【摘要】：種子是農(nóng)業(yè)生產(chǎn)必備的生產(chǎn)資料,特別是在經(jīng)濟(jì)全球化進(jìn)程步伐加快,各國日益將搶占國際種子市場上優(yōu)勢地位作為新一輪國際競爭制高點(diǎn)的形勢下,必須引起高度重視。本研究選取我國農(nóng)業(yè)種子產(chǎn)業(yè)政策法律問題為切入點(diǎn),對其進(jìn)行體系構(gòu)建以此規(guī)范種子產(chǎn)業(yè)發(fā)展,試圖為有關(guān)部門制定種子產(chǎn)業(yè)發(fā)展政策提供參考性建議,推動種子產(chǎn)業(yè)走向現(xiàn)代化、國際化。 本研究主體內(nèi)容主要涉及五個部分：一是基礎(chǔ)理論研究。基于國內(nèi)外研究,對我國農(nóng)業(yè)種子產(chǎn)業(yè)政策法律問題的基本理論進(jìn)行剖析,如“產(chǎn)業(yè)政策與產(chǎn)業(yè)政策法”、產(chǎn)業(yè)政策的“影響因素、價值功能”,再利用法學(xué)、經(jīng)濟(jì)法學(xué)的基礎(chǔ)理論,從市場規(guī)制理論、宏觀調(diào)控理論、利益與利益機(jī)制理論、可持續(xù)發(fā)展理論、公共品理論、產(chǎn)業(yè)安全理論、市場失靈與政府失靈理論入手進(jìn)行剖析。二是農(nóng)業(yè)種子產(chǎn)業(yè)政策法律問題的現(xiàn)狀考量。對我國東部、中部、西部等典型地區(qū)的農(nóng)業(yè)種子產(chǎn)業(yè)發(fā)展展開調(diào)研,剖析我國農(nóng)業(yè)種子產(chǎn)業(yè)發(fā)展現(xiàn)狀,梳理國內(nèi)現(xiàn)有種子產(chǎn)業(yè)法律法規(guī)、規(guī)范性文件等,挖掘種子產(chǎn)業(yè)政策存在主要法律問題,從利益協(xié)調(diào)性、主體局限性、區(qū)域配置性、監(jiān)督環(huán)節(jié)、制度保障等因素著手分析原因。三是國外借鑒分析部分。選取國外農(nóng)業(yè)種子產(chǎn)業(yè)政策發(fā)展較好的國家,如美國、法國、波蘭、印度進(jìn)行介紹,借鑒有利經(jīng)驗(yàn)為我國種業(yè)可持續(xù)健康發(fā)展提供參考。四是我國農(nóng)業(yè)種子產(chǎn)業(yè)政策制定與完善部分。以突出重點(diǎn)、協(xié)調(diào)發(fā)展、企業(yè)主體、公平競爭等為基本原則,探索我國農(nóng)業(yè)種子產(chǎn)業(yè)政策的基本架構(gòu),在草擬《農(nóng)作物種子產(chǎn)業(yè)發(fā)展政策》草案基礎(chǔ)上,針對產(chǎn)業(yè)政策的關(guān)鍵內(nèi)容種質(zhì)資源管理,草擬《種質(zhì)資源管理辦法實(shí)施細(xì)則》。五是法律運(yùn)行保障部分。為我國農(nóng)業(yè)種子產(chǎn)業(yè)政策發(fā)展提供政策與法律支持,并完善農(nóng)業(yè)種子產(chǎn)業(yè)政策主體法律制度、科技創(chuàng)新制度、市場準(zhǔn)入制度、監(jiān)督管理制度、風(fēng)險防控等制度,建立一系列保障其良好運(yùn)行的機(jī)制及激勵機(jī)制,保障我國農(nóng)業(yè)種子產(chǎn)業(yè)發(fā)展政策能夠有效實(shí)施。 全面且具體化對種子產(chǎn)業(yè)發(fā)展政策、法律、法規(guī)進(jìn)行詳細(xì)梳理與構(gòu)建。根據(jù)種子產(chǎn)業(yè)政策所涉及的主要內(nèi)容、產(chǎn)業(yè)鏈維度、產(chǎn)業(yè)政策維度構(gòu)建三維立體空間,對農(nóng)業(yè)種子產(chǎn)業(yè)政策結(jié)構(gòu)進(jìn)行架構(gòu)；根據(jù)架構(gòu)體系框架,草擬我國農(nóng)業(yè)種子產(chǎn)業(yè)發(fā)展政策；針對整個種子產(chǎn)業(yè)發(fā)展的內(nèi)容,考慮種質(zhì)資源保護(hù)是其中重要部分,草擬我國農(nóng)作物種質(zhì)資源管理辦法實(shí)施細(xì)則。 總之,本研究期望能通過對種子產(chǎn)業(yè)政策的構(gòu)建以及其法律保障的系統(tǒng)化分析,探討當(dāng)前農(nóng)業(yè)種子產(chǎn)業(yè)應(yīng)該如何規(guī)范,種子產(chǎn)業(yè)政策體系如何架構(gòu)；力度通過論證引起有關(guān)部門對我國種子產(chǎn)業(yè)發(fā)展政策的制定、種質(zhì)資源保護(hù)的重視,為農(nóng)業(yè)種子可持續(xù)健康發(fā)展提供引導(dǎo)和規(guī)范；為有關(guān)部門提供制定種子產(chǎn)業(yè)政策提供框架思路。同時,也期望本研究所草擬出的農(nóng)作物種質(zhì)資源管理辦法實(shí)施細(xì)則能為以后種質(zhì)資源保護(hù)提供新的參考。
[Abstract]:The seed is the essential means of production of agricultural production, especially in accelerating the pace of economic globalization, countries increasingly will seize the international seed market advantage as a new round of international competition situation, we must attach great importance to. This research selects China's agricultural seed industry policy and law as the starting point, carries on the construction in order to regulate the development of seed industry system, trying to provide reference for relevant departments to formulate policies to promote the development of seed industry, seed industry modernization, internationalization.
The main content of this paper mainly includes five parts: one is the basic theory research. Based on the research at home and abroad, analyzes the basic theory of the legal problems of agricultural seed industry policy in our country, such as "industrial policy and industrial policy law", the influence factors of industrial policy ", the value function, the basic theory of economic law. The law, from the theory of market regulation, Macro-control Theory, theory of interests and interests mechanism, the sustainable development theory, public goods theory, industrial security theory, market failure and government failure theory analysis. Two is the current problems of agricultural policy of seed industry legal considerations. In the central area of eastern China, and typical western areas.
