【摘要】：解放戰(zhàn)爭時期,中國共產(chǎn)黨帶領(lǐng)解放區(qū)群眾進(jìn)行了一場轟轟烈烈的土地改革運(yùn)動。這場土地改革不僅對當(dāng)時的中國社會產(chǎn)生了深刻的影響,而且也對當(dāng)今的法治建設(shè)及農(nóng)村土地制度的改革有著重要啟示。索鎮(zhèn)的土地改革是整個土地改革藍(lán)圖的重要組成部分,其實施是以中央到地方制定的一系列土改法律、政策為依據(jù)的,故索鎮(zhèn)的土改過程實際上是一個執(zhí)行土改法律、政策的過程。本文即是對索鎮(zhèn)落實上級政策法令,實施土地改革的實際情況進(jìn)行研究。全文共分為四個部分：第一部分,主要介紹了索鎮(zhèn)土地改革的歷史背景,包括索鎮(zhèn)的基本情況,土改前農(nóng)村土地的占有和使用情況,土改前的群眾運(yùn)動等。第二部分,論述了索鎮(zhèn)實施土地改革所依據(jù)的法律、政策及索鎮(zhèn)落實這些法律、政策的實際情況。土地改革初期的法律和政策主要包括：中共中央頒布的“五四指示”,中共華東中央局發(fā)出的“九一指示”和山東省政府頒布的《山東省土地改革暫行條例》；土改復(fù)查階段的法律和政策主要包括：中共華東中央局制定的“二二一指示”和“七七指示”；土改結(jié)束階段的法律和政策主要包括《中國土地法大綱》及其他法律、政策,如《在不同地區(qū)實行土地法的不同策略》、《一九四八年的土地改革和整黨工作》、《糾正土地改革宣傳中“左”傾錯誤》及中共華東局頒布的《中共華東中央局關(guān)于執(zhí)行中央一九四八年土改與整黨工作指示的報告》等。第三部分,主要論述索鎮(zhèn)貫徹土改政策法令,實施土地改革的具體情況。這一部分主要包括：黨組織對土地改革的領(lǐng)導(dǎo),基層政權(quán)與群眾組織執(zhí)行土改任務(wù)的情況,階級成份的劃分情況以及土地、浮財?shù)姆峙淝闆r。第四部分,總結(jié)索鎮(zhèn)土地改革過程中的經(jīng)驗和教訓(xùn),分析對我國法治建設(shè)的影響,尋找對解決我國當(dāng)前土地問題的啟示。
[Abstract]:During the Liberation War, the Communist Party of China led the masses of the liberated areas in a vigorous land reform movement, which not only had a profound impact on Chinese society at that time, It also has important implications for the construction of the rule of law and the reform of the rural land system. The land reform in Soho Town is an important part of the whole land reform blueprint, and its implementation is a series of land reform laws formulated by the central to local governments. Therefore, the process of land reform in Soho Town is actually a process of carrying out land reform laws and policies. The paper is divided into four parts: the first part mainly introduces the historical background of the land reform in Suo Town, including the basic situation of Suo Town, the occupation and use of rural land before the land reform. The second part discusses the laws and policies on which the land reform was carried out in Suo Township and the implementation of these laws in Suo Township. The actual situation of the policy. Interim regulations on Land Reform; laws and policies at the stage of land reform review mainly include the "221 Directive" and "77 Directive" formulated by the Eastern China Central Bureau of the Communist Party of China, and the laws and policies at the end of the land reform stage mainly include the "China Land Law University". This part mainly deals with the implementation of land reform policies and decrees in Soho Town and the specific situation of land reform. This part mainly includes: party organizations' leadership over land reform, the situation of grassroots political and mass organizations in carrying out the tasks of land reform, Part 4th summarizes the experience and lessons in the process of land reform in Saozhen, analyzes the influence on the construction of rule of law in our country, and looks for the enlightenment to solve the current land problems in our country.
