【摘要】：十一世紀(jì)是海洋的世紀(jì),對(duì)蘊(yùn)藏著豐富資源的海洋進(jìn)行開發(fā)利用是發(fā)展海洋經(jīng)濟(jì)的重要途徑。渤海有著豐富多樣的海洋資源,成為環(huán)渤海經(jīng)濟(jì)發(fā)展的重要物質(zhì)基礎(chǔ),涉海工程的建設(shè)及運(yùn)營(yíng)是人們利用海洋資源最直接的方法。大規(guī)模的工程建設(shè)項(xiàng)目給我們帶來了巨大的經(jīng)濟(jì)利益,但也讓我們品嘗了海洋環(huán)境污染和生態(tài)破壞的苦果。如何實(shí)現(xiàn)對(duì)渤海的可持續(xù)開發(fā),維護(hù)海洋環(huán)境處于良好的狀態(tài)成為我們亟待解決的問題。所以深刻剖析渤海建設(shè)項(xiàng)目的監(jiān)管制度,將會(huì)為進(jìn)一步完善涉海工程建設(shè)項(xiàng)目的環(huán)境監(jiān)管、合理利用渤海資源提供依據(jù)。為達(dá)到以上目標(biāo),本文將主要從以下幾個(gè)方面入手：第一,介紹渤海工程建設(shè)項(xiàng)目發(fā)展及特點(diǎn)。第二,進(jìn)一步分析涉海工程對(duì)渤海造成的環(huán)境問題并從不同角度進(jìn)行分析,提出加強(qiáng)渤海環(huán)境監(jiān)管法律制度建設(shè)的必要性。第三,在借鑒美國(guó)切爾皮克灣及日本瀨戶內(nèi)海涉海工程的環(huán)境監(jiān)管相關(guān)制度的基礎(chǔ)上,分析我國(guó)相關(guān)法律法規(guī)及制度,總結(jié)教訓(xùn)和不足。第四,從海洋綜合管理層面分析渤海工程建設(shè)項(xiàng)目環(huán)境監(jiān)管的法律制度構(gòu)建�；谏鲜鏊悸钒才�,主要內(nèi)容如下。第一章涉海工程及環(huán)境監(jiān)管概述。主要包括定義涉海工程及其主要類型,分別從公共物品理論和海洋環(huán)境管理理論方面詳細(xì)介紹加強(qiáng)涉海工程環(huán)境監(jiān)管的重要性。第二章論述了涉海工程建設(shè)項(xiàng)目及其對(duì)渤海產(chǎn)生的環(huán)境問題。包括渤海工程的具體發(fā)展情況及特點(diǎn)。渤海環(huán)境問題的具體表現(xiàn)形式并進(jìn)行主要原因分析。主要從渤海特殊的生態(tài)系統(tǒng)、涉海工程技術(shù)的不確定性和環(huán)境監(jiān)管問題三個(gè)方面進(jìn)行闡述。第三章研究了現(xiàn)行涉海工程建設(shè)項(xiàng)目的環(huán)境監(jiān)管。分別研究借鑒美國(guó)和日本的先進(jìn)經(jīng)驗(yàn)制度。并深入論述了我國(guó)中央及渤海沿岸三省一市的海洋環(huán)境保護(hù)的立法和法律制度的相關(guān)情況,總結(jié)其中存在的不足。對(duì)海洋功能區(qū)劃制度、海洋環(huán)境影響評(píng)價(jià)制度、三同時(shí)制度等進(jìn)行了介紹。并針對(duì)海洋石油勘探開發(fā)工程建設(shè)項(xiàng)目和圍填海工程建設(shè)項(xiàng)目的環(huán)境監(jiān)管制度進(jìn)行了特別論述。第四章論述了我國(guó)加強(qiáng)渤海工程項(xiàng)目建設(shè)環(huán)境監(jiān)管制度建設(shè)的對(duì)策建議。包括涉海工程建設(shè)項(xiàng)目環(huán)境監(jiān)管法律制度建設(shè)的必要性、基本原則,并通過曹妃甸圍填海工程等具體案例的闡述,分析了環(huán)境監(jiān)管的具體法律制度構(gòu)建。
[Abstract]:In 11th century, the century of the ocean, the exploitation and utilization of the rich marine resources is an important way to develop the marine economy. The Bohai Sea has rich and diverse marine resources, and has become an important material basis for the economic development of the Bohai Sea. The construction and operation of sea-related projects is the most direct way for people to make use of marine resources. Large-scale construction projects bring us enormous economic benefits. But let's also taste the bitter fruits of marine environmental pollution and ecological destruction. How to achieve sustainable development of the Bohai Sea, Maintaining the marine environment in a good state has become an urgent problem for us to solve. Therefore, a deep analysis of the supervision system of the construction projects in the Bohai Sea will further improve the environmental supervision of the construction projects involving the sea. In order to achieve the above objectives, this paper will mainly start from the following aspects: first, introduce the development and characteristics of Bohai engineering construction projects. Further analyzing the environmental problems caused by the sea related projects to the Bohai Sea and analyzing from different angles, the necessity of strengthening the legal system of the Bohai Sea environmental supervision is put forward. Third, On the basis of drawing lessons from the related environmental supervision systems of the Cherpike Bay of the United States and the Seto Sea Project in Japan, this paper analyzes the relevant laws, regulations and systems of our country, and summarizes the lessons and shortcomings. 4th, This paper analyzes the construction of legal system for the environmental supervision of Bohai engineering construction projects from the perspective of comprehensive marine management. The main contents are as follows. The first chapter is an overview of marine engineering and environmental regulation. It mainly includes the definition of marine engineering and its main types, The importance of strengthening environmental supervision of sea-related engineering is introduced in detail from the aspects of public goods theory and marine environmental management theory. Chapter 2 discusses the construction projects of sea-related projects and their environmental problems to the Bohai sea, including the Bohai sea. The concrete development and characteristics of the project, the concrete manifestation of the Bohai Sea environmental problems and the analysis of the main reasons. Mainly from the special ecosystem of the Bohai Sea, The third chapter studies the environmental supervision of the current marine engineering construction projects, studies the advanced experience system of the United States and Japan respectively. This paper discusses the relevant situation of the legislation and legal system of marine environment protection of the central authorities and three provinces and one city along the Bohai Sea. To sum up the shortcomings of marine functional regionalization system, marine environmental impact assessment system, The three simultaneous systems are introduced, and the environmental supervision system of offshore oil exploration and development projects and surrounding reclamation construction projects is discussed in particular. Chapter 4th discusses the strengthening of Bohai Sea engineering projects in China. The countermeasures and suggestions for the construction of the environmental supervision system, including the necessity of the legal system construction of environmental supervision in the construction projects involving the sea, Basic principles, and through the Caofeidian reclamation project and other specific cases, analyzed the construction of the specific legal system of environmental supervision.
