大陸和臺灣就業(yè)促進法律制度比較研究

【摘要】:就業(yè)促進,是指為了保障公民勞動權(quán)利順利實現(xiàn),由國家、社會及用人單位通過提供就業(yè)機會、創(chuàng)造就業(yè)條件、訓練職業(yè)技能等措施來推動勞動者就業(yè)的過程。我國人口眾多,是世界上人口和勞動力最多的國家,就業(yè)問題也多種多樣,隨著社會經(jīng)濟的不斷發(fā)展,轉(zhuǎn)軌就業(yè)、高校畢業(yè)生就業(yè)、農(nóng)村大量勞動力剩余等就業(yè)問題日益嚴重。針對就業(yè)問題,中央及各級政府出臺各種促進就業(yè)政策、建立健全公共就業(yè)服務市場,以期降低失業(yè)率推動全民就業(yè)。然而,這些政策規(guī)章過于原則性,僅僅停留在口號的層面,其宣誓作用遠大于實踐操作性。同時由于政策的易變性,造成就業(yè)促進在實踐執(zhí)行中的混亂。因此,建立科學完善的就業(yè)促進法律制度對推動我國就業(yè)促進十分必要。隨著就業(yè)促進法等相關(guān)制度的頒布實施,我國就業(yè)促進法律制度已初步成體系,但由于就業(yè)促進法是就業(yè)促進政策法律化的產(chǎn)物,缺乏可操作性。同時,因為我國就業(yè)促進法律制度失業(yè)保險的屬性,在失業(yè)保險制度中就業(yè)促功能不是首位的,不能有效充分發(fā)揮其促進就業(yè)功能。并且因我國經(jīng)濟發(fā)展的嚴重不均衡及城鄉(xiāng)就業(yè)的二元屬性,各地政府用于就業(yè)促進的經(jīng)費大不相同、城市和農(nóng)村就業(yè)促進的發(fā)展存在很大差距,導致各地有關(guān)就業(yè)促進的勞動力市場在落實就業(yè)服務措施方面存在很大差別。相比較而言,臺灣的就業(yè)促進已經(jīng)發(fā)展了很多年,有了很豐富的實踐經(jīng)驗,在實施就業(yè)促進方面取得了很好的成果。不僅設(shè)立了就業(yè)保險制度,而且頒布了一整套完善成熟的就業(yè)促進法律制度。鑒于大陸和臺灣在社會文化、法律制度等方面的高度相似性,筆者希望通過兩岸就業(yè)促進法律制度的比較研究,發(fā)現(xiàn)兩者各自在就業(yè)促進法律制度內(nèi)容及結(jié)構(gòu)上的優(yōu)點和不足,進而學習臺灣相關(guān)成熟的實踐經(jīng)驗,探索出現(xiàn)階段適合大陸的就業(yè)促進法律制度。使得大陸就業(yè)促進法律制度更加科學化完善化,以便最大程度的發(fā)揮就業(yè)促進功能、降低失業(yè)率、促進社會穩(wěn)定,實現(xiàn)社會經(jīng)濟的和諧穩(wěn)定發(fā)展。
[Abstract]:Employment promotion refers to the process of promoting the employment of workers by providing employment opportunities, creating employment conditions, training vocational skills and so on, in order to ensure the smooth realization of citizens' labor rights.Our country has a large population and the largest labor force in the world, and the employment problems are also varied. With the development of social economy, the transition to employment, the employment of college graduates, the surplus of a large number of rural labor force and other employment problems are increasingly serious.In view of the employment problem, the central government and the governments at all levels have issued various policies to promote employment and establish and improve the public employment service market in order to reduce the unemployment rate and promote full employment.However, these policies and regulations are too principled to remain at the level of slogans.At the same time, due to the volatility of policy, employment promotion in practice in the implementation of confusion.Therefore, it is necessary to establish a scientific and perfect legal system for employment promotion in China.With the promulgation and implementation of the employment promotion law and other related systems, the employment promotion legal system of our country has been initially systemized, but because the employment promotion law is the product of employment promotion policy legalization, it is lack of maneuverability.At the same time, because of the attribute of unemployment insurance in the legal system of employment promotion in our country, the function of promoting employment is not the first in the system of unemployment insurance, and it can not give full play to its function of promoting employment.And because of the serious imbalance of economic development and the dual attribute of urban and rural employment, the funds used by local governments for employment promotion are very different, and there is a big gap between urban and rural employment promotion development.As a result, local employment promotion of the labor market in the implementation of employment services measures are very different.In contrast, Taiwan's employment promotion has developed for many years, with rich practical experience and good results in the implementation of employment promotion.Not only has the employment insurance system been established, but also a set of mature employment promotion laws have been promulgated.In view of the high similarity between the mainland and Taiwan in the aspects of social culture and legal system, the author hopes to find out the advantages and disadvantages of the two sides in the content and structure of the employment promotion legal system through the comparative study of the cross-strait employment promotion legal system.Then we study Taiwan's relevant mature practical experience and explore the employment promotion legal system suitable for mainland China.In order to maximize the function of employment promotion, reduce unemployment rate, promote social stability and realize the harmonious and stable development of social economy, the mainland's employment promotion legal system is more scientific and perfect.
