【摘要】：習(xí)近平同志在2014年中央政法工作會議上提出要提高運用法治思維和法治方式的能力,堅持依法治國、依法執(zhí)政和行政,建設(shè)法治中國。 公安機關(guān)是國家的刑事司法力量和治安行政力量,擔(dān)負著維護國家安全和社會大局穩(wěn)定、保障人民安居樂業(yè)和促進社會公平正義的重要使命。在當(dāng)前我國社會經(jīng)濟飛速發(fā)展,各種社會矛盾集中顯現(xiàn),人民群眾法律意識和維權(quán)意識日益增強的大環(huán)境下,警察執(zhí)法能力水平的高低,不僅關(guān)乎警隊形象和政府公信力,更加關(guān)乎國家的政治大局穩(wěn)定和人民群眾的安危。 警察執(zhí)法能力,就是警察履行法定職責(zé)、依法行使權(quán)力所必需具備的職業(yè)能力。警察執(zhí)法能力養(yǎng)成方式主要通過教育培訓(xùn)—執(zhí)法實踐—教育培訓(xùn)這樣一個不斷循環(huán)的過程來實現(xiàn)。當(dāng)前,我國警察執(zhí)法能力不足與警察個人素養(yǎng)、在執(zhí)法中缺少法律思維和教育培訓(xùn)存在缺陷不無關(guān)系。提高警察執(zhí)法能力,立法上要提高入警條件,增加對警察的考核及培訓(xùn)內(nèi)容；其次要轉(zhuǎn)變執(zhí)法觀念,培養(yǎng)警察執(zhí)法應(yīng)當(dāng)具備的法律至上、保障人權(quán)、由程序正義實現(xiàn)實體正義以及法律優(yōu)于情理的法律思維；其三要提高教育培訓(xùn)質(zhì)量：明確培訓(xùn)目標(biāo),改進培訓(xùn)形式,完善培訓(xùn)考評機制。其四要建立有效的執(zhí)法監(jiān)督和激勵機制,在防止權(quán)力濫用,及時糾正執(zhí)法差錯的同時,也要增強民警對其職業(yè)的認同感,努力提升素質(zhì),增強履職能力。
[Abstract]:Comrade Xi Jinping proposed at the 2014 Central Committee meeting on political and legal work that we should improve our ability to use the thinking of the rule of law and the way of ruling by law, persist in governing the country according to law, govern and administer according to law, and build a country ruled by law. The public security organ is the national criminal judicial power and the public security administrative force, shoulders the maintenance national security and the social overall situation stability, guarantees the people to live and work in peace and contentment and promotes the social fair and just mission. All kinds of social contradictions are concentrated, and the level of law enforcement ability of the police is not only related to the image of the police force and the credibility of the government, but also to the increasing awareness of the people's legal consciousness and the awareness of protecting their rights. More related to the overall political stability of the country and the safety of the people. The ability of the police to enforce the law means that the police perform their statutory duties. The professional ability that must be possessed in exercising power according to law. The way to develop the law enforcement ability of the police is mainly realized through the continuous cycle process of education and training, law enforcement practice and education training. At present, The deficiency of police's law enforcement ability in our country is related to the police's personal accomplishment, the lack of legal thinking and the defect of education and training in law enforcement. To improve the police's law enforcement ability, the legislation should improve the condition of entering the police, and increase the examination and training content of the police. Secondly, it is necessary to change the concept of law enforcement, train the law supremacy that the police should have, protect human rights, realize substantive justice by procedural justice and the legal thinking that the law is superior to reason; third, improve the quality of education and training: make clear the training goal, Improve the training form and perfect the training appraisal mechanism. Fourthly, we should establish effective law enforcement supervision and incentive mechanisms, prevent abuse of power and correct mistakes in law enforcement in time, at the same time, we should also enhance the police's identity with their profession and strive to improve their quality. Enhance the ability to carry out one's duties.
