公共租賃住房準(zhǔn)入機(jī)制法律問題研究

【摘要】:居住是最基本的民生需求之一,保障公民住宅權(quán)的實(shí)現(xiàn)是政府義不容辭的責(zé)任。公共租賃住房作為我國正在逐步發(fā)展的保障性住房形式,主要是解決我國中低收入住房困難居民的住房問題,通過與廉租住房、經(jīng)濟(jì)適用住房的“無縫對接”共同構(gòu)成我國保障住房體系。發(fā)展公共租賃住房制度,是一項(xiàng)多目標(biāo)的社會福利措施,不僅可以使收入較低的家庭安居樂業(yè),提高其生活水平,進(jìn)而確保社會的安定;并且可以抑制房價,有效改善居住環(huán)境及提高土地利用價值。所以,一個恰當(dāng)?shù)墓沧赓U住房政策,其所獲得的成果,具有經(jīng)濟(jì)、社會、環(huán)境等多層面的功能。本文站在法律的角度,從以下四個方面論述了公共租賃住房在準(zhǔn)入機(jī)制方面的一些問題。 第一部分:公共租賃住房準(zhǔn)入的法學(xué)基本理論。該部分從分析公共租賃住房準(zhǔn)入機(jī)制的概念入手,進(jìn)而論述了公共租賃住房準(zhǔn)入機(jī)制的法理基礎(chǔ),,最后闡釋公共租賃住房準(zhǔn)入機(jī)制的社會功效。 第二部分:國外公共租賃住房準(zhǔn)入機(jī)制的法律規(guī)定及評價。通過介紹美國、韓國、新加坡的公共租賃住房準(zhǔn)入機(jī)制的規(guī)定,總結(jié)域外住房制度中值得我國公共租賃住房準(zhǔn)入機(jī)制借鑒的經(jīng)驗(yàn)。 第三部分:我國公共租賃住房準(zhǔn)入機(jī)制的立法現(xiàn)狀及缺陷分析。介紹中央人民政府關(guān)于公共租賃住房準(zhǔn)入機(jī)制了哪些規(guī)定,而各級人民政府又出臺了哪些管理辦法。通過以上分析,總結(jié)我國公共租賃住房準(zhǔn)入機(jī)制存在的缺陷。 第四部分:完善公共租賃住房準(zhǔn)入機(jī)制的法律建議。此部分是本文的重點(diǎn),在前文分析的基礎(chǔ)之上,分別從制定全國統(tǒng)一立法、擴(kuò)大準(zhǔn)入對象覆蓋范圍、制定嚴(yán)格的準(zhǔn)入審核程序、加強(qiáng)準(zhǔn)入的監(jiān)管、完善準(zhǔn)入的法律責(zé)任五個方面加以完善。
[Abstract]:Residence is one of the most basic needs of people's livelihood, and it is the government's duty to ensure the realization of citizens' right to housing.Public rental housing, as a form of affordable housing that is gradually developing in our country, mainly solves the housing problem of the residents with low and middle income housing difficulties, through the use of low-rent housing.The "seamless docking" of affordable housing constitutes our country's housing security system.The development of a public rental housing system is a multi-objective social welfare measure that not only enables low-income families to live and work in peace and contentment, improves their living standards, and thus ensures social stability, but also inhibits housing prices.Improve living environment and land use value effectively.Therefore, an appropriate public rental housing policy, its results, with economic, social, environmental and other aspects of the function.From the point of view of law, this paper discusses some problems in the access mechanism of public rental housing from the following four aspects.The first part: the basic legal theory of public rental housing access.This part begins with the analysis of the concept of the admission mechanism of public rental housing, and then discusses the legal basis of the admission mechanism of public rental housing, and finally explains the social efficacy of the admission mechanism of public rental housing.The second part: the legal regulation and evaluation of the admission mechanism of public rental housing abroad.By introducing the regulations of the admission mechanism of public rental housing in the United States, South Korea and Singapore, this paper sums up the experience of foreign housing system which is worthy of our country's public rental housing access mechanism.The third part: the legislation present situation and the flaw analysis of our country public rental housing admittance mechanism.Introduce the Central people's Government on the admission mechanism of public rental housing regulations, and people's governments at all levels issued what management measures.Through the above analysis, summarizes our country public rental housing admittance mechanism existence flaw.The fourth part: the legal suggestion of perfecting the admittance mechanism of public rental housing.This part is the focus of this paper, on the basis of the previous analysis, from the formulation of national uniform legislation, the expansion of the coverage of access objects, the establishment of strict access audit procedures to strengthen the supervision of access,Perfect access to five aspects of legal responsibility to perfect.
