【摘要】：作為工商機(jī)關(guān)最為重要的執(zhí)法權(quán)力之一,工商行政自由裁量權(quán)事關(guān)行政相對(duì)人的切身利益。當(dāng)前,工商行政管理工作已經(jīng)滲入社會(huì)主義市場(chǎng)經(jīng)濟(jì)的每個(gè)角落。我國(guó)賦予了工商行政管理機(jī)關(guān)領(lǐng)域廣、范圍大的行政自由裁量權(quán)。被賦予如此大的行政權(quán)力,有利也有弊,關(guān)鍵是怎樣合理有效地加以控制,將權(quán)力關(guān)進(jìn)制度的籠子里。作為工商行政管理人員,本人結(jié)合長(zhǎng)沙工商行政處罰實(shí)踐,分析行政自由裁量權(quán)存在的必要性,指出當(dāng)前工商行政自由裁量權(quán)行使過程中畸輕重、濫處罰、縱枉法、徇私情等諸多問題,分析當(dāng)前國(guó)內(nèi)控制工商自由裁量權(quán)濫用的原則性規(guī)制模式、拆分檔級(jí)規(guī)制模式、公式定罰規(guī)制模式的利與弊,提出采用制度+科技的智能化規(guī)制模式控制工商行政自由裁量權(quán)的對(duì)策。
[Abstract]:As one of the most important law enforcement powers of industrial and commercial organs, the discretion of industrial and commercial administration concerns the vital interests of the administrative counterpart. The work of industrial and commercial administration has penetrated into every corner of the socialist market economy. Our country has given industrial and commercial administrative organs broad and extensive administrative discretion. Given such a large administrative power, there are both advantages and disadvantages. The key is how to control it reasonably and effectively and put the power in the cage of the system. As an administrator for industry and commerce, I analyze the necessity of the existence of administrative discretion by combining the practice of Changsha industrial and commercial administrative punishment. This paper points out many problems in the process of exercising the administrative discretion of industry and commerce, such as excessive punishment, perversion of the law, favoritism, etc., and analyzes the principle regulation mode of controlling the abuse of the industrial and commercial discretion in China, and splits the regulation mode of file level. Based on the advantages and disadvantages of the regulatory model of fixed penalty, the paper puts forward some countermeasures to control the discretionary power of industrial and commercial administration by adopting the intelligent regulation mode of system science and technology.
