【摘要】:農(nóng)業(yè)補(bǔ)貼在保障國(guó)家糧食安全、促進(jìn)社會(huì)和諧穩(wěn)定、加快農(nóng)村經(jīng)濟(jì)建設(shè)、提升農(nóng)民生活質(zhì)量等方面發(fā)揮著十分重要的作用。由于農(nóng)業(yè)補(bǔ)貼資金由一國(guó)政府從中央和地方財(cái)政中劃撥,因此,這種國(guó)家行為很容易被誤認(rèn)為是建設(shè)福利國(guó)家的一個(gè)組成部分。事實(shí)上,農(nóng)業(yè)補(bǔ)貼并不是國(guó)家對(duì)農(nóng)民提供的福利保障,其目的不是用來(lái)抵御有可能出現(xiàn)的個(gè)人生存風(fēng)險(xiǎn),不以解決個(gè)體溫飽或?qū)θ鮿?shì)群體提供社會(huì)保障為出發(fā)點(diǎn)。農(nóng)業(yè)補(bǔ)貼是國(guó)家以行政干預(yù)為手段,通過(guò)對(duì)公共財(cái)政的再分配,從有利于社會(huì)整體發(fā)展的角度來(lái)協(xié)調(diào)社會(huì)發(fā)展與生產(chǎn)經(jīng)營(yíng)者的關(guān)系,它不只關(guān)注個(gè)人利益,更關(guān)注政策實(shí)施的宏觀效果,秉承的是一種給付行政理念。本文運(yùn)用傳統(tǒng)行政法學(xué)、現(xiàn)代行政法學(xué)、公共財(cái)政學(xué)等相關(guān)理論和分析方法,將農(nóng)業(yè)補(bǔ)貼納入行政行為框架內(nèi)進(jìn)行討論,圍繞農(nóng)業(yè)補(bǔ)貼的特征和性質(zhì)、農(nóng)業(yè)補(bǔ)貼法律制度的完善等問(wèn)題進(jìn)行探討。主要研究成果如下:1.對(duì)農(nóng)業(yè)補(bǔ)貼的目的、主體、客體、對(duì)象和行為特征進(jìn)行了辨析,并以傳統(tǒng)行政法學(xué)上公、私法絕對(duì)二元分立理論為根基,對(duì)農(nóng)業(yè)補(bǔ)貼性質(zhì)的不同學(xué)說(shuō)進(jìn)行了分析,最終明確了農(nóng)業(yè)補(bǔ)貼的公法行為性質(zhì),提出農(nóng)業(yè)補(bǔ)貼行為是行政法調(diào)整下的行政行為。2.明確農(nóng)業(yè)補(bǔ)貼不是政府無(wú)條件的慈善資助,而是賦予相對(duì)人一定義務(wù)的,以保障個(gè)人權(quán)益、維護(hù)促進(jìn)社會(huì)和諧穩(wěn)定發(fā)展為目的,政府依法或政策向符合補(bǔ)貼條件的對(duì)象提供資金支持的行政給付行為。3.對(duì)農(nóng)業(yè)補(bǔ)貼進(jìn)行法律規(guī)制,是實(shí)現(xiàn)人民主權(quán)與監(jiān)督國(guó)家義務(wù)的有效途徑,是保障補(bǔ)貼對(duì)象受益權(quán)的有力抓手,是依法行政的必然要求。4.文章通過(guò)對(duì)我國(guó)農(nóng)業(yè)補(bǔ)貼法律規(guī)制現(xiàn)狀進(jìn)行梳理,結(jié)合域外較為成熟的農(nóng)業(yè)補(bǔ)貼立法實(shí)踐經(jīng)驗(yàn),對(duì)我國(guó)農(nóng)業(yè)補(bǔ)貼法律規(guī)制提出合理制定規(guī)則、轉(zhuǎn)變行政理念、正確處理農(nóng)業(yè)補(bǔ)貼政策與立法之間關(guān)系、建立有效的責(zé)任追究機(jī)制等建議。最后,文章對(duì)我國(guó)農(nóng)業(yè)補(bǔ)貼立法模式之完善提出設(shè)想,認(rèn)為我國(guó)應(yīng)單獨(dú)出臺(tái)一部《農(nóng)業(yè)補(bǔ)貼法》,以實(shí)現(xiàn)對(duì)農(nóng)業(yè)補(bǔ)貼的依法規(guī)范。
[Abstract]:Agricultural subsidies play an important role in ensuring national food security, promoting social harmony and stability, speeding up rural economic construction and improving the quality of life of farmers.Since agricultural subsidy funds are allocated by a government from central and local governments, such state actions can easily be mistaken as part of the building of a welfare state.As a matter of fact, agricultural subsidies are not welfare security provided by the state to farmers, and their purpose is not to resist the possible personal survival risks, and not to solve the problem of food and clothing for individuals or to provide social security for vulnerable groups.Agricultural subsidy is to coordinate the relationship between social development and production operators through the redistribution of public finance through administrative intervention by the state. It is not only concerned about individual interests, but also from the perspective of social development as a whole.Pay more attention to the macro effect of policy implementation, adhering to an administrative concept of payment.Based on the theories and analytical methods of traditional administrative law, modern administrative law and public finance, this paper discusses the characteristics and nature of agricultural subsidy in the framework of administrative behavior.The perfection of the agricultural subsidy law system and so on question carries on the discussion.The main research results are as follows: 1.The purpose, subject, object, object and behavior characteristics of agricultural subsidy are analyzed, and the different theories of agricultural subsidy are analyzed based on the theory of absolute dualism of public and private law in the traditional administrative law.Finally, it clarifies the nature of the public law behavior of agricultural subsidy, and puts forward that the agricultural subsidy behavior is the administrative act under the adjustment of administrative law.To make it clear that agricultural subsidies are not unconditional charitable grants by the government, but rather give certain obligations to the relative parties, in order to safeguard individual rights and interests and safeguard and promote social harmony and stable development.According to law or policy, the government provides financial support to those who meet the subsidy conditions. 3. 3.The legal regulation of agricultural subsidy is an effective way to realize the people's sovereignty and supervise the national obligation, is a powerful hand to protect the beneficiary right of subsidy object, and is the inevitable requirement of administration by law.By combing the current situation of the legal regulation of agricultural subsidy in China and combining with the practical experience of agricultural subsidy legislation in foreign countries, the article puts forward reasonable rules for the legal regulation of agricultural subsidy in China, and changes the administrative idea.To correctly deal with the relationship between agricultural subsidy policy and legislation, to establish an effective accountability mechanism.Finally, the article puts forward a tentative plan to perfect the legislative model of agricultural subsidy in our country, and holds that we should issue a separate "Agricultural subsidy Law" in order to realize the regulation of agricultural subsidy according to law.
