【摘要】：我國(guó)的農(nóng)村土地承包經(jīng)營(yíng)權(quán)經(jīng)歷了一個(gè)從禁止流轉(zhuǎn)到支持、鼓勵(lì)流轉(zhuǎn)的過程。隨著農(nóng)村經(jīng)濟(jì)的進(jìn)一步發(fā)展,限制農(nóng)村土地承包經(jīng)營(yíng)權(quán)流轉(zhuǎn)這一做法已經(jīng)跟不上農(nóng)村生產(chǎn)發(fā)展的要求,不利于進(jìn)一步解放農(nóng)村生產(chǎn)力,因而國(guó)家對(duì)這一規(guī)定進(jìn)行了適時(shí)的調(diào)整。如2008年《物權(quán)法》將農(nóng)村土地承包經(jīng)營(yíng)權(quán)正式定性為一種用益物權(quán),對(duì)土地承包經(jīng)營(yíng)權(quán)抵押?jiǎn)栴}進(jìn)行了再次重申,從而使土地承包經(jīng)營(yíng)權(quán)抵押貸款有了理論依據(jù);2013年11月12日召開的十八屆三中全會(huì)通過了《中共中央關(guān)于全面深化改革若干重大問題的決定》等,明確了中央政府對(duì)土地抵押貸款業(yè)務(wù)的支持態(tài)度。本文通過對(duì)現(xiàn)有法律和政策的梳理以及對(duì)在全國(guó)推行農(nóng)村土地承包經(jīng)營(yíng)權(quán)抵押貸款的必要性與可行性的肯定和對(duì)各地農(nóng)村土地承包經(jīng)營(yíng)權(quán)抵押貸款試點(diǎn)工作取得成效的分析,看到了在全國(guó)推行農(nóng)村土地承包經(jīng)營(yíng)權(quán)抵押貸款的困境。在總結(jié)分析各個(gè)試點(diǎn)取得的成功與不足后,指出國(guó)家應(yīng)構(gòu)建我國(guó)農(nóng)村土地承包經(jīng)營(yíng)權(quán)抵押貸款的法律保障制度框架,并從完善法律、出臺(tái)司法解釋以及結(jié)合大數(shù)據(jù)平臺(tái)和農(nóng)村普惠經(jīng)融服務(wù)制度完善相關(guān)配套制度的角度予以具體的闡述。
[Abstract]:The contracted management right of rural land in our country has experienced a process from prohibiting circulation to supporting and encouraging circulation.With the further development of rural economy, the practice of restricting the transfer of contracted management right of rural land has been unable to keep up with the requirements of rural production and development, which is not conducive to further emancipating rural productive forces, so the state has made timely adjustments to this provision.For example, in 2008, the right of contracted management of rural land was formally characterized as a usufruct right, and the issue of mortgage of the right to contract management of land was reiterated again.The third Plenary session of the 18th CPC Central Committee held on November 12, 2013, adopted the "decision of the CPC Central Committee on comprehensively deepening several important issues of Reform," and so on.Clear central government to land mortgage loan business support attitude.This paper analyzes the existing laws and policies, the necessity and feasibility of carrying out the rural land contractual management right mortgage loan in the whole country, and the effectiveness of the pilot work of the rural land contract management right mortgage loan.To see the implementation of the country in rural land contractual management right mortgage loan dilemma.After summing up and analyzing the success and deficiency of each pilot project, the author points out that the country should construct the legal guarantee system frame of the right of contracted management of rural land in our country, and perfect the law.Introducing judicial interpretation and combining big data platform and rural inclusive financial service system to improve the relevant supporting system to give a specific elaboration.
