【摘要】：國務(wù)院從1997年開始在城市管理領(lǐng)域推行相對集中行政處罰試點工作,2002年開始推行綜合執(zhí)法試點工作,各地陸續(xù)成立相應(yīng)的城市管理綜合執(zhí)法機構(gòu),對改善市容市貌、維護(hù)城市環(huán)境、提升城市形象、促進(jìn)城市管理體制改革方面成效顯著。湛江市也于2004年啟動行使相對集中行政處罰權(quán),開展城市管理綜合執(zhí)法工作。自實施相對集中行政處罰權(quán)以來,城市管理綜合執(zhí)法水平不斷提升。但隨著法治政府建設(shè)的要求的提高和城鎮(zhèn)化進(jìn)程的加快,城市管理綜合執(zhí)法中一些深層次的問題和矛盾逐漸凸顯出來,亟待我們在理論和實踐上進(jìn)行研究和探索。本文以湛江市城市管理綜合執(zhí)法中的問題及對策為研究對象,通過文獻(xiàn)研究法、比較分析法、訪談法及問卷調(diào)查法等方法對湛江市城市管理綜合執(zhí)法的現(xiàn)狀、問題以及存在問題的原因進(jìn)行了分析,借鑒了國內(nèi)外先進(jìn)城市的管理經(jīng)驗,在此基礎(chǔ)上提出了完善湛江市綜合執(zhí)法的對策建議。全文共分五個部分展開研究:第一部分,從界定城市管理、城市管理綜合執(zhí)法等相關(guān)概念入手,對城市管理的相關(guān)理論和研究意義進(jìn)行了闡述,并對國內(nèi)外相關(guān)文獻(xiàn)進(jìn)行了歸納整理,為下一章的研究打下基礎(chǔ)。第二部分,根據(jù)湛江市當(dāng)前城市管理綜合執(zhí)法的現(xiàn)狀,從執(zhí)法體制改革發(fā)展階段、執(zhí)法方式、執(zhí)法內(nèi)容等方面詳細(xì)進(jìn)行分析研究。第三部分,對湛江市城市管理綜合執(zhí)法中出現(xiàn)綜合執(zhí)法合法性、合理性和保障體系的完善等問題上進(jìn)行了研究,歸納總結(jié)出相關(guān)法律法規(guī)不健全、執(zhí)法人員素質(zhì)有待提高、執(zhí)法對象復(fù)雜、相關(guān)部門聯(lián)動不夠、公關(guān)危機應(yīng)對能力低下、監(jiān)督機制不夠等深層次原因進(jìn)行分析。第四部分,對國內(nèi)城市管理水平較高、特色顯著的上海市、張家港市、昆山市,以及國外具備完善法律體系管理經(jīng)驗的美國、新加坡、法國城市管理模式進(jìn)行了探討,梳理并總結(jié)了他們成功的管理經(jīng)驗。第五部分,在借鑒國外先進(jìn)城市管理經(jīng)驗的基礎(chǔ)上,立足于湛江城市綜合執(zhí)法的實際,提出了必須樹立正確的執(zhí)法理念,健全相應(yīng)的法律機制,理順綜合執(zhí)法管理機制,提高執(zhí)法人員素質(zhì),重構(gòu)城管形象等對策建議。
[Abstract]:The State Council has been carrying out relatively centralized administrative punishment pilot work in the field of urban management since 1997, and comprehensive law enforcement pilot work has been implemented since 2002. The corresponding comprehensive urban management law enforcement agencies have been set up in various localities one after another to improve the appearance of the city.To maintain the urban environment, improve the image of the city, and promote the reform of urban management system has achieved remarkable results.Zhanjiang City also started to exercise relatively centralized administrative punishment in 2004 to carry out comprehensive law enforcement of urban management.Since the implementation of relatively centralized administrative punishment, the comprehensive law enforcement level of urban management has been improved.However, with the improvement of the construction of the government ruled by law and the acceleration of the urbanization process, some deep-seated problems and contradictions in the comprehensive law enforcement of urban management have been gradually highlighted, and it is urgent for us to study and explore in theory and practice.This paper takes the problems and countermeasures in the comprehensive law enforcement of urban management in Zhanjiang as the object of study. The present situation of comprehensive law enforcement of urban management in Zhanjiang is studied by the methods of literature research, comparative analysis, interview and questionnaire survey.Based on the analysis of the problems and the management experience of advanced cities at home and abroad, the countermeasures and suggestions to perfect the comprehensive law enforcement in Zhanjiang City are put forward.The thesis is divided into five parts: the first part, from the definition of urban management, urban management comprehensive law enforcement and other related concepts, the related theory and research significance of urban management are expounded.And related literature at home and abroad were summarized and sorted, for the next chapter of the research laid the foundation.The second part, according to the current situation of comprehensive law enforcement in Zhanjiang City, analyzes and studies in detail from the reform and development stage of the law enforcement system, the law enforcement method, the law enforcement content and so on.In the third part, the author studies the legitimacy, rationality and security system of comprehensive law enforcement in Zhanjiang city management, and concludes that the relevant laws and regulations are not perfect, and the quality of law enforcement personnel needs to be improved.The complex object of law enforcement, the insufficient linkage of relevant departments, the low response ability of public relations crisis, the insufficient supervision mechanism and other deep-seated reasons are analyzed.The fourth part discusses the urban management models of Shanghai, Zhangjiagang, Kunshan, and the United States, Singapore and France, which have the experience of perfecting the legal system.Combing and summing up their successful management experience.The fifth part, based on the experience of foreign advanced city management and the reality of comprehensive law enforcement in Zhanjiang city, puts forward that we must set up the correct law enforcement idea, perfect the corresponding legal mechanism, and straighten out the comprehensive law enforcement management mechanism.Improve the quality of law enforcement personnel, reconstruction of the image of urban management and other countermeasures.
