農村宅基地使用權動態(tài)配置的可行性及模式探究

【摘要】:農村宅基地是農村集體土地的重要組成部分,是農民生產生活的主要場所,對維護農村社會穩(wěn)定和保障農民基本生活,曾發(fā)揮過積極的作用。土地上的權利是農民最基本的權利,對這一權利的保護關乎農民的生存問題,而宅基地使用權作為一項用益物權被《物權法》所確認,正是為了保障農民的土地權利。當前我國農村宅基地使用權配置主要體現在靜態(tài)的立法上,隨著市場經濟的發(fā)展和城鎮(zhèn)化進程的加快,靜態(tài)配置越來越難以與時代相適應,而且現行宅基地使用權配置方式已經阻礙了農村經濟的發(fā)展,同時也損害了農民的切身利益。因此,改革和完善我國宅基地使用權制度就顯得十分迫切。本文摒棄僅對農村宅基地使用權進行靜態(tài)配置的現有觀點,試圖運用動態(tài)分析方法研究宅基地使用權配置問題,論證宅基地使用權動態(tài)配置的合理性與可行性,進而探究宅基地使用權動態(tài)配置的模式,并結合我國當前國情,提出切合實際的制度設想。希望宅基地使用權的動態(tài)配置盡快在立法上得以體現,賦予農民更多的財產性權利。除引言和結語外,本文共分為以下四個部分:第一部分為農村宅基地使用權及其配置的概念界定。首先闡述了農村宅基地使用權的定義,然后介紹了農村宅基地使用權配置的相關概念,說明配置和流轉的區(qū)別與聯系,并運用動態(tài)分析方法對宅基地使用權的配置進行了分類闡釋。第二部分是對農村宅基地使用權配置的現狀分析。首先通過對法條的解讀分析當前農村宅基地使用權配置的立法現狀,然后指出現行宅基地使用權配置中存在的問題,包括法律規(guī)范滯后且匱乏、宅基地使用權不能自由流轉、農村宅基地空置浪費嚴重和隱形流轉現象盛行等問題,最后分析農村宅基地使用權缺乏動態(tài)配置的原因。第三部分論述了農村宅基地使用權動態(tài)配置的合理性與可行性。宅基地使用權動態(tài)配置是物權發(fā)展的要求,是城鄉(xiāng)發(fā)展一體化的要求,是拓寬農民融資渠道的需要,是土地資源優(yōu)化配置的需要。宅基地使用權動態(tài)配置的可行性在于法律為其預留了空間,它符合改革方向和政策要求,也具備一定的現實基礎。第四部分探究了農村宅基地使用權動態(tài)配置的模式。首先分析宅基地使用權動態(tài)配置現有模式的不足,然后提出宅基地使用權動態(tài)配置的理想模式和現實模式,并分別對其模式的制度設想展開論述。
[Abstract]:The rural homestead is an important part of the rural collective land, is the main place of farmers' production and life, which can safeguard the rural social stability and guarantee the peasants' basic life. The rights on the land are the most basic rights of the peasants, and the protection of this right is related to the survival of farmers, and the right to use the homestead as a usufruct is confirmed by the Real right Law. It is in order to protect the farmers' land rights. At present, the allocation of the right to use the rural homestead in our country is mainly reflected in the static legislation. With the development of the market economy and the acceleration of the urbanization process, the static allocation is becoming more and more difficult to adapt to the times. Moreover, the current allocation of the right to use the homestead has hindered the development of the rural economy and also harmed the vital interests of the peasants. It is very urgent to reform and perfect the system of the right to use the homestead in our country. This paper abandons the existing viewpoint that only the right to use the rural homestead is statically allocated, and tries to use the dynamic analysis method to study the allocation of the usufruct of the homestead. To demonstrate the rationality and feasibility of the dynamic allocation of the right to use the homestead, and then to explore the mode of the dynamic allocation of the right to use the homestead, and to combine with the current situation of our country. It is hoped that the dynamic allocation of homestead use right will be embodied in legislation as soon as possible, and that farmers will be given more property rights. This paper is divided into the following four parts: the first part is the definition of the right to use the rural homestead and its configuration. First, the definition of the right to use the rural homestead is expounded, and then the related concepts of the allocation of the right to use the rural homestead are introduced. Explain the differences and connections between configuration and flow, The second part is the analysis of the current situation of the allocation of the right to use the rural homestead. First, through the interpretation of the law to analyze the current use of rural homestead. The current legislative situation of power allocation, Then it points out the problems existing in the present allocation of the right to use the homestead, including the lag and lack of legal norms, the lack of free circulation of the right to use the homestead, the serious waste of vacant homestead in rural areas and the prevalence of the phenomenon of invisible circulation, etc. The third part discusses the rationality and feasibility of the dynamic allocation of rural homestead use right, the dynamic allocation of homestead use right is the requirement of real right development. It is the requirement of the integration of urban and rural development, the need of widening farmers' financing channels and the need of optimizing the allocation of land resources. The feasibility of dynamic allocation of homestead use right lies in the space reserved for it by law, which conforms to the reform direction and policy requirements. The fourth part probes into the mode of dynamic allocation of the right to use the rural homestead. Firstly, it analyzes the deficiency of the existing mode of dynamic allocation of the right to use the homestead. Then it puts forward the ideal mode and realistic mode of dynamic allocation of homestead use right, and discusses the system assumption of its mode respectively.
