【摘要】：2013年3月14日，第十二屆全國(guó)人大第一次會(huì)議審議通過(guò)《國(guó)務(wù)院機(jī)構(gòu)改革和職能轉(zhuǎn)變方案》，重新組建國(guó)家海洋局。國(guó)家海洋局以中國(guó)海警局（CHINA COAST GUARD）名義開(kāi)展海上維權(quán)執(zhí)法。但由于我國(guó)海洋法律法規(guī)本身的不健全不完善，以及本次改革采取的是機(jī)構(gòu)先行等原因，致使新組建的中國(guó)海警局無(wú)論是在執(zhí)法依據(jù)上，還是在執(zhí)法過(guò)程中都存在一些亟待解決的問(wèn)題。這些問(wèn)題的存在，嚴(yán)重制約了中國(guó)海警海上執(zhí)法工作的順利開(kāi)展，也很難有效維護(hù)國(guó)家海洋權(quán)益和海上安全。由于中國(guó)海警局為新設(shè)機(jī)構(gòu)，在本文之前，許多專家學(xué)者主要是對(duì)海上執(zhí)法體制進(jìn)行研究，，涉及中國(guó)海警局海上執(zhí)法的內(nèi)容相對(duì)較少。 在結(jié)構(gòu)安排上，本文由四個(gè)部分構(gòu)成。第一章主要介紹中國(guó)海警的發(fā)展和構(gòu)成，海上執(zhí)法的特點(diǎn)和原則。第二章深入分析了我國(guó)海洋法律體系建設(shè)，也就是海警海上執(zhí)法依據(jù)方面存在的問(wèn)題和缺陷。第三章深入分析了中國(guó)海警海上執(zhí)法本身存在的弊端，以及影響中國(guó)海警海上執(zhí)法的突出問(wèn)題。第四章是本文的落腳點(diǎn)，在前文分析的基礎(chǔ)上，對(duì)中國(guó)海警海上執(zhí)法提出了相應(yīng)的對(duì)策和建議。
[Abstract]:On March 14, 2013, the first session of the Twelfth National people's Congress deliberated on the adoption of the State Council's Program for Institutional Reform and functional Transformation to re-establish the State Oceanic Administration.The State Oceanic Administration carries out maritime rights enforcement on behalf of China Sea Police Department (CHINA COAST GUARD).However, due to the imperfections of China's maritime laws and regulations itself and the fact that the reform is based on institutional priorities, the newly established China Sea Police Department, whether on the basis of law enforcement,There are still some problems to be solved in the course of law enforcement.The existence of these problems has seriously restricted the smooth development of the maritime law enforcement work of China's marine police, and it is also very difficult to effectively safeguard the national maritime rights and interests and maritime safety.Since China Sea Police Station is a new institution, before this paper, many experts and scholars mainly study the maritime law enforcement system, and the content of maritime law enforcement involving China Sea Police Station is relatively small.In the structure arrangement, this article is composed of four parts.The first chapter mainly introduces the development and composition of China's marine police, the characteristics and principles of maritime law enforcement.The second chapter deeply analyzes the problems and defects of maritime law enforcement in our country.The third chapter deeply analyzes the disadvantages of the maritime law enforcement and the prominent problems that affect the maritime law enforcement.The fourth chapter is the foothold of this paper, on the basis of the previous analysis, put forward the corresponding countermeasures and suggestions to the maritime law enforcement of Chinese coast police.
