拆遷中承租人利益保障問題研究

【摘要】:房屋是人們重要的生活、生產(chǎn)物質(zhì)資料。近些年來,房屋資源不均衡現(xiàn)象越來越嚴(yán)重,房屋租賃成了解決這一問題的有效途徑。又隨著城市化進(jìn)程的快速發(fā)展,房屋拆遷已成為了社會熱點(diǎn)問題。拆遷征地糾紛關(guān)系民生,涉及人數(shù)眾多,法律關(guān)系復(fù)雜,而我國城市房屋拆遷過程中仍存在著補(bǔ)償制度立法不完善、拆遷補(bǔ)償方式簡單化等問題,導(dǎo)致拆遷補(bǔ)償糾紛巨增,拆遷問題處理不好而會引起巨大的社會矛盾。拆遷中不僅涉及到房屋所有人的利益,也涉及到承租人作為拆遷的相關(guān)人的利益。長期以來我國在城市房屋拆遷過程中一直沿用《城市房屋拆遷管理?xiàng)l例》,在2011年1月19日國務(wù)院出臺并實(shí)施新的《國有土地上房屋征收與補(bǔ)償條例》,從立法上解決了一些問題,但是仍存在沒有明確對國有土地上房屋承租人的損失補(bǔ)償?shù)葐栴},以至于承租人及其相關(guān)人的切身利益得不到有效的保護(hù)。在司法實(shí)踐上如何保障拆遷中承租人合法權(quán)利是本文嘗試解決主要問題。 本文選擇此作為研究方向,使用評價方法,預(yù)測方法,,實(shí)證分析方法,綜合比較等方法,從“廈門市X工貿(mào)有限公司訴李C、金D租賃合同糾紛案”一案出發(fā),通過案中添附房屋是否合法、拆遷補(bǔ)償協(xié)議舉證責(zé)任、法院依申請調(diào)查取證是否必要、依會議紀(jì)要裁判是否合法、訴爭款項(xiàng)的性質(zhì)等五個爭議焦點(diǎn)進(jìn)行充分分析,對涉拆問題進(jìn)行探討并思考,以為拆遷時房屋承租人權(quán)利保護(hù)提出一些建議和看法。 最后,對本案處理意見進(jìn)行簡述并對現(xiàn)行拆遷征收法律制度提出建議。第一,立法上,我國應(yīng)對拆遷中補(bǔ)償項(xiàng)目法定化,同時明確承租人的訴訟地位;第二,司法上,法院在審理涉拆案件時合理分配舉證責(zé)任,同時應(yīng)重視調(diào)解的作用;第三,自我保障時,承租人在租賃房屋時應(yīng)盡到審慎注意義務(wù)。
[Abstract]:Housing is people's important life, production material. In recent years, the imbalance of housing resources has become more and more serious, housing leasing has become an effective way to solve this problem. And with the rapid development of urbanization, Housing demolition has become a hot issue in the society. The dispute over demolition of land is related to people's livelihood, involving a large number of people, and the legal relationship is complex. However, there is still imperfect legislation of compensation system in the process of urban house demolition in China. The simplification of the compensation method of demolition leads to a huge increase in the dispute of demolition and compensation, and the problem of demolition can cause huge social contradictions because of the poor handling of the problem. The demolition involves not only the interests of the owner of the house, but also the interests of the owner of the house. It also involves the interests of the lessee as the relative person of demolition. For a long time, our country has been using the "regulations on the Administration of Urban Housing demolition" in the process of urban house demolition for a long time. On January 19, 2011, the State Council promulgated and implemented a new "country". Regulations on expropriation and compensation of Housing on Land. Some problems have been solved by legislation. However, there are still problems such as the lack of explicit compensation for the loss of housing lessees on state-owned land, So that the vital interests of the lessee and its related persons can not be effectively protected. In judicial practice, how to protect the legal rights of the lessee is the main problem that this paper tries to solve. This article chooses this as the research direction, uses the appraisal method, the forecast method, the demonstration analysis method, the synthesis comparison and so on method, from Xiamen X industry and trade limited company v. Li C, Jin D lease contract dispute case, starts from the case, Whether the housing is legal or not, the burden of proof of the removal compensation agreement, whether it is necessary for the court to investigate and collect evidence according to the application, whether it is lawful to decide according to the minutes of the meeting, and the nature of the claim for money, are fully analyzed through the five focal points of the dispute. This paper probes into and ponders over the issue of demolition, and puts forward some suggestions and opinions for the protection of the right of the house lessee when the house is demolished. Finally, the author gives a brief account of the opinions of the case and puts forward some suggestions on the current legal system of demolition and expropriation. First, in legislation, China should legalize the compensation items in the demolition and clear the legal status of the lessee at the same time; second, in the judicial aspect, The court reasonably distributes the burden of proof in the trial of the case, and should attach importance to the role of mediation. Thirdly, the lessee should pay due attention to the duty of care when renting the house.
