【摘要】：“官邸制”是國(guó)家為一定級(jí)別的在任官員提供住房的一項(xiàng)制度。該制度在我國(guó)當(dāng)代的提出源自于官員“以權(quán)謀房”腐敗現(xiàn)象愈演愈烈,亟需制度化規(guī)范的需要。本文探討了官邸制立法的意義和原則,在綜合分析官邸制實(shí)施的主客觀條件的基礎(chǔ)上,確立了“以立法促改革,地方先行先試”的官邸制立法徑路。以我國(guó)古代和現(xiàn)代外國(guó)官邸制的基本情況為導(dǎo)引,結(jié)合我國(guó)當(dāng)代的基本國(guó)情,確立了官邸制立法的具體內(nèi)容和配套措施。本文秉持以法律制約權(quán)力的理念,從官邸制的基本功能出發(fā),通過對(duì)官邸制立法的探求,使我國(guó)當(dāng)下官邸制的設(shè)計(jì)回歸官邸制本身,希冀我國(guó)官邸制走上一條符合本土實(shí)情和國(guó)際趨勢(shì)的道路。
[Abstract]:Residence system is a system in which the state provides housing for a certain number of serving officials. This system is put forward in our country from the corruption phenomenon of "seeking room by power", which needs to be institutionalized and standardized. This paper probes into the significance and principle of official residence system legislation, and on the basis of synthetically analyzing the subjective and objective conditions for the implementation of official residence system, establishes the official residence system legislative path of "promoting reform by legislation and first trial by local authorities". Guided by the basic situation of the official residence system in ancient and modern China and the basic national conditions of our country, this paper establishes the concrete contents and supporting measures of the official residence system legislation. Based on the idea of restricting power by law and the basic function of official residence system, this paper explores the legislation of official residence system, and makes the design of official residence system return to the official residence system itself. It is hoped that China's official residence system will follow a path in line with local facts and international trends.
