【摘要】：農(nóng)地三權(quán)分置改革政策的核心是,設(shè)置從土地承包經(jīng)營權(quán)中分離出來的土地經(jīng)營權(quán),如此制定政策的初衷和動(dòng)因需要進(jìn)行全面的廓清。土地經(jīng)營權(quán)所負(fù)載的目標(biāo)功能大致可以概括為穩(wěn)定土地承包經(jīng)營權(quán)流轉(zhuǎn)中受讓人的經(jīng)營預(yù)期,滿足其為擴(kuò)大生產(chǎn)經(jīng)營而進(jìn)行抵押融資的需求,同時(shí)保障原土地承包經(jīng)營權(quán)人對(duì)土地承包經(jīng)營權(quán)的保有權(quán)、控制權(quán)和收益權(quán)三重目的。以土地經(jīng)營權(quán)為出發(fā)點(diǎn)和落腳點(diǎn)的農(nóng)地三權(quán)分置改革方案需要通過三重門:一是價(jià)值取向之門;二是體系化之門;三是實(shí)踐之門。仔細(xì)檢驗(yàn)發(fā)現(xiàn),如此制度設(shè)計(jì)無法順利通過上述三重門。面對(duì)農(nóng)地三權(quán)分置已經(jīng)成為既定改革方向和政策方案的現(xiàn)實(shí),理論界需要秉持務(wù)實(shí)態(tài)度,在遵循法理和邏輯的前提下創(chuàng)新理論、更新話語、革新規(guī)則,借民法典編纂之機(jī)整合現(xiàn)行土地承包經(jīng)營權(quán)制度,完善農(nóng)村家庭承包經(jīng)營體制,為農(nóng)業(yè)現(xiàn)代化奠定制度基礎(chǔ),提供法制保障。
[Abstract]:The core of the reform policy is to set up the land management right which is separated from the land contract management right. The objective function of the land management right can be summarized as the operation expectation of the transferee in stabilizing the transfer of the land contract management right. To meet their demand for mortgage financing in order to expand production and operation, and at the same time to ensure the tenure of the original land contractual management right, The reform plan of the land management right as the starting point and the foothold need to pass through the triple door: one is the door of value orientation; the other is the door of systematization; the third is the door of practice. In the face of the fact that the division of farmland rights has become the reality of the established reform direction and policy plan, the theorists need to maintain a pragmatic attitude and innovate the theory under the premise of following the legal theory and logic. We should renew the discourse, innovate the rules, integrate the current system of land contracting and management, perfect the rural household contract management system, lay the system foundation for the agricultural modernization and provide the legal guarantee for the modernization of agriculture.
