【摘要】:《中華人民共和國道路交通安全法》實(shí)施以來,雖規(guī)定了交通事故搶救費(fèi)用墊付、無責(zé)賠付等人性化條款,但由于機(jī)動(dòng)車所有人與實(shí)際的運(yùn)行控制、運(yùn)行收益分離以及道路交通事故損害賠償?shù)姆峙錁?biāo)準(zhǔn)存在爭議,使具體實(shí)施過程中困難重重。 本文以真實(shí)案例為基礎(chǔ),從適用現(xiàn)有法律解決現(xiàn)有問題為主線,對案件處理過程中存在的如何準(zhǔn)確認(rèn)定多車相撞交通事故損害賠償?shù)呢?zé)任主體、如何最大限度地使機(jī)動(dòng)車交通事故造成的損失在責(zé)任主體之間乃至全社會(huì)得以合理分擔(dān)以及程序問題進(jìn)行分析,通過探尋《道路交通安全法》《機(jī)動(dòng)車交通強(qiáng)制責(zé)任保險(xiǎn)條例》的立法背景及目的,并結(jié)合《侵權(quán)責(zé)任法》的精神正確適用《道路交通安全法》第76條,并歸納出一套解決多車相撞交通事故現(xiàn)存問題的科學(xué)的法律適用理論及方法,以解決交通事故中的責(zé)任分擔(dān),以期達(dá)到對事故涉及的各方法律主體利益的均衡,給司法審判實(shí)務(wù)以借鑒。首先,關(guān)于多車相撞交通事故責(zé)任主體確定的問題。第一,保險(xiǎn)公司“無責(zé)賠付”的適用問題,從交強(qiáng)險(xiǎn)的功能定位以及利害相關(guān)人的影響分析論述“無責(zé)賠付”之必要;第二責(zé)任主體認(rèn)定問題,通過原因分析與法律分析找到解決問題的根源,并提出相應(yīng)的解決方案。其次,多車相撞交通事故損害賠償?shù)姆峙鋯栴}。對于分配比例問題,通過正確認(rèn)識(shí)事故責(zé)任與賠償責(zé)任的關(guān)系,去偽存真,,正確認(rèn)識(shí)問題,提出解決問題方法;對于多方受害人交強(qiáng)險(xiǎn)范圍內(nèi)受償權(quán)的保障,從法律規(guī)定與司法實(shí)踐存在差距入手,在現(xiàn)有法律基礎(chǔ)上,尋求司法實(shí)踐中縮小差距有效途徑。最后,多車相撞交通事故損害賠償?shù)某绦騿栴}。無責(zé)機(jī)動(dòng)車一方是否列為或追加為共同被告或第三人參加訴訟。從被告當(dāng)事人適格的判定入手,尋求保護(hù)無責(zé)機(jī)動(dòng)車一方訴訟權(quán)利及節(jié)約其成本的解決方案。
[Abstract]:Since the implementation of the Road Traffic Safety Law of the people's Republic of China, although it has stipulated humanized clauses such as advance payment of rescue expenses for traffic accidents, no liability compensation, but due to the owners of motor vehicles and the actual operation control, The separation of operating income and the allocation standard of compensation for road traffic accidents are controversial, which makes the concrete implementation difficult. On the basis of real cases, from the application of the existing law to solve the existing problems as the main line, how to accurately determine how to accurately identify the main body of liability for damage compensation in the multi-vehicle collision traffic accident in the course of handling the case. How to maximize the loss caused by motor vehicle traffic accidents between the main body of responsibility and even the whole society can be reasonably shared, as well as the analysis of the procedures, By exploring the legislative background and purpose of the regulations on compulsory liability Insurance for Motor vehicles in the Road Traffic Safety Law, and combining the spirit of the Tort liability Law, the article 76 of the Road Traffic Safety Law is applied correctly. A set of scientific applicable theories and methods to solve the existing problems of multi-vehicle collision traffic accidents are summarized in order to solve the burden sharing in traffic accidents, in order to achieve the balance of the interests of the parties involved in the accidents. First of all, about the problem of determining the subject responsible for multi-vehicle collision traffic accident. First, the application of "non-liability indemnity" in insurance company. This paper discusses the necessity of "non-liability compensation" from the function orientation of traffic insurance and the influence of stakeholders, and finds out the root cause of the problem through cause analysis and legal analysis. And put forward the corresponding solution. Secondly, the distribution problem of compensation for damage caused by multi-vehicle collision traffic accident. For the problem of allocation ratio, through correctly understanding the relationship between accident liability and liability for compensation, we can distinguish false things, preserve the real things, and correctly understand the problem. Put forward the solution to the problem; for the protection of the right to compensation within the scope of multiple victims' traffic insurance, start with the gap between the legal provisions and judicial practice, and seek an effective way to narrow the gap in the judicial practice on the basis of the existing laws. The procedural problem of compensation for damage caused by a multi-vehicle collision traffic accident. Is the party not liable for the motor vehicle listed or added to the action for the co-defendant or the third party. To seek solutions to protect the litigant rights of non-liable motor vehicle and save its cost.
