【摘要】:近段時(shí)間來,幾個(gè)詞語一直出現(xiàn)在大街小巷:霧霾天氣、黃浦江死豬事件。霧霾的出現(xiàn),一度使得口罩及空氣凈化器成為炙手可熱的暢銷品。霧霾問題出現(xiàn)不久,,2013年3月份,黃浦江開始出現(xiàn)大量死豬,有時(shí)一天甚至能出現(xiàn)好幾千頭,網(wǎng)友開始調(diào)侃推開窗戶是仙境,免費(fèi)喝著排骨湯。從霧霾天氣到水體污染事件,一系列的環(huán)境污染事件映入我們的眼簾。作為社會(huì)主人翁的社會(huì)大眾面對(duì)這些問題,束手無策;想要詳細(xì)的數(shù)據(jù)資料,所求無門。隨著生活質(zhì)量和知識(shí)水平的提高,大眾對(duì)環(huán)境問題的關(guān)注日益密切,對(duì)環(huán)境知情權(quán)的必要性突顯,賦予公眾環(huán)境知情權(quán)成為大勢(shì)所趨。 環(huán)境權(quán)的一項(xiàng)重要內(nèi)容即為環(huán)境知情權(quán)。因此,公眾的環(huán)境知情權(quán)立法保護(hù),必須從我國的基本國情出發(fā),切實(shí)充分披露環(huán)境信息,使得我國的環(huán)境信息公開制度全面、透明。公眾在積極參與環(huán)境保護(hù)的同時(shí),能夠享受到權(quán)利受到侵害時(shí)的救濟(jì)保障,這將極大提高公眾參與的積極性,為積極監(jiān)督環(huán)境義務(wù)主體的履行義務(wù)活動(dòng)產(chǎn)生積極作用。公眾環(huán)境知情權(quán)的充分行使將有助于實(shí)現(xiàn)環(huán)境保護(hù)和環(huán)境權(quán)的最終目標(biāo)! 本文從環(huán)境知情權(quán)的基本理論出發(fā),根據(jù)提出問題-分析問題-解決問題的思路,對(duì)當(dāng)前國內(nèi)外環(huán)境知情權(quán)法律保護(hù)層面的制度進(jìn)行研究和分析。本文由四個(gè)部分組成,第一部分從環(huán)境知情權(quán)的概念、法律關(guān)系等基本理論著手,了解環(huán)境知情權(quán)的涵義、法律價(jià)值以及它的法律關(guān)系,對(duì)環(huán)境知情權(quán)的理論有初步的了解;第二部分通過國外的環(huán)境知情權(quán)立法的成功經(jīng)驗(yàn),對(duì)我國的環(huán)境知情權(quán)保護(hù)立法提供有利借鑒,通過對(duì)比分析找出我國國家立法的不足;第三部分介紹我國關(guān)于環(huán)境知情權(quán)的保護(hù)現(xiàn)狀,詳細(xì)論述我國的環(huán)境知情權(quán)法律保護(hù)存在的問題;最后一部分是本文的關(guān)鍵部分,針對(duì)環(huán)境知情權(quán)在我國出現(xiàn)的問題提出了五項(xiàng)完善對(duì)策:以立法為導(dǎo)向,推動(dòng)國家立法、擴(kuò)大環(huán)境知情權(quán)的權(quán)利義務(wù)主體范圍、建立健全企業(yè)、產(chǎn)品環(huán)境信息公開制度、健全環(huán)境公眾參與機(jī)制、健全環(huán)境知情權(quán)的法律責(zé)任及救濟(jì)機(jī)制。
[Abstract]:In recent times, several words have been appearing on the streets: haze weather, the Huangpu River pig death incident. The appearance of haze once made masks and air purifiers a hot bestseller. Soon after the haze problem, in March 2013, The Huangpu River began to see a large number of dead pigs, and sometimes thousands of pigs a day. Netizens began to joke that opening the window was fairyland and drinking free chops soup. From haze weather to water pollution incidents, A series of environmental pollution events have come into our eyes. The public, as the masters of society, are unable to cope with these problems. They want detailed data and information. With the improvement of the quality of life and the level of knowledge, The public pays more and more attention to the environmental problem, the necessity of the right to know the environment is highlighted, and giving the public the right to know the environment becomes the trend of the times. One of the important contents of the environmental right is the right to know the environment. Therefore, the legislative protection of the public's right to know about the environment must proceed from the basic conditions of our country, and disclose the environmental information fully, so as to make the system of environmental information public in our country comprehensive. Transparency. The active participation of the public in the protection of the environment while enjoying the protection of remedies in the event of a violation of their rights will greatly increase public participation, The full exercise of the public's right to know about the environment will help to realize the ultimate goal of environmental protection and environmental rights. Based on the basic theory of the right to know, this paper studies and analyzes the legal protection system of the right to know at home and abroad according to the ideas of putting forward the problem, analyzing the problem and solving the problem. This paper is composed of four parts. The first part starts with the concept of the right to know the environment, legal relation and other basic theories, understand the meaning, legal value and its legal relationship of the right to know about the environment, and have a preliminary understanding of the theory of the right to know about the environment. The second part through the foreign successful experience of the right to know the right to know the right to environmental protection legislation in China to provide beneficial reference through comparative analysis to find out the shortcomings of our national legislation; The third part introduces the current situation of the protection of the right to know about the environment in our country, and discusses in detail the problems existing in the legal protection of the right to know of the environment in our country; the last part is the key part of this paper. In view of the problems of the environmental right to know in our country, this paper puts forward five perfect countermeasures: take the legislation as the direction, promote the national legislation, expand the scope of the rights and obligations of the environmental right to know, establish and perfect the system of enterprises and environmental information disclosure of products. Improve the environmental public participation mechanism, improve the environmental right to know the legal responsibility and relief mechanism.
