【摘要】：行政監(jiān)察制度是各國(guó)政治體制中的重要組成部分,對(duì)維護(hù)公民合法權(quán)益、促進(jìn)政府權(quán)力的規(guī)范運(yùn)行等方面具有不可替代的作用,在國(guó)家的行政活動(dòng)中具有重要的地位。中華人民共和國(guó)成立以來(lái),我國(guó)的行政監(jiān)察制度經(jīng)過(guò)創(chuàng)建、停滯和重建完善等發(fā)展階段,逐步形成了一套比較健全的行政監(jiān)察法律體系,在查辦案件、開展專項(xiàng)監(jiān)察等方面取得了舉世矚目的成果,促進(jìn)了依法行政建設(shè)。但隨著行政權(quán)力在現(xiàn)實(shí)政治生活中的不斷拓展,行政監(jiān)察制度存在的缺點(diǎn)和不足越來(lái)越突出,表現(xiàn)在行政監(jiān)察法律法規(guī)不健全、行政監(jiān)察機(jī)關(guān)缺乏獨(dú)立性和權(quán)限范圍過(guò)窄、監(jiān)察人員素質(zhì)有待提高等方面。反觀相關(guān)國(guó)家和地區(qū),如美國(guó)、新加坡、日本和我國(guó)香港特區(qū)等,都有完善的行政監(jiān)察制度,行政監(jiān)察作用也得到了很好地發(fā)揮,這啟示我們借鑒其成功經(jīng)驗(yàn),在以下四個(gè)方面對(duì)我國(guó)的行政監(jiān)察制度進(jìn)行完善：一是制定完備的行政監(jiān)察法律體系,二是設(shè)立擁有獨(dú)立地位的行政監(jiān)察機(jī)關(guān),三是賦予監(jiān)察機(jī)關(guān)廣泛的權(quán)力,四是提高監(jiān)察人員的素質(zhì),并為其提供優(yōu)厚的物質(zhì)保障。進(jìn)一步加強(qiáng)和改進(jìn)我國(guó)的行政監(jiān)察工作,以推動(dòng)社會(huì)主義政治文明的建設(shè)。
[Abstract]:The administrative supervision system is an important part of the political system of various countries. It has an irreplaceable role in maintaining the legitimate rights and interests of the citizens and promoting the standardized operation of the government power. It has an important position in the administrative activities of the state. Since the founding of People's Republic of China, the administrative supervision system of our country has been established, stagnated and heavy. To build a perfect stage of development, a set of more sound administrative supervision legal system has been gradually formed, which has made remarkable achievements in investigating cases and carrying out special supervision, and promoted the construction of administration according to law. However, with the continuous expansion of administrative power in the real political life, the shortcomings and shortcomings of the administrative supervision system are becoming more and more important. The more outstanding, the administrative supervision laws and regulations are not perfect, the administrative supervision organs lack the independence and the scope of authority too narrow, and the quality of the inspectors need to be improved. In addition, the relevant countries and regions, such as the United States, Singapore, Japan and the Hongkong Special Economic Zone, have a perfect administrative supervision system, and the role of administrative supervision has also been very good. As a result, we can learn from its successful experience and improve our administrative supervision system in the following four aspects: one is to establish a complete legal system of administrative supervision, the two is to set up an administrative supervisory organ with independent status, the three is to endow the supervisory authority with extensive power, and the four is to improve the quality of the inspectors and to provide them for it. It provides a good material guarantee, and further strengthens and improves our administrative supervision so as to promote the construction of socialist political civilization.
