【摘要】：在法政策學的范式下,就我國的未成年人監(jiān)護立法而言,從政策的角度,法律的工具性和合目的性存在不足;從法律的角度,雖然不存在合法性和民主正當性的問題,但是在可行性上存在不少缺陷。究其原因,在留守兒童日益增加、父母監(jiān)護力有不逮的社會轉型時期,政策和法律出現(xiàn)脫節(jié),國內依然沒有建立起剝奪"父母監(jiān)護權"后有效的、完整的法律制度和配套措施,沒有體現(xiàn)國家在未成年人監(jiān)護中的兜底責任。建議加快構建一體化聯(lián)動機制,不僅要健全監(jiān)護監(jiān)督和監(jiān)護干預制度,而且要完善對監(jiān)護失職行為的處罰措施,并積極引導社會關注和支持未成年人監(jiān)護工作。
[Abstract]:Under the paradigm of law and policy, as far as the juvenile guardianship legislation of our country is concerned, from the perspective of policy, the instrumental nature of law and the purpose of law are insufficient, while from the angle of law, there are no problems of legitimacy and democratic legitimacy.But there are many defects in the feasibility.The reason is that during the period of social transformation in which the number of left-behind children is increasing and parental guardianship is beyond control, there is a disconnect between policies and laws, and there is still no effective and complete legal system and supporting measures in China after depriving parents of "parental custody."It does not reflect the responsibility of the state in the custody of minors.It is suggested to accelerate the construction of an integrated linkage mechanism, not only to improve the supervision and monitoring intervention system, but also to perfect the punishment measures for the dereliction of duty, and to actively guide the society to pay attention to and support the work of minors' guardianship.
