【摘要】：隨著我國新型城鎮(zhèn)化進(jìn)程的加快,城市規(guī)模不斷擴(kuò)大,因而政府在城鎮(zhèn)化過程中對土地征收,對公民個人房屋的拆遷也隨之增加。政府對土地征收和房屋拆遷,直接導(dǎo)致了公民土地權(quán)利、財產(chǎn)權(quán)利和居住權(quán)等利益的改變,從而引發(fā)了大量的、各種不同形式的社會矛盾。因此,如何依法化解和控制這些社會矛盾是當(dāng)今法治社會亟需解決的難題。由于受歷史和現(xiàn)實(shí)的影響,我國在土地征收與房屋拆遷中一直過分強(qiáng)調(diào)公共利益,而忽視個體利益,導(dǎo)致土地征收與房屋拆遷時對公民個人利益的考量不足,對其利益的保障存在隨意性,且在這樣的過程中還摻雜了權(quán)力尋租和權(quán)力濫用的現(xiàn)象。鑒于當(dāng)前我國在城鎮(zhèn)化過程中有關(guān)土地征收與房屋拆遷的法律制度不完善、再加之公民權(quán)利保護(hù)認(rèn)識上的不足,因此,在城鎮(zhèn)化過程中涉及到土地征收與房屋拆遷問題上的處理措施十分混亂,從而在這一領(lǐng)域產(chǎn)生了諸多矛盾沖突,這既給社會和個人造成了諸多傷害,也給政府的公信力乃至聲譽(yù)造成了不良的影響。當(dāng)前,法律是控制和化解各種社會矛盾的依據(jù)。因此,如何運(yùn)用法律制度對城鎮(zhèn)化過程中涉及的土地征收與房屋拆遷行為進(jìn)行規(guī)制,如何建立與市場經(jīng)濟(jì)體制相適應(yīng)的城鎮(zhèn)化過程中土地征收與房屋拆遷制度,如何運(yùn)用法律規(guī)范來平衡城鎮(zhèn)化過程中土地征收與房屋拆遷各主體之間的利益分配,就顯得特別重要。本文基于法社會學(xué)的視角,圍繞治理城鎮(zhèn)化過程中土地征收及房屋拆遷矛盾,從以下幾個方面來進(jìn)行分析和論述:第一部分,緒論。旨在提出城鎮(zhèn)化過程中土地征收與房屋拆遷存在的社會問題。就該問題研究的社會背景、研究內(nèi)容、研究方法等進(jìn)行簡要梳理。第二部分,對城鎮(zhèn)化過程中土地征收和房屋拆遷的基本問題進(jìn)行分析。包括土地征收和房屋拆遷釋義、城鎮(zhèn)化過程中土地征收和房屋拆遷法律性質(zhì)進(jìn)行簡要闡述。第三部分,從法社會學(xué)的角度對城鎮(zhèn)化過程中土地征收和房屋拆遷利益主體及沖突進(jìn)行剖析。分別從資源占有不均、利益訴求泛化、法律法規(guī)選擇余地較大等方面來進(jìn)行分析。第四部分,就我國當(dāng)前城鎮(zhèn)化過程中土地征收和房屋拆遷沖突法律控制存在的問題進(jìn)行分析。主要從法律規(guī)制、法定程序執(zhí)行狀態(tài)、權(quán)利保障等問題來進(jìn)行討論。第五部分,依據(jù)當(dāng)前城鎮(zhèn)化過程中土地征收和房屋拆遷存在的社會矛盾分析,從法律的社會控制角度出發(fā)提出完善土地征收和房屋拆遷的一系列法治方法,以期創(chuàng)新土地征收和房屋拆遷的社會法治措施與制度。第六部分,對本文研究的問題進(jìn)行簡要總結(jié),形成結(jié)論。全文共約50000余字。
[Abstract]:With China's new urbanization process accelerated, the city continues to expand the scale, so the government levied on land in the process of urbanization, the individual housing demolition is also increased. The government of the land expropriation and housing demolition, led directly to the citizens of the land rights, property rights and housing rights interests change, which triggered a large number of different kinds of social contradictions. Therefore, how to control and resolve these contradictions is the problem in today's society under the rule of law needs to be solved. Due to the influence of history and reality, our country in the land expropriation and housing demolition has been too much emphasis on the public interests, while ignoring the individual interests, lack of interests of individual citizens considering that land expropriation and housing demolition, to protect the interests of the existence of arbitrary, and in this process with the abuse of power and abuse of power in view of the phenomenon. Our country in the process of urbanization related legal system for land expropriation and housing demolition is not perfect, coupled with the protection of civil rights lack understanding, therefore, in the process of urbanization involves measures of land expropriation and housing demolition issue is very confusing, resulting in many conflicts in this field, the both to the society and individuals caused a lot of damage to the government's credibility and reputation of the adverse effects. At present, the law is to control and resolve various social contradictions basis. Therefore, how to use the legal system to the urbanization process involved in land expropriation and housing demolition conduct regulation, how to set up the process of urbanization. With the market economy system in the land expropriation and housing demolition system, how to use the law to regulate the balance in the process of urbanization of land expropriation and housing demolition and relocation between different subjects The distribution of benefits, it is particularly important. This paper from the perspective of Sociology of law based governance in the process of urbanization around the contradiction of land expropriation and housing demolition, are analyzed and discussed from the following aspects: the first part is introduction. Aiming at the social problems in the process of urbanization of land expropriation and housing demolition. Research on the social background, research contents, research methods and reviewed briefly. The second part, the basic problems in the process of urbanization of land expropriation and housing demolition were analyzed. Including the land expropriation and housing demolition interpretation in the process of urbanization, land expropriation and housing demolition properties were briefly described. The third part carries on the analysis to the urbanization in the process of land expropriation and housing demolition interests and conflicts from the perspective of Sociology of law. The fourth part of China's current urbanization process, land expropriation and housing demolition conflicts of legal control problems were analyzed.
