【摘要】：中國(guó)正處在社會(huì)轉(zhuǎn)型時(shí)期，是社會(huì)發(fā)展的重要階段，當(dāng)前我國(guó)改革已經(jīng)進(jìn)入了“深水區(qū)”，因此也是社會(huì)矛盾的高發(fā)期，而作為承擔(dān)維護(hù)社會(huì)秩序和穩(wěn)定的警察組織則肩負(fù)重任，因?yàn)橥ǔ＞焓菍?duì)社會(huì)矛盾做出迅速反應(yīng)的第一人，，因此警察在執(zhí)法過(guò)程中的行為，以及對(duì)于糾紛解決的方式往往會(huì)直接影響到公民對(duì)警察的評(píng)價(jià)，甚至是對(duì)國(guó)家司法系統(tǒng)的信任度。因此在新形勢(shì)下，在中國(guó)社會(huì)轉(zhuǎn)型的大背景下警察職能應(yīng)當(dāng)同社會(huì)轉(zhuǎn)型下公民及政府對(duì)警察的需求相適應(yīng)，對(duì)警察職能進(jìn)行重構(gòu)，文章主要探討社會(huì)轉(zhuǎn)型時(shí)期警察組織為何需要進(jìn)行職能重構(gòu)，以及結(jié)合我國(guó)的國(guó)情和國(guó)外的警察職能轉(zhuǎn)型的特點(diǎn)尋求我國(guó)警察職能在定位的方向和途徑。本文大概兩萬(wàn)八千字，分為四個(gè)部分： 第一部分，社會(huì)轉(zhuǎn)型下警察職能的研究現(xiàn)狀。此部分是本文寫作的基石，分為國(guó)外研究現(xiàn)狀和國(guó)內(nèi)研究現(xiàn)狀，首先是明確對(duì)社會(huì)轉(zhuǎn)型時(shí)期的研究，以便于為為何重構(gòu)警察職能做鋪墊，其次是厘清對(duì)我國(guó)警察職能轉(zhuǎn)變的現(xiàn)狀，警察職能轉(zhuǎn)變的趨勢(shì)，從而對(duì)本論文的寫作產(chǎn)生啟發(fā)。 第二部分，社會(huì)轉(zhuǎn)型下警察職能所面臨的問(wèn)題。這也是我國(guó)警察職能重構(gòu)的重要原因，具體包括明確我國(guó)社會(huì)轉(zhuǎn)型時(shí)期的社會(huì)大背景，以及以英國(guó)的警務(wù)革命和我國(guó)歷史上的警察職能轉(zhuǎn)變?yōu)楸尘瓣U述社會(huì)轉(zhuǎn)型時(shí)期對(duì)我國(guó)警察職能產(chǎn)生何種影響，得出我國(guó)警察職能已經(jīng)到了適時(shí)轉(zhuǎn)變的時(shí)期的結(jié)論。 第三部分，警察職能轉(zhuǎn)變的理論依據(jù)。總結(jié)警察職能轉(zhuǎn)變的規(guī)律，從而得出我國(guó)未來(lái)警察職能的發(fā)展方向，并且用組織變革理論分析我國(guó)警察職能轉(zhuǎn)變的必要性。 第四部分，社會(huì)轉(zhuǎn)型背景下的警察職能的重構(gòu)。該部分是本文寫作的核心，對(duì)當(dāng)前我國(guó)警察的公共服務(wù)職能、秩序維護(hù)職能以及執(zhí)法職能進(jìn)行具體的分析，提出未來(lái)警察職能重構(gòu)的路徑以及實(shí)現(xiàn)條件。
[Abstract]:China is in a period of social transformation, which is an important stage of social development. At present, China's reform has entered a "deep water area", so it is also a period of high incidence of social contradictions. As a police organization, which is responsible for maintaining social order and stability, it is shouldering a heavy responsibility. Because the police are usually the first person to react quickly to social conflicts, the behavior of the police in the law enforcement process, as well as the way in which disputes are resolved, often have a direct impact on citizens' evaluation of the police. Therefore, under the new situation, under the background of social transformation in China, the police function should be adapted to the needs of the citizens and the government for the police under the social transition, and the police function should be reconstructed. This paper mainly discusses why the police organizations need to reconstruct their functions in the period of social transformation, and how to find the orientation and approach of the police functions in our country according to the national conditions of our country and the characteristics of the transformation of the police functions abroad. This paper is about 28,000 words. Divided into four parts:. The first part is the research status quo of police function under the social transformation. This part is the cornerstone of this paper, which is divided into foreign research status and domestic research status, the first is the clear study of the period of social transformation. In order to facilitate the restructuring of police functions, the second is to clarify the current situation of the transformation of police functions in China, the trend of the transformation of police functions, so as to enlighten the writing of this paper. The second part, the problems faced by the police function under the social transformation, which is also an important reason for the reconstruction of the police function in our country, including the clear social background in the period of social transformation. Based on the police revolution in Britain and the transformation of police functions in the history of our country, this paper expounds the influence of the period of social transformation on the police functions of our country, and draws the conclusion that the police functions of our country have already reached the period of timely transformation. The third part, the theoretical basis of the police function transformation, summarizes the law of the police function transformation, thus obtains the future development direction of the police function in our country, and analyzes the necessity of the police function transformation in our country with the organization change theory. Part 4th, the reconstruction of police function under the background of social transformation. This part is the core of this paper. It makes a concrete analysis of the public service function, order maintenance function and law enforcement function of the police in our country. The paper puts forward the ways and conditions for the future reconfiguration of police functions.
