【摘要】: 2007年3月審議通過(guò)的《中華人民共和國(guó)物權(quán)法》第21條對(duì)不動(dòng)產(chǎn)登記錯(cuò)誤的賠償作出原則性規(guī)定,與此相關(guān)的問(wèn)題卻沒有明確,使不動(dòng)產(chǎn)登記機(jī)構(gòu)賠償責(zé)任問(wèn)題成為當(dāng)前學(xué)術(shù)界和實(shí)務(wù)界研究的熱點(diǎn)。筆者在本文中,聯(lián)系我國(guó)的物權(quán)法律制度現(xiàn)狀,對(duì)不動(dòng)產(chǎn)登記機(jī)構(gòu)賠償責(zé)任問(wèn)題進(jìn)行粗淺的探討。全文分為五章,內(nèi)容概要如下: 第一章論述不動(dòng)產(chǎn)登記法律制度基本理論。明確應(yīng)將不動(dòng)產(chǎn)登記機(jī)構(gòu)定性為行政機(jī)構(gòu),確認(rèn)不動(dòng)產(chǎn)登記行為是一種依申請(qǐng)的具體行政行為,是一種行政確認(rèn)行為。 第二章從研究不動(dòng)產(chǎn)登記機(jī)構(gòu)賠償責(zé)任的法理和現(xiàn)實(shí)依據(jù)出發(fā),對(duì)不動(dòng)產(chǎn)登記錯(cuò)誤進(jìn)行分類,明確登記錯(cuò)誤給他人造成損害時(shí)登記機(jī)構(gòu)應(yīng)當(dāng)承擔(dān)賠償責(zé)任,認(rèn)為其賠償責(zé)任的性質(zhì)為國(guó)家賠償責(zé)任。 第三章主要闡述登記機(jī)構(gòu)賠償責(zé)任的構(gòu)成要件,重點(diǎn)研究了賠償責(zé)任的歸責(zé)原則,認(rèn)為《物權(quán)法》第12條確立的是以形式審查為主、實(shí)質(zhì)審查為輔的審查形式,對(duì)登記機(jī)構(gòu)損害賠償責(zé)任應(yīng)采用過(guò)錯(cuò)責(zé)任的歸責(zé)原則,在舉證責(zé)任分配上應(yīng)采取過(guò)錯(cuò)推定的方式。 第四章主要研究在登記錯(cuò)誤發(fā)生后,登記機(jī)構(gòu)應(yīng)如何承擔(dān)責(zé)任。本文認(rèn)為,在共同侵權(quán)時(shí),登記機(jī)構(gòu)與其他侵權(quán)人應(yīng)承擔(dān)連帶責(zé)任;在混合侵權(quán)的情況下,登記機(jī)構(gòu)應(yīng)按過(guò)錯(cuò)大小承擔(dān)按份責(zé)任。另外,明確對(duì)損害賠償?shù)姆秶鷳?yīng)限定在直接經(jīng)濟(jì)損失上。 第五章主要闡述了登記機(jī)構(gòu)應(yīng)對(duì)賠償責(zé)任的幾種措施。提出了登記機(jī)構(gòu)預(yù)防登記錯(cuò)誤的三個(gè)設(shè)想,即設(shè)立不動(dòng)產(chǎn)登記官制度、發(fā)揮不動(dòng)產(chǎn)登記代理人作用及自行選擇采用公證前置程序。同時(shí),建議登記機(jī)構(gòu)采取追償、設(shè)立不動(dòng)產(chǎn)賠償專項(xiàng)基金及職業(yè)責(zé)任保險(xiǎn)三條途徑減輕賠償責(zé)任。
[Abstract]:Article 21 of the Law of the people's Republic of China on Real Rights, which was deliberated and adopted in March 2007, provides in principle for compensation for errors in the registration of immovable property, but the related issues are not clear. The problem of compensation liability of real estate registration institutions has become a hot topic in the academic and practical circles. In this paper, the author relates to the current situation of the legal system of real right in our country. The thesis is divided into five chapters, and the content is summarized as follows:. The first chapter deals with the basic theory of the legal system of real estate registration. It is clear that the real estate registration institution should be characterized as an administrative body, and the act of confirming the registration of real estate is a specific administrative act according to the application, and is an administrative confirmation act. The second chapter starts from studying the legal theory and realistic basis of the compensation liability of the real estate registration institution, classifies the registration error of the real estate, and makes it clear that the registration institution shall bear the liability of compensation when the registration error causes damage to others. The nature of its liability is considered to be the liability of the State. The third chapter mainly expounds the constitutive elements of the liability of the registration institution, and focuses on the principle of liability imputation. The article 12 of the Real right Law establishes a form of examination which is mainly based on formal review and supplemented by substantive review. The principle of fault liability should be applied to the liability for damages of the registration institution, and the way of fault presumption should be adopted in the distribution of the burden of proof. Chapter 4th mainly studies how the registration institution should bear the responsibility after the registration error occurs. This article holds that in the joint infringement, the registration institution and other infringers should bear joint liability; in the case of mixed infringement, In addition, the scope of compensation for damages should be limited to direct economic losses. Chapter 5th mainly expounds several kinds of measures for the registration institution to deal with the liability of compensation, and puts forward three ideas for the registration institution to prevent the registration errors, that is, the establishment of the real estate registrar system. At the same time, it is suggested that the registration institution should take recourse, set up real estate compensation special fund and occupational liability insurance to reduce liability.
