kāi)始發(fā)展,但是在我國(guó)各地發(fā)展迅速,大量的公共租賃住房出現(xiàn),使大量的“夾心層”群體擁有了自己的住房。公租房制度的出現(xiàn)有效的干預(yù)了我國(guó)房地產(chǎn)市場(chǎng),促進(jìn)了住房保障制度的完善,實(shí)現(xiàn)了公共住房資源的和諧、可持續(xù)發(fā)展,完善了我國(guó)租賃住房市場(chǎng)體系。 我國(guó)公共租賃住房制度已經(jīng)有了一定的發(fā)展,但是,它發(fā)展的時(shí)間還比較短,還有很多不足的地方。不論是在立法實(shí)踐方面,還是在關(guān)于公共租賃住房法律制度的理論方面的研究都比較少,還沒(méi)有有影響的研究出現(xiàn)。我國(guó)公共租賃住房制度在經(jīng)濟(jì)學(xué)和管理學(xué)方面的研究比較多,在法律方面的研究現(xiàn)在還是空白的狀態(tài)。我國(guó)公共租賃住房法律制度并不完善,現(xiàn)在僅靠部門(mén)規(guī)章和政策性文件來(lái)管理公共租賃住房。然而,這些法律文件普遍存在著立法層次較低,缺乏全國(guó)統(tǒng)一的立法等等的問(wèn)題。而在具體的規(guī)定中,也存在著公共租賃住房的入住對(duì)象和入住條件不明確、不合理,公共租賃住房管理機(jī)制的缺失以及公共租賃住房租賃期限和退出機(jī)制的不合理等等的缺陷。 所以,本文旨在通過(guò)研究域外現(xiàn)有的較為完善的公共租賃住房法律制度,比較分析我國(guó)公共租賃住房法律制度存在的弊端,并借鑒域外先進(jìn)經(jīng)驗(yàn),結(jié)合我國(guó)當(dāng)前的現(xiàn)狀,提出相應(yīng)的建議。本文將綜合運(yùn)用文獻(xiàn)分析法、比較分析法以及歸納分析法等等的方法,以期對(duì)我國(guó)公共租賃住房法律制度做較為深入的研究,完善我國(guó)的公共租賃住房法律制度,使之成為一個(gè)多層次、全面保障的住房保障法律制度,推動(dòng)社會(huì)的和諧和進(jìn)步。 本文正文主體部分的結(jié)構(gòu)分為四大部分。第一部分是“公共租賃住房法律制度概述”,該部分主要闡明了公共租賃住房法律制度的概念及我國(guó)公共租賃住房的概念和特征,探討了公共租賃住房法律制度的現(xiàn)實(shí)意義,并從法的淵源的角度闡述了我國(guó)公共租賃住房法律制度的立法現(xiàn)狀。第二部分是“域外公共租賃住房立法和實(shí)踐及其借鑒”,這一部分通過(guò)對(duì)英國(guó)、美國(guó)、德國(guó)、新加坡以及我國(guó)香港地區(qū)公共租賃住房法律制度的立法和實(shí)踐的分析,闡釋了其他國(guó)家和地區(qū)公共租賃住房立法和實(shí)踐對(duì)我國(guó)的公共租賃住房發(fā)展的可供借鑒之處。第三部分則是“我國(guó)公共租賃住房法律制度存在的問(wèn)題”,這一部分通過(guò)分析我國(guó)公共租賃住房的法律規(guī)定和地方規(guī)章政策等,結(jié)合我國(guó)當(dāng)前各地公租房制度的狀況,說(shuō)明了我國(guó)公共租賃住房法律制度立法與實(shí)踐中存在的主要問(wèn)題。最后一部分是“完善我國(guó)公共租賃住房法律制度的建議”,該部分借鑒域外的先進(jìn)經(jīng)驗(yàn),針對(duì)當(dāng)前我國(guó)公共租賃住房法律制度所出現(xiàn)的各種問(wèn)題,提出了完善的基本原則和相應(yīng)的具體建議。
[Abstract]:"Everyone has proper housing" is an important issue for the improvement of the people's livelihood. However, the current hot real estate market leads to a high price of commodity housing, and the increasing housing price has caused the problem of housing difficulties in the middle and low income groups in the city. If this problem is not effectively solved, it will lead to a serious society. Problem. Our government attaches great importance to this problem. It has introduced the policy of "low rent housing", "affordable housing" and "limited price commodity house" to solve the housing difficulties of middle and low income groups in China. It has achieved good social effects and solved many people's housing difficulties. However, there are still some non conforms. In addition to the above conditions, it is difficult to solve the "sandwich" group of housing problems through the market. They are excluded from these housing security policies. The problem of "sandwich" housing is still not solved, and the emergence of public rental housing system provides an effective way to solve this problem.
The public rental housing system has played an irreplaceable role in solving the housing difficulties of the "sandwich" group. Although the public rental housing system has just begun to develop, it has developed rapidly in all parts of China, and a large number of public rental housing appears, making a large number of "sandwich" groups have their own housing. The system of public rental housing in our country has been developed, but the time of its development is relatively short, and there are still a lot of inadequacies. No matter in legislative practice or in the theory of the legal system of public rental housing, there are few studies that have influence. There are many studies in economics and management, and the legal research is still blank. The legal system of public rental housing in China is not perfect. Now, the public rental housing is managed only by department rules and policy documents. However, these legal documents are generally low in legislative level and lack of national unity. One of the legislation and so on, and in the specific provisions, there is also a public rental housing object and occupancy conditions are not clear, unreasonable, the lack of public rental housing management mechanism and the lack of public rental housing lease term and exit mechanism is not reasonable and so on.
Therefore, the purpose of this paper is to compare the existing legal system of public rental housing outside the region, compare and analyze the drawbacks of the legal system of public rental housing in our country, and draw on the advanced experience of foreign countries, combine with the current situation of our country, and put forward the corresponding suggestions. This article will use the literature analysis method, comparative analysis method and induction. In order to make a more thorough research on the legal system of public rental housing in China and improve the legal system of public rental housing in our country, the law system of public rental housing in China will be perfected to make it a multi-level, comprehensive protection legal system for housing security and promote the harmony and progress of the society.
The structure of the main body part of the text is divided into four parts. The first part is the "summary of the legal system of public rental housing". This part mainly clarifies the concept of the legal system of public rental housing and the concept and characteristics of the public rental housing in our country, and probes into the practical significance of the law system of public rental housing, and from the angle of the origin of the law. The legislative status of the legal system of public rental housing in China is expounded. The second part is "the legislation and practice of extraterritorial public rental housing and its reference". This part explains the legislation and practice of the legal system of public rental housing in the UK, the United States, Germany, Singapore and the Hongkong region of China. The legislation and practice of public rental housing in the district can be used for reference in the development of public rental housing in China. The third part is "the problem of the legal system of public rental housing in China". This part analyzes the public rental housing system in China by analyzing the legal provisions and local rules and policies of public rental housing in China, and combining the public rental housing system in our country at present. The main problems in the legislation and practice of the legal system of public rental housing in China are explained. The last part is the suggestion of "perfecting the legal system of the public rental housing in our country". This part draws on the advanced experience abroad, and puts forward the perfection of the problems arising from the legal system of public rental housing in our country.
