【摘要】：隨著中國國力的增強(qiáng),公民的社會意識也逐漸提高。加之文化交流和社會體育競技活動的增多以及頻發(fā)的自然災(zāi)害,推動我國志愿服務(wù)事業(yè)迅猛發(fā)展,社會上出現(xiàn)了大量的志愿者,包括注冊志愿者和非注冊志愿者,為社會做出了巨大的貢獻(xiàn)。與此同時(shí),志愿者活動也帶來了一些法律問題,其中非注冊志愿者引發(fā)的法律問題,已經(jīng)成為社會關(guān)注的熱點(diǎn)問題。首先,非注冊志愿者只在學(xué)術(shù)上有-個(gè)約定俗成的稱謂,并沒有一個(gè)明確的法律概念。其次,非注冊志愿者沒有明確的組織和規(guī)章制度對其統(tǒng)一指導(dǎo)和管理。再次,我國志愿者社會救助立法的滯后,使得非注冊志愿者在社會救助方面得不到應(yīng)有救助。這既不利于我國志愿事業(yè)的發(fā)展,也不利于我國作為一個(gè)國際大國在志愿服務(wù)層面的國際形象的塑造。因此,對于如何解決非注冊志愿者的社會救助問題,在學(xué)術(shù)界展開了激烈的討論并提出了許多切實(shí)的建議和解決措施,本文擬在總結(jié)以往研究成果的基礎(chǔ)上,對非注冊志愿者的社會救助在法律制度層面提出一些探索性的建議,本文主要從以下幾個(gè)方面進(jìn)行研究： 第一部分：非注冊志愿者社會救助法律制度基本理論概述。主要討論研究的背景、目的和意義。闡明非注冊志愿者社會救助的相關(guān)理論問題,對非注冊志愿者的基本問題進(jìn)行說明,以期得到整體上的認(rèn)識。 第二部分：非注冊志愿者社會救助法律制度存在的問題。社會救助屬于社會保障的一部分,是社會保障中最基礎(chǔ)最重要的一個(gè)方面。目前我國法律未將非注冊志愿者納入社會救助范圍,加之非注冊志愿者是由志愿者發(fā)展而來,屬于志愿者的范疇。因此本部分從當(dāng)前立法對志愿者社會救助方面著手研究,梳理我國立法中志愿者社會救助基本內(nèi)容,并找出立法中對非注冊志愿者社會救助存在的問題。 第三部分：借鑒國外和其他地區(qū)非注冊志愿者社會救助法律制度的經(jīng)驗(yàn)并得到啟示。力圖闡明其他國家和地區(qū)在解決非注冊志愿者社會救助問題的解決方式和可借鑒經(jīng)驗(yàn),以期對我國非注冊志愿者社會救助法律制度構(gòu)建提供借鑒和參照。 第四部分：我國建立非注冊志愿者社會救助法律制度的基本建議。提出構(gòu)建非注冊志愿者社會救助法律制度的建議方案。將非注冊志愿者納入注冊志愿者系統(tǒng)進(jìn)行統(tǒng)一管理和指導(dǎo),完善非注冊志愿者登記制度和途徑。同時(shí)解決非注冊志愿者社會救助資金籌集問題,在給予非注冊志愿者物資幫助的同時(shí)關(guān)注其心理救助。只有這樣才能使得非注冊志愿者的社會救助不僅在法律層面有法可依,而且在實(shí)際救助中具有切實(shí)可行的操作性。最后希望通過本文的研究建議,能為我國非注冊志愿者的社會救助獻(xiàn)出自己的綿薄之力,使我國志愿服務(wù)事業(yè)充滿生機(jī),蓬勃發(fā)展。
[Abstract]:With the increase of China's national strength, the citizens' social consciousness is also gradually raised. In addition, the increase in cultural exchanges, the increase in social sports competitive activities and the frequent natural disasters have promoted the rapid development of the cause of voluntary service in our country. A large number of volunteers, including registered volunteers and unregistered volunteers, have made great contributions to the society. At the same time, volunteer activities have also brought some legal problems, including legal problems caused by non-registered volunteers. Has become a hot issue of social concern. First, unregistered volunteers only have a formal term in the academic field, and there is no clear legal concept. Second, Unregistered volunteers have no clear organization and rules to guide and manage them. Thirdly, the legislation of volunteer social assistance in China lags behind. It is not conducive to the development of China's voluntary cause nor to the shaping of the international image of our country as an international power in the level of voluntary service. As to how to solve the problem of social assistance for unregistered volunteers, there is a heated discussion in academic circles and many practical suggestions and solutions are put forward. This paper intends to sum up the previous research results. Some exploratory suggestions on the social assistance of unregistered volunteers in the legal system are put forward in this paper, which are mainly studied from the following aspects:. The first part: an overview of the basic theory of the legal system of social assistance for unregistered volunteers. It mainly discusses the background, purpose and significance of the research, and clarifies the relevant theoretical issues of social assistance for unregistered volunteers. The basic problems of non-registered volunteers are explained in order to get a general understanding. Part II: problems in the legal system of social assistance for unregistered volunteers. Social assistance is a part of social security. It is one of the most basic and important aspects of social security. At present, the law of our country does not include unregistered volunteers in the scope of social assistance. In addition, unregistered volunteers are developed by volunteers. Therefore, this part starts with the research of the current legislation on social assistance to volunteers, combs the basic content of volunteer social assistance in our legislation, and finds out the problems existing in the legislation of social assistance to non-registered volunteers. The third part: draw lessons from the legal system of non-registered volunteers' social assistance in foreign countries and other regions, and try to clarify the solutions and experiences of other countries and regions in solving the social assistance problems of unregistered volunteers. In order to provide reference and reference to the construction of the legal system of non-registered volunteers' social assistance in our country. Part 4th: the basic suggestion of establishing the legal system of social assistance for unregistered volunteers in our country. The proposal of constructing the legal system of social assistance for non-registered volunteers is put forward. The non-registered volunteers are brought into the system of registered volunteers. Unified management and guidance, To improve the registration system and ways for unregistered volunteers. At the same time, to solve the problem of raising social assistance funds for unregistered volunteers, While giving material assistance to unregistered volunteers, we should pay attention to their psychological assistance. Only in this way can the social assistance of unregistered volunteers not only be provided with laws at the legal level. Finally, I hope that through the research suggestions of this paper, I can give my own contribution to the social assistance of non-registered volunteers in our country, so that the cause of voluntary service in our country is full of vitality and vigorous development.
