【摘要】:行政許可信息公開(kāi)是有關(guān)行政許可活動(dòng)的設(shè)定、實(shí)施以及監(jiān)管信息的對(duì)外公布行為。信息公開(kāi)有助于普通民眾對(duì)掌握有大量行政審批事項(xiàng)的行政機(jī)關(guān)進(jìn)行有效的監(jiān)督,避免“暗箱操作”、“權(quán)錢(qián)交易”的出現(xiàn),進(jìn)而鏟除腐敗的溫床。另一方面,服務(wù)型政府、法治政府的構(gòu)建也需要打造一個(gè)公開(kāi)透明的政務(wù)環(huán)境,其與行政許可信息公開(kāi)有著內(nèi)在的價(jià)值契合性。行政許可的設(shè)定應(yīng)予公開(kāi),許可申請(qǐng)條件、依據(jù)、數(shù)量、程序、期限、實(shí)施結(jié)果以及監(jiān)督檢查信息亦應(yīng)進(jìn)行公開(kāi)。無(wú)論是依職權(quán)還是依中請(qǐng)公開(kāi),民眾知曉許可信息是行政許可在法治框架內(nèi)正常有序開(kāi)展的關(guān)鍵一步。為規(guī)范許可信息的公開(kāi)流程以及保障公民信息知情權(quán),《行政許可法》、《政府信息公開(kāi)條例》相繼出臺(tái),政務(wù)公開(kāi)得到前所未有的重視。但同時(shí)囿于立法技術(shù)上的缺陷,上述有關(guān)信息公開(kāi)的立法規(guī)范尚存在諸多不足:行政許可過(guò)程性信息界定不清,監(jiān)督檢查信息公開(kāi)力度不足以及信息公開(kāi)的監(jiān)督與救濟(jì)機(jī)制不健全等問(wèn)題的存在都嚴(yán)重制約著許可信息公開(kāi)實(shí)效。本文以行政許可信息公開(kāi)為切入點(diǎn),在對(duì)國(guó)內(nèi)學(xué)者現(xiàn)有理論成果文獻(xiàn)資料進(jìn)行收集整合基礎(chǔ)之上,對(duì)比國(guó)外立法與實(shí)踐經(jīng)驗(yàn),將行政許可信息在廣義的角度下界定為有關(guān)行政許可的設(shè)定、實(shí)施與監(jiān)管信息;突破以往單純依照《政府信息公開(kāi)條例》第2條將其僅僅限定為在行政機(jī)關(guān)履職過(guò)程中制作或者獲取的,并以一定形式保存、記錄之信息的傳統(tǒng)認(rèn)知。鑒于信息公開(kāi)實(shí)踐在該領(lǐng)域所暴露出的問(wèn)題,首先從行政許可審批過(guò)程入手,將該過(guò)程之中伴隨產(chǎn)生的相關(guān)行政信息嚴(yán)格區(qū)分為過(guò)程性與事實(shí)性信息,并區(qū)別對(duì)待,衡量是否予以公開(kāi)。在此基礎(chǔ)上,提出通過(guò)立法途徑對(duì)行政機(jī)關(guān)信息自由裁量權(quán)進(jìn)行限制的可行性建議。其次,為增強(qiáng)行政許可監(jiān)管信息的公開(kāi)力度與深度,著力對(duì)其進(jìn)行在公開(kāi)及時(shí)和有效性方向的規(guī)范構(gòu)建,輔之以許可持有人強(qiáng)制信息披露機(jī)制的探索。同時(shí),以擴(kuò)大聽(tīng)證適用范圍、擴(kuò)寬聽(tīng)證形式為主要路徑對(duì)行政許可聽(tīng)證制度進(jìn)行完善,突出其在許可信息公開(kāi)工作中的積極作用。最后,正所謂“無(wú)救濟(jì)就無(wú)權(quán)利”,加強(qiáng)對(duì)行政許可信息公開(kāi)的多方監(jiān)督和司法救濟(jì)力度對(duì)上述改進(jìn)措施的到位落實(shí)意義重大。
[Abstract]:The disclosure of administrative license information is the act of setting up, implementing and supervising administrative licensing activities. The disclosure of information helps the ordinary people to effectively supervise the administrative organs that have a large number of administrative examination and approval items. To avoid the emergence of "black box operation" and "power and money trading", and then to eradicate the hotbed of corruption. On the other hand, the construction of service-oriented government and rule of law government also needs to create an open and transparent government environment. The establishment of the administrative license shall be made public, the conditions, the basis, the quantity, the procedure and the time limit of the application for the license shall be made public. The results of the implementation as well as the information on supervision and inspection should also be made public. Whether ex officio or in accordance with China, Public awareness of licensing information is a key step in the normal and orderly development of administrative licensing within the framework of the rule of law. In order to standardize the open process of licensing information and to protect citizens' right to know about it, the Administrative Licensing Law and the regulations on the publicity of Government Information have been promulgated one after another. However, due to the defects of the legislative technology, the above legislative norms of information disclosure still have many shortcomings: the definition of the process information of administrative license is not clear, The lack of supervision and inspection information disclosure and the unsound supervision and remedy mechanism of the information disclosure seriously restrict the effectiveness of the license information disclosure. This paper takes the administrative license information disclosure as the starting point. On the basis of collecting and integrating the literature of domestic scholars' existing theoretical achievements, compared with foreign legislation and practical experience, the administrative license information is defined as the information about the establishment, implementation and supervision of administrative license in a broad sense. Breakthrough in the past, simply according to section 2 of the "regulations on the publicity of Government Information", which was limited to production or acquisition in the course of carrying out the duties of an administrative organ, and preserved in a certain form, The traditional cognition of recorded information. In view of the problems exposed in the practice of information disclosure in this field, first of all, starting with the process of examination and approval of administrative licensing, the relevant administrative information produced in the process is strictly divided into procedural and factual information. On the basis of this, the author puts forward some feasible suggestions to limit the discretion of information of administrative organs through legislative channels. Secondly, in order to enhance the openness and depth of administrative license supervision information, Focusing on its normative construction in the direction of openness, timeliness and effectiveness, supplemented by a probe into the compulsory disclosure mechanism of information by licensees. At the same time, in order to expand the scope of application of the hearing, Broadening the hearing form is the main way to perfect the administrative license hearing system and highlight its positive role in the work of license information disclosure. As the so-called "no remedy means no right", it is of great significance to strengthen the multi-party supervision and judicial relief for the administrative license information publicity.
