【摘要】：農(nóng)地三權(quán)分置改革的實(shí)質(zhì)是在現(xiàn)有農(nóng)地所有權(quán)和承包經(jīng)營權(quán)二元結(jié)構(gòu)的基礎(chǔ)上,分化為所有權(quán)、承包權(quán)、經(jīng)營權(quán)三元結(jié)構(gòu),也就是在承包經(jīng)營權(quán)的基礎(chǔ)上再分化出一個(gè)獨(dú)立類型的經(jīng)營權(quán)。土地承包經(jīng)營權(quán)糾紛的司法治理具有為未來承包權(quán)、經(jīng)營權(quán)制度構(gòu)造提供規(guī)則供給的功能。通過對(duì)裁判文書網(wǎng)相關(guān)裁判數(shù)據(jù)的梳理可以發(fā)現(xiàn),實(shí)務(wù)界在現(xiàn)有土地承包經(jīng)營權(quán)流轉(zhuǎn)糾紛的認(rèn)識(shí)上還缺乏相應(yīng)的類型構(gòu)造。要發(fā)揮司法治理在土地承包經(jīng)營權(quán)流轉(zhuǎn)糾紛和未來相應(yīng)制度的規(guī)則供給方面的作用和功能,須構(gòu)造土地承包經(jīng)營權(quán)流轉(zhuǎn)糾紛的獨(dú)立的認(rèn)識(shí)類型,并建立相應(yīng)規(guī)則供給的保障性制度。
[Abstract]:On the basis of the dual structure of the ownership of agricultural land and the right of contractual management, the essence of the reform of the separation of the three rights of farmland is to divide into three structures of ownership, right of contract and right of management.That is, on the basis of the contractual management right to differentiate a separate type of management rights.The judicial management of land contract management right dispute has the function of providing rules for future contract right and management right system construction.By combing the relevant adjudicative data of the adjudicative documents network, we can find that the practical circles still lack the corresponding type structure on the understanding of the existing land contract management right circulation dispute.In order to give full play to the role and function of judicial governance in the disputes over the transfer of land contractual management rights and the supply of rules of the corresponding system in the future, it is necessary to construct an independent cognitive type of disputes over the transfer of land contractual management rights.And establishes the corresponding rule supply safeguard system.
