【摘要】：2015年《立法法》修正后,設(shè)區(qū)的市被正式賦予地方性法規(guī)立法權(quán),近兩年以來(lái),全國(guó)各省紛紛出臺(tái)地方性立法條例,進(jìn)一步明確設(shè)區(qū)的市地方立法程序和權(quán)限范圍,設(shè)區(qū)的市人大逐步開(kāi)始了地方性法規(guī)的立法實(shí)踐。地方立法是協(xié)調(diào)促進(jìn)地方經(jīng)濟(jì)發(fā)展、解決區(qū)域矛盾、彌補(bǔ)中央立法不足的必要路徑。數(shù)十年來(lái)較大的市在立法實(shí)踐中出現(xiàn)的問(wèn)題不容忽視,不僅表現(xiàn)在法規(guī)的實(shí)施效果上,還直接影響了地區(qū)發(fā)展,甚至影響了國(guó)家法治社會(huì)的建設(shè)。地方人大作為設(shè)區(qū)的市地方立法主體,在主導(dǎo)立法、監(jiān)督立法、協(xié)調(diào)立法過(guò)程中發(fā)揮著重要職能,是保證法規(guī)質(zhì)量的重要主體。設(shè)區(qū)的市人大的立法職能是否正常發(fā)揮,直接關(guān)系著地方性法規(guī)的質(zhì)量、區(qū)域內(nèi)公民的切身利益、社會(huì)經(jīng)濟(jì)和文化的發(fā)展、以及國(guó)家法制的統(tǒng)一。本文聚焦當(dāng)前設(shè)區(qū)的市人大立法權(quán),分析設(shè)區(qū)的市人大的立法職能,并根據(jù)較大的市人大的立法職能發(fā)揮現(xiàn)狀,提出強(qiáng)化設(shè)區(qū)的市人大立法職能的工作舉措,為我國(guó)設(shè)區(qū)的市人大立法工作的開(kāi)展提供參考。本文共分為五部分。第一部分為緒論,對(duì)本文的選題背景、研究方法、內(nèi)容等進(jìn)行了介紹,并對(duì)當(dāng)前設(shè)區(qū)的市人大職能的研究現(xiàn)狀進(jìn)行了歸納整理。第二部分對(duì)設(shè)區(qū)的市人大立法的基本理論進(jìn)行了詳細(xì)闡述,對(duì)其基本概念和包括的理論知識(shí)進(jìn)行了介紹。第三部分結(jié)合地方立法程序,具體分析設(shè)區(qū)的市人大的立法職能概念和具體內(nèi)容。第四部分總結(jié)較大的市的立法經(jīng)驗(yàn),分析其地方人大立法職能的發(fā)揮現(xiàn)狀。第五部分是針對(duì)前文立法職能發(fā)揮不足,提出了機(jī)制完善的建議,以供設(shè)區(qū)的市人大立法工作參考。
[Abstract]:In 2015, after the Legislative Law was amended, the municipalities divided into districts were formally vested with the legislative power of local laws and regulations. In the past two years, the provinces of the whole country have introduced local legislative regulations one after another to further clarify the local legislative procedures and the scope of jurisdiction of the municipalities that are divided into districts. The district people's congresses have gradually begun the legislative practice of local laws and regulations. Local legislation is to coordinate and promote local economic development and resolve regional contradictions. The necessary path to make up for the lack of central legislation. The problems that have arisen in the legislative practice of larger cities over the past decades cannot be ignored, not only in terms of the effect of the implementation of the laws and regulations, but also directly affecting the development of the region. The local people's Congress, as the main body of the municipal local legislation, plays an important role in leading legislation, supervising legislation and coordinating legislation. It is an important subject to ensure the quality of laws and regulations. Whether or not the legislative functions of the municipal people's congresses in districts are properly brought into play are directly related to the quality of local laws and regulations, the vital interests of citizens in the region, and the development of social economy and culture. And the unification of the national legal system. This paper focuses on the legislative power of the municipal people's congresses that are currently divided into districts, analyzes the legislative functions of the municipal people's congresses divided into districts, and exerts the present situation according to the legislative functions of the larger municipal people's congresses. This paper is divided into five parts. The first part is the introduction. The content is introduced, and the current research status of the functions of the municipal people's Congress is summarized and arranged. The second part expounds the basic theory of the legislation of the district people's Congress in detail. The third part, combined with the local legislative procedure, analyzes the concept and content of the legislative function of the district people's Congress. Part 4th summarizes the legislative experience of the larger cities. The article analyzes the present situation of the legislative functions of the local people's congresses. The 5th part is aimed at the deficiency of the legislative functions of the local people's congresses, and puts forward some suggestions on how to perfect the mechanism for the legislative work of the municipal people's congresses which are divided into districts.
