【摘要】：十八屆三中全會(huì)《中共中央關(guān)于全面深化改革重大問(wèn)題決定》要求改革完善農(nóng)村宅基地制度。這對(duì)于農(nóng)村宅基地制度改革具有指針意義。落實(shí)這一要求,首先要合理安排宅基地和宅基地上構(gòu)筑物的關(guān)系,使其不僅科學(xué),而且符合宅基地及其上構(gòu)筑物使用、流轉(zhuǎn)的便捷和效率要求。其次,就宅基地使用權(quán)的保障功能而言,其實(shí)現(xiàn)了"居者有其屋"的人之生存基本需求。改革農(nóng)村宅基地制度,實(shí)現(xiàn)其財(cái)產(chǎn)價(jià)值,必然會(huì)弱化宅基地生存保障功能,這就要求要完善我國(guó)農(nóng)村社會(huì)保障制度。最后,允許宅基地使用權(quán)自由流轉(zhuǎn),要堅(jiān)持平等原則和市場(chǎng)化原則,以保障實(shí)現(xiàn)宅基地使用權(quán)的財(cái)產(chǎn)價(jià)值。
[Abstract]:The third Plenary session of the 18th CPC Central Committee called for the reform and perfection of the rural homestead system.This for the reform of the rural homestead system has a guiding significance.In order to fulfill this requirement, we should arrange the relationship between the homestead and the structure on the homestead reasonably, make it not only scientific, but also accord with the requirement of convenience and efficiency of the use and circulation of the homestead and its upper structure.Secondly, as far as the function of protecting the right to use the homestead is concerned, it realizes the basic living needs of the people who have their own house.The reform of the rural homestead system and the realization of its property value will inevitably weaken the function of homestead survival guarantee, which requires the improvement of the rural social security system in our country.Finally, to allow the free circulation of homestead use right, we should adhere to the principle of equality and marketization in order to ensure the realization of the property value of homestead use right.
