【摘要】:現(xiàn)行物業(yè)管理立法主要針對(duì)的對(duì)象是住宅物業(yè)。而商業(yè)物業(yè)因其具有收益性、公眾性、服務(wù)對(duì)象多樣性等不同與住宅物業(yè)的屬性,簡(jiǎn)單類比適用現(xiàn)行物業(yè)管理立法是業(yè)主和物業(yè)服務(wù)企業(yè)在履行商業(yè)物業(yè)服務(wù)合同的過(guò)程中屢發(fā)糾紛的原因之一。針對(duì)商業(yè)物業(yè)服務(wù)合同履行過(guò)程中主要存在的合同簽訂主體、物業(yè)服務(wù)費(fèi)、專項(xiàng)維修資金、商業(yè)物業(yè)保險(xiǎn)等問(wèn)題,本文將采取理論和實(shí)證相結(jié)合、并輔之比較的方法,借鑒各國(guó)和地區(qū)優(yōu)秀的做法,在我國(guó)物業(yè)管理實(shí)踐的基礎(chǔ)上,認(rèn)定業(yè)主大會(huì)的法人地位和業(yè)主委員會(huì)“其他組織”的法律地位;明確商業(yè)物業(yè)服務(wù)合同的簽訂主體是業(yè)主與商業(yè)物業(yè)服務(wù)企業(yè),商戶可以成為商業(yè)物業(yè)服務(wù)企業(yè)的簽訂主體;商業(yè)物業(yè)費(fèi)應(yīng)采取“市場(chǎng)調(diào)節(jié)價(jià)為主,政府指導(dǎo)價(jià)為輔”的定價(jià)模式;改進(jìn)和完善包干制和酬金制、綜合物業(yè)費(fèi)等物業(yè)費(fèi)計(jì)費(fèi)方式;規(guī)范業(yè)主和商戶欠繳物業(yè)費(fèi)時(shí)商業(yè)物業(yè)服務(wù)企業(yè)的救濟(jì)措施;強(qiáng)制設(shè)立商業(yè)物業(yè)專項(xiàng)維修資金,規(guī)范商業(yè)物業(yè)專項(xiàng)維修資金交存、使用和監(jiān)督環(huán)節(jié);強(qiáng)制引入商業(yè)物業(yè)服務(wù)保險(xiǎn)以及完善物業(yè)管理責(zé)任保險(xiǎn)產(chǎn)品等。最后,第四章以商業(yè)物業(yè)管理立法完善建議的形式對(duì)前三章探討的問(wèn)題歸納總結(jié)?傊,只有明確商業(yè)物業(yè)服務(wù)合同履行過(guò)程中出現(xiàn)的法律問(wèn)題的原因及對(duì)策,才能有效減少商業(yè)物業(yè)在“無(wú)法可依”的情況下所產(chǎn)生的糾紛。保障商業(yè)物業(yè)管理中的多方主體利益,是研究商業(yè)物業(yè)服務(wù)合同履行過(guò)程中的主要法律問(wèn)題一文的意義所在。
[Abstract]:Current property management legislation is mainly aimed at residential property.Commercial property is different from residential property because of its profitability, public nature, diversity of service objects, etc.It is one of the reasons that the owners and the property service enterprises frequently produce disputes in the process of performing the commercial property service contract by using simple analogy to apply the current legislation of property management.In view of the main problems of contract signing, property service charge, special maintenance fund, commercial property insurance and so on in the process of performing commercial property service contract, this paper will adopt the method of combining theory and demonstration, and comparing it with each other.On the basis of the practice of property management in China, the legal person status of the owners' Congress and the legal status of "other organizations" of the owners' committee are determined on the basis of the excellent practices of various countries and regions.It is clear that the subject of signing the commercial property service contract is the owner and the commercial property service enterprise, and the merchant can become the signing subject of the commercial property service enterprise.The pricing mode of the government guiding price is supplementary; the reform and perfection of the contract system and the fee system, the comprehensive property fee and other charging methods; the regulation of the relief measures of the commercial property service enterprises when the owners and merchants fail to pay the property fees;Compulsory establishment of commercial property special maintenance funds, standardize commercial property special maintenance funds deposit, use and supervision links; mandatory introduction of commercial property service insurance and improve property management liability insurance products.Finally, the fourth chapter summarizes the problems discussed in the first three chapters in the form of suggestions on the perfection of commercial property management legislation.In a word, only by making clear the causes and countermeasures of the legal problems in the process of the performance of the commercial property service contract, can the disputes arising from the commercial property under the circumstances of "unable to abide by" be effectively reduced.To protect the interests of multiple parties in commercial property management is the significance of studying the main legal issues in the process of fulfilling commercial property service contracts.
