【摘要】：美國個人信息保護(hù)的行業(yè)自律機(jī)制是在政府引導(dǎo)下形成的。日本在積極推進(jìn)行業(yè)自律機(jī)制建設(shè)的基礎(chǔ)上基于人格利益的保護(hù)建立了個人信息保護(hù)法律體系。我國《憲法》并沒有將個人隱私權(quán)規(guī)定為一種獨立的人權(quán)加以保護(hù),而且《個人信息保護(hù)法》立法進(jìn)程至今尚不明朗。為此,應(yīng)積極鼓勵引導(dǎo)行業(yè)自律,以充分發(fā)揮民間對個人信息的保護(hù)作用,并積極推動政府統(tǒng)一立法。唯如此,公民的個人信息才能得到有效保護(hù)。
[Abstract]:The self-discipline mechanism of American personal information protection is formed under the guidance of the government. Japan has established the legal system of personal information protection based on the protection of personal interests on the basis of actively promoting the construction of industry self-discipline mechanism. The Constitution does not provide for the protection of the right to privacy as an independent human right, Moreover, the legislative process of the personal Information Protection Law is still unclear. To this end, we should actively encourage and guide industry self-discipline, so as to give full play to the role of the people in protecting personal information, and actively promote the unification of government legislation. The personal information of citizens can be effectively protected.
