【摘要】：符合正義要求的土地法律規(guī)制問(wèn)題是當(dāng)前中國(guó)現(xiàn)代化過(guò)程中亟需解決的緊迫問(wèn)題,既有的關(guān)于土地法律規(guī)制的研究,都陷入立場(chǎng)先行或僅進(jìn)行形式分析的思維泥淖中。農(nóng)民權(quán)利保障理論要求形成以農(nóng)民合法權(quán)益為中心的法律規(guī)范體系,市場(chǎng)要素理論認(rèn)為應(yīng)通過(guò)法律形式保護(hù)好土地承包經(jīng)營(yíng)權(quán)(經(jīng)營(yíng)權(quán))的自由流轉(zhuǎn)、質(zhì)押,現(xiàn)代化進(jìn)程理論主張通過(guò)法律規(guī)制好土地增值部分如何使用的問(wèn)題。三種理論各有利弊,有關(guān)土地的法律制度安排,應(yīng)處理好土地與穩(wěn)定、發(fā)展之間的利益平衡,根據(jù)中國(guó)實(shí)際形成中國(guó)特色土地法律制度安排。
[Abstract]:In line with the land problem of legal regulation requirement of justice is an urgent problem needs to be solved urgently in the process of Chinese modernization, the existing legal regulation on land research into position of first or only form the thinking of the mud.
